In masura in care solicitarile de clarificari sau informatiile suplimentare au fost adresate in termenul prevazut in anuntul de participare, termenul-limita in care autoritatea va raspunde in mod clar si complet tuturor solicitarilor de clarificare/informatiilor suplimentare -conform prevederile OUG 107/2017 este de 12 zile inainte de termenul stabilit pentru depunerea ofertelor. Numarul de zile pana la care se pot solicita clarificari inainte de data limita de depunere a ofertelor/candidaturilor: 20 zile. “Anexa II loturi”este atasata in cadrul documentatiei - la rubrica,,Documente atasate ce compun Documentatia de Atribuire".

Potrivit prevederilor art.193 din Legea 98/2016, autoritatea contractanta va accepta in cadrul ofertelor DUAE (Documentul Unic de Achizitie European) in locul documentelor solicitate in vederea demonstrarii cerintelor de calificare, inclusiv a capacitatii de exercitare, ca dovada preliminara. DUAE se completeaza de catre ofertanti direct in SICAP. (instructiuni privind completarea DUAE sunt disponibile la adresa www.e-licitatie.ro). Înainte de atribuirea acordului-cadru, autoritatea contractanta va solicita ofertantului clasat pe primul loc în clasamentul intermediar întocmit la finalizarea evaluării ofertelor, sa prezinte documentele justificative actualizate prin care sa demonstreze îndeplinirea tuturor criteriilor de calificare, în conformitate cu informatiile cuprinse în DUAE. Documentele justificative pot fi: 1.• certificate constatatoare privind lipsa datoriilor RESTANTE cu privire la plata impozitelor, taxelor sau a contribuţiilor la bugetul general consolidat (buget local, buget de stat etc.) la momentul prezentării; 2.• cazierul judiciar al operatorului economic și al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, așa cum rezultă din certificatul constatator emis de ONRC / actul constitutiv; 3.• după caz, documente prin care se demonstrează faptul ca operatorul economic poate beneficia de derogările prevăzute la art. 166 alin. DUAE se va depune, dupa caz, de catre tertul sustinator si de subcontractant. În cazul operatorilor economici straini se vor prezenta documente echivalente emise în conformitate cu legislatia aplicabila în tara de rezidenta.

5.Certificat de Atestare Fiscala eliberata de Administratia Financiara care sa stipuleze ca Ofertantul/candidatul nu are datorii la bugetul consolidat de stat restante la momentul prezentarii. Asadar, dovada achitarii taxelor se va face prin prezentarea formularelor tip emise de organismele competente - doar de catre ofertantul clasat pe primul loc.

6. CERTIFICAT DE ATESTARE FISCALA PT. 1.Certificat constatator emis de Oficiul National al Registrului Comertului, din care sa rezulte adresa actuala si obiectul de activitate al respectivului operator economic. Obiectul contractului trebuie sa aiba corespondent in codul CAEN din certificatul constatator emis de O.N.R.C..Certificatului Constatator eliberat de Oficiul Registrului Comertului, informatiile cuprinse in acesta trebuie sa fie reale/actuale la momentul prezentarii. Inainte de transmiterea comunicarii privind rezultatul procedurii de atribuire,ofertantului clasat pe primul loc i se va solicita sa prezinte ptr. conformitate documentul in orginal/ copie legalizata in situatia in care a fost prezentat in forma copie conform cu originalul sau in format electronic.
