Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

165 – Auf Anordnung des AG (BB75 vom 26.05.2020) hat der AN MHEL die Vorsignalbarke NE3 zum Signal f bei km 21,905 der Strecke 4530 versetzt. Diese Leistung wurde erforderlich, da ein neu errichteter Oberleitungsmast das Signal NE3 verdeckt hat. Der Mast wurde nach der Errichtung der Vorsignalbarke errichtet und hat die Sicht auf die Barke verdeckt. Aufgrund einer Anordnung des Abnahmeprüfers musste die Barke versetzt werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Baudurchführung im Bereich der Bahnstrecke erfolgt hauptsächlich vom Gleis aus, da die Baubereiche über weite Strecken nicht über das Straßennetz zugänglich sind. Alle Arbeiten im Zusammenhang mit dem Kabeltiefbau werden durch den AN Bau MHEL erbracht. Aus diesem Grund kann ein Dritter hier nicht ohne erhebliche Koordinationsprobleme tätig werden.
