List and brief description of conditions:

Cerinta nr. 1: Neincadrarea in situatiile prevazute la art. 164, 165 si 167 din Legea 98/2016 privind achizitiile publice. Ofertantii/ membrii asocierii/ subcontractantii/tertii sustinatori nu trebuie sa se regaseasca in situatiile prevazute la art. 164, 165 si 167 din Legea 98/2016 privind achizitiile publice. Incadrarea in situatiile prevazute la art. 164, 165 si 167 din Legea 98/2016 atrage excluderea oricarui operator economic din procedura aplicata pentru atribuirea contractului de achizitie publica.

Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative, care probeaza indeplinirea celor asumate prin completarea DUAE sunt: a) CERTIFICATE CONSTATATOARE privind lipsa datoriilor cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (BUGET LOCAL, BUGET DE STAT, etc.), la momentul prezentarii; b) CAZIERUL JUDICIAR AL OPERATORULUI ECONOMIC SI AL MEMBRILOR ORGANULUI DE ADMINISTRARE, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv; c) dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 179 alin. (2), art. 180 alin. (2), art 187 din Legea 99/2016 privind achizitiile publice; d) alte documente edificatoare, dupa caz. Acestea urmeaza a fi prezentate la solicitarea autoritatii contractante doar de catre ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

Cerinta nr. 2: Declaratie privind neincadrarea in prevederile art.59 (evitarea conflictului de interese) coroborat cu art.60 din Legea nr.98/2016 . Ofertantul unic/Ofertantul asociat/Subcontractantul/Tertul sustinator, va prezenta o Declaratie cu privire la conflictul de interese în conformitate cu prevederile art. 60 alin. (1) lit. a), lit. d) si lit. e) din Legea nr. 98/2016 privind achizitiile publice. Se va completa Formularul aferent din Sectiunea „Formulare” din Documentatia de Atribuire si se va semna cu semnatura electronica extinsa, bazata pe un certificat calificat, eliberat de un furnizor de servicii de certificare acreditat in conditiile legii. Se va prezenta de catre Ofertantul unic/Ofertantul asociat/Subcontractantul/Tertul sustinator, odata cu DUAE la secțiunea corespunzătoare cerinței. Persoanele cu functie de decizie din cadrul autoritatii contractante, in ceea ce priveste organizarea, derularea si finalizarea procedurii de atribuire, sunt:

Nota:

In sensul dispozitiilor art. 60 alin. (1) lit. d), prin actionar sau asociat semnificativ se intelege persoana care exercita drepturi aferente unor actiuni care, cumulate, reprezinta cel putin 10% din capitalul social sau ii confera detinatorului cel putin 10% din totalul drepturilor de vot in adunarea generala Incadrarea in situatia prevazuta la art. 164, 165, 167 din Legea nr. 98/2016 privind achizitiile publice, atrage exluderea ofertantului din procedura aplicata pentru atribuirea contractului de achizitie publica. Autoritatea contractantă va accepta ca fiind suficient şi relevant pentru demonstrarea faptului că ofertantul nu se încadrează în una dintre situaţiile prevăzute la art. 164, 165 şi 167, orice document considerat edificator, din acest punct de vedere, în ţara de origine sau în ţara în care ofertantul este stabilit, cum ar fi certificate, caziere judiciare sau alte documente echivalente emise de autorităţi competente din ţara respectivă. În cazul în care în ţara de origine sau în ţara în care este stabilit ofertantul nu se emit documente de natura celor prevăzute la alin. (1) sau respectivele documente nu vizează toate situaţiile prevăzute la art. 164, 165 şi 167, autoritatea contractantă va accepta o declaraţie pe propria răspundere sau, dacă în ţara respectivă nu există prevederi legale referitoare la declaraţia pe propria răspundere, o declaraţie autentică dată în faţa unui notar, a unei autorităţi administrative sau judiciare sau a unei asociaţii profesionale care are competenţe în acest sens. Referitor la termenul legal de exigibilitate a datoriilor către bugetul statului respectiv, ofertanții străini vor dovedi îndeplinirea obligațiilor de plată în conformitate cu legislația din țara de rezidență. Documentele vor fi prezentate in copie legalizata sau copie lizibila semnata avand mentiunea conform cu originalul, la care se va anexa traducerea autorizata a acestora in limba romana,acolo unde este cazul, semnate cu semnatura electronica extinsa Potrivit prevederior Art. 60. - (1) din HG nr. 395/2016, operatorul economic are obligaţia de a transmite oferta şi DUAE în format electronic şi numai până la data şi ora-limită de depunere a ofertelor prevăzute în anunţul de participare. Se vor mai depune, odată cu DUAE, următoarele documente: angajamentul ferm al terțului susținător + anexa din care rezultă modul efectiv în care se va materializa susținerea acestuia, acordul de subcontractare și/sau acordul de asociere, după caz. Nedepunerea acestora odată cu DUAE, constituie temei pentru solicitarea de clarificări pentru eventualele inadvertențe de formă ale informațiilor cuprinse în secțiunile DUAE, atât ale ofertantului/candidatului, cât și ale subcontractantului/terțului susținător, acest lucru fiind necesar pentru a asigura desfășurarea corespunzătoare a procedurii de atribuire.

Cerinta nr. 1 – Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, din care sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documente probatorii, pe care operatorii economici sunt obligati sa le prezinte doar la solicitarea autoritatii contractante la finalizarea evaluarii ofertelor: certificat constatator emis de ONRC, sau in cazul ofertantilor straini, documente echivalente emise in tara de rezidenta. Informatiile cuprinse in certificatul constatator trebuie sa fie reale/actuale la momentul prezentarii. In cazul ofertantilor de alta nationalitate decat cea romana, documentele vor fi insotite de o traducere a acestora in limba romana. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

Cerinta nr. 2 -Avizul de functionare emis de Ministerul Sanatatii cu toate anexele acestuia conform legii nr.176/2000 privind dispozitivele medicale sau dupa caz documente din care rezulta inregistrarea operatorului economic la Ministerul Sanatatii;

Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.

Documente probatorii, pe care operatorii economici sunt obligati sa le prezinte doar la solicitarea autoritatii contractante la finalizarea evaluarii ofertelor: Aviz de functionare emis de Ministerul Sanatatii Publice cu toate anexele acestuia in conformitate cu Legea 95/2006 si OUG nr. 2/2014 pentru modificarea si completarea Legii 95/2006 privind reforma in domeniul sanatatii, art. 926.

1.Comisia de evaluare are dreptul de a solicita completari/clarificari la ofertele depuse.

2. Stabil ofer castig se realiz numai prin comparare pret faraTVA/UM prez in ofer admisib, prin intocmirea, in ordine crescatoare a unui clasament pe baza caruia se stabilesc ofertele castigatoare, fara sa fie cuantificate alte elemente.Oferta decl castig trebuie sa indepl caract tehnice din CS. In cazul in care exista oferte pe loc 1 ce prezinta pret egal, se va solicita reofertare prin intermediul SEAP-ului in vederea departajarii ofertelor. 4. Autoritatea contractanta va continua procedura de atribuire, chiar daca va exista doar un singur operator economic cu oferta admisibila, si va incheia acordul cadru doar cu acel operator economic.
