Rok za izjavljivanje žalbe na dokumentaciju o nabavi je 10 (deset) dana, i to od dana:

1. objave poziva na nadmetanje, u odnosu na sadržaj poziva ili dokumentacije o nabavi,

2. objave obavijesti o ispravku, u odnosu na sadržaj ispravka,

3. objave izmjene dokumentacije o nabavi, u odnosu na sadržaj izmjene dokumentacije.

Naziv i adresa žalbenog tijela: Državna komisija za kontrolu postupaka javne nabave, Koturaška cesta 43/IV, 10 000 Zagreb.

Članak 405. ZJN 2016:

(1) Žalba se izjavljuje Državnoj komisiji u pisanom obliku.

(2) Žalba se dostavlja neposredno, putem ovlaštenog davatelja poštanskih usluga ili elektroničkim sredstvima komunikacije putem međusobno povezanih informacijskih sustava Državne komisije i EOJN RH.

(3) Žalitelj je obvezan primjerak žalbe dostaviti naručitelju u roku za žalbu.

(4) Kad je žalba upućena putem ovlaštenog davatelja poštanskih usluga, dan predaje ovlaštenom davatelju poštanskih usluga smatra se danom predaje Državnoj komisiji, odnosno naručitelju.

(5) Pravodobnost žalbe utvrđuje Državna komisija, s time da će se žalba koja nije dostavljena naručitelju u skladu sa stavkom 3. ovoga članka smatrati nepravodobnom.

(6) Oblik i način dostave žalbe elektroničkim sredstvima komunikacije, način povezivanja informacijskih sustava i druga bitna pitanja u vezi s elektroničkom žalbom propisuje čelnik središnjeg tijela državne uprave nadležnog za politiku javne nabave, pravilnikom.

Sukladno Pravilniku o elektroničkoj žalbi u javnoj nabavi (Narodne novine, broj 101/2017) žalba se može dostaviti i elektroničkim sredstvima komunikacije putem sustava e-Žalba.
