Section III: Legal, economic, financial and technical information

III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 164, 165, 167 din Legea 98/2016. Ofertantii, tertii sustinatori si subcontractantii vor depune documentul DUAE, iar operatorilor economici clasati pe primele doua locuri li se vor solicita documentele justificative pentru declaratiile din acest document, in vederea probarii acestora. Vor fi exclusi din procedura operatorii economici care se regasesc in una din situatiile prevazute la art. 164, 165 si 167 din L98/2016. In sensul verificarii prevazute la art. 170 alin. (1) din Legea nr. 98/2016, subcontractantii completeaza declaratia pe propria raspundere in conformitate cu prevederile art. 193-195 din aceeasi lege, precizand ca nu se afla in niciuna din situatiile ce atrag excluderea din procedura de atribuire. Ofertantilor clasati pe locurile I si II in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor, li se vor solicita, in vederea probarii celor asumate in DUAE, urmatoarele:

— certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidate (bugetul local si de stat) la momentul prezentarii;

— cazierul judiciar al operatorului economic si al membrilor organizatiei de administrare, de conducere sau de supraveghere al respectivului operator economic sau a celor ce au putere de reprezentare, de decizie sau control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/act constitutiv;

— dupa caz, documente prin care se demonstraza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2) si art. 171 din Legea 98/2016;

— alte documente edificatoare, dupa caz.

Ofertantii straini vor prezenta orice documente edificatoare, eliberate de autoritati competente din tara in care acestia sunt rezidenti, prin care sa dovedeasca lipsa datoriilor restante catre bugetul de stat si bugetul local, in conformitate cu legislatia din tara de rezidenta. Documentele se vor prezenta insotite de traducere autorizata a acestora in limba romana.

Neincadrarea in situatiile prevazute de art. 5863 din Legea nr.98/2016 – Formularul 5.

Persoanele cu functie de decizie in cadrul AC in ceea ce priveste organizarea, derularea si finalizarea procedurii sunt:

— dr. Rotaru Lucia – manager;

— dr. Goldstein Dana Silvia – director medical interimar;

— dir. financiar-contabil – ec.Butiuc Cornel;

— dr. epidemiologie Ifrim Simona – membru comisie;

— ec. Vrinceanu Luminita – presedinte comisie;

— asistent medical CPIAAM – Lungu Bogdan.

Operatorii economici care nu vor prezenta toate documentele mentionate mai sus vor fi descalificati.

1. Operatorii economici care depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii, precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE, respectiv certificat constatator emis de ONRC sau in cazul ofertantilor straini, documente echivalente emise in tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre primii doi ofertanti considerati castigatori in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor;

2. Persoane juridice/fizice straine: documente edificatoare care sa dovedeasca o forma de inregistrare ca persoana juridica sau inregistrare/atestare din punct de vedere profesional, in conformitate cu prevederile legale din tara in care ofertantul este rezident.

Persoane juridice/fizice: certificat constatator emis de ONRC din care sa rezulte obiectul de activitate al operatorului economic. Obiectul contractului trebuie sa aiba corespondent in codul CAEN din certificatul constatator emis de ONRC;

3. Avizul/autorizatia/certificatul de recunoastere reciproca eliberat/eliberata de Comisia Naţionala pentru Produse Biocide, conform Ordinului ministrului sănătăţii, al ministrului mediului şi pădurilor şi al preşedintelui Autorităţii Naţionale Sanitare;

4. Certificatul de marcaj CE;

5. Fişa tehnică a produsului;

6. Fisa cu date de securitate;

7. Eticheta produsului, cu text in limba romana, care sa cuprinda informatiile;

8. Prospectul cu text in limba romana;

9. Condiţii tehnice de asigurare a calităţii.

List and brief description of selection criteria:

Loturile: 1, 10, 11, 12, 13, 2, 3, 4, 5, 6, 7, 8, 9. Pentru contractele de achizitie de bunuri: executarea de livrari de tipul specificat. Lista principalelor livrari de produse similare din ultimii trei ani, minimum o livrare/contract – copie dupa documente justificative (contracte/documente/certificate, alte documente) din care sa rezulte ca in ultimii trei ani au fost furnizate produse similare, minimum un contract/livrare, insotit de dovada livrarii.

Minimum level(s) of standards possibly required:

Completare in DUAE a minimum un contract/livrare. Documentele solicitate in vederea sustinerii cerintei vor fi prezentate, la solicitarea autoritatii contractante, la finalizarea evaluarii, doar de ofertantii clasati pe primele doua locuri in clasamentul intermediar, întocmit la finalizarea evaluarii ofertelor.
