Incheierea unui acord-cadru cu o durata de 24 luni pentru MOBILIER MEDICAL

1. Numarul de zile pana la care se pot solicita clarificari inainte de data limita de depunere a ofertelor/candidaturilor este de 20 zile.

2. Autoritatea contractanta va raspunde in mod clar si complet tuturor solicitarilor de clarificare/informatiilor suplimentare, care au fost adresate in termenul prevazut in anuntul de participare, in a 10-a zi inainte de termenul limita de depunere a ofertelor/candidaturilor.

Nota: Autoritatea contractanta nu este obligata sa raspunda solicitarilor de clarificari / informatiilor suplimentare care nu au fost adresate in termenul stabilit la pct. 1, invocat mai sus

The contracting authority reserves the right to award contracts combining the following lots or groups of lots:

Loturile 6, 7 și de la 9÷18 vor fi atribuite aceluiași ofertant, în baza art.141 alin.9 din Legea nr.98/2016, prin aplicarea criteriului de atribuire “cel mai bun raport calitate-pret”, efectuându-se o evaluare comparativă raportată la valoarea totală rezultată din cumulul valorilor ofertate pentru fiecare lot în parte.

În cazul loturilor 6, 7 și de la 9÷18, a fost aleasă modalitatea de atribuire enunțată anterior, în conformitate cu prevederile specificațiilor tehnice anexate Caietului de sarcini, în scopul asigurării următoarelor avantaje:

- uniformitatea produselor furnizate;

- aceeași nuanță de culoare pentru materialul din care vor fi confecționate articolele de mobilier;

- aceleași finisaje pentru toate produsele;

- posibilitatea ofertării de către operatorii economici a unui preț mai mic pentru achiziție, având în vedere cantitatea de produse;

Section III: Legal, economic, financial and technical information

III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

A) Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca în situatiile prevazute la art. 59, 60, 164, 165, 167 din Legea nr.98/2016 cu modificarile si completarile ulterioare.

Autoritatea contractantă aplică următoarele motive de excludere: conform prevederilor art. 169 din Legea 98/2016 cu modificarile si completarile ulterioare.

Modalitatea prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.

Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, de catre operatorii economici clasati pe locurile I, II si III în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor.

Aceste documente sunt:

1. certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) la momentul prezentarii;

2. cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv;

3. dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice cu modificarile si completarile ulterioare;

4. alte documente edificatoare, dupa caz

Fiecare document va fi semnat de reprezentantul legal al ofertantului. În cazul în care documentele sunt semnate de o alta persoana, aceasta va prezenta o împuternicire.

Documentele emise în alta limba decât româna vor fi însotite de traducerea autorizata în limba româna.

Toate documentele vor avea, pe lânga semnatura, mentionat în clar numele, prenumele si functia semnatarului.

Tertul care sustine capacitatea tehnica si profesionala/economica sau financiara a operatorului economic participant la procedura precum si subcontractantul au obligatia de a prezenta documentele enumerate mai sus.

Toate documentele se vor depune in S.I.C.A.P. semnate cu semnatura electronica extinsa, conform art 60 alin. (4) din HG 395/2016 cu modificarile si completarile ulterioare.

La finalizarea evaluarii ofertelor autoritatea contractanta va solicita ofertantilor clasati pe locurile I, II si III, dupa aplicarea criteriului de atribuire, sa prezinte documentele justificative actualizate prin care sa demonstreze indeplinirea criteriilor de calificare, in conformitate cu informatiile cuprinse in DUAE.

Atenționări speciale:

1. Nedepunerea DUAE odată cu oferta (inclusiv pentru asociat/terț susținător) atrage respingerea acesteia ca inacceptabilă.

2. Se vor depune, odata cu DUAE, urmatoarele documente : angajamentul ferm al terțului susținător din care rezultă modul efectiv în care se va materializa susținerea acestuia, a acordului de subcontractare și/sau a acordului de asociere, după caz. Nedepunerea acestora odată cu DUAE, constituie temei pentru solicitarea de clarificări pentru eventualele inadvertențe de formă ale informațiilor cuprinse în secțiunile DUAE, atât ale ofertantului/candidatului, cât și ale subcontractantului/terțului susținător, acest lucru fiind necesar pentru a asigura desfășurarea corespunzătoare a procedurii de atribuire.

B) Cerinta: Conform art. 182 din Legea 98/2016 cu modificarile si completarile ulterioare, operatorul economic are dreptul, daca este cazul si în legatura cu un anumit contract de achizitie publica sa invoce sustinerea unui/unor tert/terti în ceea ce priveste îndeplinirea criteriilor referitoare la capacitatea tehnica si profesionala, indiferent de natura relatiilor juridice existente între operatorul economic si tertul/tertii respectiv/respectivi. In cazul in care exista subcontractanti, ofertantul trebuie sa precizeze partea/partile din contract care este/sunt indeplinita/indeplinite de subcontractanti si specializarea acestora. Se vor prezenta informatii si documente relevante în conformitate cu art. 174 din Legea 98/2016 privind achizitiile publice cu modificarile si completarile ulterioare, la solicitarea autoritatii contractante, la finalizarea evaluarii ofertelor.

Modalitate de indeplinire:

Se vor depune odata cu DUAE urmatoarele documente: angajamentul ferm al tertului sustinator, a acordului de subcontractare si/sau a acordului de asociere, dupa caz. Odata cu angajamentul de sustinere, ofertantul/ candidatul are obligatia sa prezinte documente transmise acestuia de catre tert/tertii sustinatori, din care sa rezulte modul efectiv prin care tertul/ tertii sustinatori va/vor asigura îndeplinirea propriului angajament de sustinere, documente care se vor constitui anexe la respectivul angajament.

Nedepunerea DUAE odata cu oferta (inclusive pentru asociat/subcontractant/tert sustinator) atrage respingerea acesteia ca inacceptabila.

Documentele-suport justificative urmeaza sa fie prezentate, la solicitarea autoritatii contractante, de catre operatorii economici clasati pe locurile I, II si III în clasamentul intermediar, pâna la finalul evaluarii. Autoritatea contractanta respinge tertul sustinator propus daca acesta nu îndeplineste cerintele de calificare privind capacitatea se încadreaza printre motivele de excludere si solicita candidatului/ofertantului o singura data – inlocuirea acestuia si prezentarea unui alt tert, cu respectarea principiului tratamentului egal.

Toate documentele se vor depune in SICAP semnate cu semnatura electronica extinsa, conform art 60 alin. (4) din HG 395/2016 cu modificarile si completarile ulterioare.

Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.

Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE, respectiv certificat constatator emis de Oficiul Naţional al Registrul Comerţului, sau in cazul ofertantilor straini, documente echivalente emise in tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante de catre ofertanti clasati pe locurile I,II si III - in clasamentul intermediar intocmit la finalizarea ofertelor. Obiectul contractului trebuie sa aiba corespondent in codul CAEN din certificatul constatator emis de O.N.R.C. Imposibilitatea demonstrării înregistrării ofertantului ca persoana juridică/fizice având in obiectul de activitate furnizare produse care sunt cerute prin prezenta documentaţie, atrage excluderea ofertantului de la procedura pentru atribuirea contractului

Toate documentele se vor depune in S.I.C.A.P. semnate cu semnatura electronica extinsa, conform art 60 alin. (4) din HG 395/2016 cu modificarile si completarile ulterioare.
