Contract de furnizare produse "APARATURA MEDICALA" așa cum sunt specificate în sectiunea II.2 Lista loturi a prezentei fise de date si in caietul de sarcini.

Numarul de zile pana la care se pot solicita clarificari inainte de data limita de depunere a ofertelor/candidaturilor este de 10 zile.

Autoritatea contractanta va raspunde in mod clar si complet tuturor solicitarilor de clarificari sau informatiilor suplimentare in a 5-a zi inainte de data limita de depunere a ofertelor, in conformitate cu prevederile art. 161, alin (1) din Legea 98/2016.

Justificare privind stabilirea numarului de zile:

Pentru aceasta procedura a fost publicat anunt de intentie asa cum se poate vedea la pct. IV.2.1 din prezenta fisa de date deci anuntul de participare va sta postat pe SEAP 15 zile conform art. 74 alin. 2 din Legea 98/2016

III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

Informatii si formalitati necesare pentru evaluarea respectarii cerintelor mentionate:

Ofertantul, tertul sustinator, subcontractantul nu trebuie sa se regaseasca în situatiile prevazute la art. 60, art. 164, art. 165 si art. 167 din Legea nr.98/2016.

Modalitatea prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatii aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE la momentul prezentarii (cum ar fi certificate care atesta lipsa datoriilor restante la momentul prezentarii acestora cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat), cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin.(2), art. 167 alin.(2), art. 171 din Legea nr. 98/2016, precum si orice alte documente edificatoare, dupa caz) urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre operatorul economic clasat pe primul loc in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor. În situatia în care în urma demersurilor realizate de autoritatea contractanta în baza art. 196 alin. (2) din Legea 98/2016 ofertantul clasat pe primul loc nu demonstreaza în mod corespunzator îndeplinirea integrala a tuturor criteriilor de calificare, autoritatea contractanta solicita ofertantului clasat pe locul urmator sa depuna toate documentele justificative ca dovada a informatiilor cuprinse în DUAE, în scopul verificarii îndeplinirii criteriilor de calificare. Autoritatea contractanta va atribui contractul de achizitie publica ofertantului clasat pe locul urmator, daca acesta îndeplineste toate criteriile de calificare prevazute în anuntul de participare si/sau în fisa de date a achizitiei. Dupa completarea DUAE in conformitate cu Notificarea ANAP nr.240/2016, operatorii economici vor fi obligati sa prezinte la solicitarea autoritatii contractante documentele solicitate în cadrul acestei sectiuni care se pot încarca prin scanarea urmatoarelor tipuri de forme: original, copie legalizata, copie lizibila cu mentiunea „conform cu originalul” semnat si stampilat. Fisierele scanate vor fi semnate electronic.

1. Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara rezidenta, din care sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.

Certificatul constatator emis de ONRC, sau in cazul ofertantilor straini, documente echivalente emise in tara de rezidenta, urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre operatorul economic clasat pe primul loc in clasamentul intocmit la finalizarea evaluarii ofertelor.

2. Avizul de functionare emis de MINISTERUL SANATATII

Cerinta obligatorie:

Deținerea Avizului de funcționare eliberat de Ministerul Sănătății (inclusiv anexele) valabil la data prezentării acestuia conform prevederilor art. 2 din Normele Metodologice de aplicare a titlului XX din Legea 95/2006, aprobate prin Ordinul MS nr. 566/2020.

1. AVIZUL DE FUNCTIONARE cu toate anexele acestuia, emis de M.S. pentru activitatea de import și/sau distribuție dispozitive medicale și este distribuitor al producătorului aparatului medical ofertat.

2. AVIZUL DE FUNCTIONARE cu toate anexele acestuia emis de M.S. pentru activitatea de reparare, mentenanță a aparatului medical ofertat.

3. Furnizorul, în cazul în care nu este autorizat pentru efectuarea intervențiilor tehnice va nominaliza operatorul economic, respectiv subcontractantul/terțul susținător, operator care va putea asigura service-ul aparatului ofertat/lot conform caietului de sarcini, pentru care va prezenta AVIZUL DE FUNCȚIONARE

Modalitatea de îndeplinire: Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE, sunt

obligatorii sa fie prezentate, la solicitarea autoritatii contractante, de catre ofertantul clasat pe primul loc în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor. Nota: Operatorii straini vor demonstra indeplinirea cerintelor completand DUAE. Documentele justificative ce probeaza indeplinirea celor asumate prin completarea DUAE, respectiv documentele echivalente, emise in tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe primul loc în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor.

Ofertantul va elabora oferta in conformitate cu prevederile din documentatia de atribuire si va indica in cuprinsul acesteia care informatii din propunerea tehnica si/sau din propunerea financiara sunt confidentiale, clasificate sau sunt protejate de un drept de proprietate intelectuala. Oferta are caracter obligatoriu, din punctul de vedere al continutului, pe toata perioada de valabilitate stabilita de catre autoritatea contractanta si asumata de ofertant. Comisia de evaluare are obligatia de a stabili oferta câstigatoare, dintre ofertele admisibile, pe baza aplicarii criteriului pentru atribuirea contractului de achizitie publica. Înainte de atribuirea contractului de achizitie publica autoritatea contractanta solicita ofertantului clasat pe primul loc dupa aplicarea criteriului de atribuire sa prezinte fara intarziere documente justificative actualizate prin care sa demonstreze indeplinirea tuturor criteriilor de calificare, in conformitate cu informatiile cuprinse în DUAE. Orice comunicare, solicitare, informare, notificare si altele asemenea vor fi incarcate in SEAP si vor fi semnate cu semnatura electronica extinsa, bazata pe un certificat calificat, eliberat de un furnizor de servicii de certificare acreditat în conditiile legii.
