III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art 164, 165, 167 din Legea nr 98/ 2016. Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre toti operatorii economici participant la procedura de atribuire, cu informatiile aferente situatiei lor.

Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante conform Art 196 din Legea nr. 98/2016 doar de catre ofertantii clasati pe primele 5 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

Aceste documente pot fi:

1. Certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidate (buget local, buget de stat etc) la momentul prezentarii;

2. Declaratie pe propria raspundere privind respectarea prevederilor art. 59-60 din legea 98/ 2016.

1.Operatorii economic ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii, precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE, respectiv certificat constatator emis de ONRC, sau in cazul ofertantilor straini, documente echivalente emise in tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele 5 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

2.Persoane juridice/ fizice straine: documente edificatoare care sa dovedeasca o forma de inregistrare ca persoana juridica sau inregistrare/ atestare din punct de vedere profesional, in conformitate cu prevederile legale din tara in care ofertantul este rezident Persoane juridice/ fizice: Certificat constatator emis de ONRC din care sa rezulte obiectul de activitate al operatorului economic. Obiectul contractului trebuie sa aiba corespondent in codul CAEN din certificatul constatator emis de ONRC. Se va prezenta in original sau copie conform cu originalul.

3.Aviz de functionare emis de Ministerul Sanatatii pentru activitatea de comercializare si distributie pentru categoria produselor ofertate, conform Legii 95/ 2006 art. 926, republicata si actualizata - se va completa in DUAE la sectiunea Finalizare partea 5 (specificati /enumerati toate documentele solicitate prin Fisa de date. De exemplu: Certificat constatator, Aviz de functionare emis de Ministerul Sanatatii etc) urmand ca documentul justificativ, respectiv Avizul de functionare sau pentru ofertantii straini, document echivalent emis in tara de rezidenta, sa fie prezentat doar la solicitarea AC la finalizarea evaluarii ofertelor de catre ofertantii clasati pe primele 5 locuri

Elementul care va face obiectul procesului repetitiv este pretul unitar. Procesul repetitiv va avea loc prin intermediul SEAP (www.e-licitatie.ro). În timpul licitatiei electronice operatorul SEAP va pune la dispozitia ofertantilor informatii privind numarul de participanti care liciteaza electronic, precum si cel mai scazut pret. Numar runde 1 Durata rundei 1 zi lucratoare (24 ore) Dupa licitatia electronica ofertantul declarat câstigator va avea obligatia de a transmite o noua oferta financiara semnata si stampilata. La etapa finala a acestei faze, sistemul informatic va pune la dispozitia autoritatii contractante clasamentul final.
