III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

1.Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca în situatiile prevazute la art.58-60 din Legea nr.98/2016. 2. Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca în situatiile prevazute la art.164, 165, 167 din Legea nr.98/2016 Modalitatea prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor. Aceste documente pot fi: certificate constatatoare privind lipsa datoriilor restante, cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) la momentul prezentarii; cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic sau al celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/actul constitutiv; dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice; alte documente edificatoare, dupa caz. Persoanele cu functie de decizie in cadrul Spitalului Clinic de Urgenta pentru Copii Brasov sunt: - ec. Monica Sabadusi - manager,dr. Liviu Muntean - director medical, ec. Anica Bojte - director financiar contabil, ref. Ioan Fejer - sef serviciu administrativ - aprovizionare

Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE, respectiv certificat constatator emis de ONRC, sau în cazul ofertantilor straini, documente echivalente emise în tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor.

Loturile: 1,2,3,4,5,6,7 Pentru contractele de achizitie de bunuri: executarea de livrari de tipul specificat Justificare cerinte minime privind capacitatea tehnica: in vederea demonstrarii credibilitatii si capacitatii tehnice a ofertantului se solicita o lista a principalelor livrari de produse efectuate in ultimii 3 ani, din care sa rezulte ca a furnizat produse a caror valoare cumulata a fost cel putin egala cu valoarea estimata a contractului: pentru lotul 1 –80280 de lei, pentru lotul 2 – 39710 de lei, pentru lotul 3 – 559800 de lei, pentru lotul 4 – 81840 de lei, pentru lotul 5 – 1530 de lei, pentru lotul 6 – 5294.16 de lei, pentru lotul 7 – 42696 de lei, insotita de certificate/documente care atesta masurile implementate de operatorul economic prin care se garanteaza trasabilitatea produselor pe lantul de aprovizionare.

Minimum level(s) of standards possibly required:

Lista se va prezenta prin DUAE. Documentele solicitate pentru demonstrarea celor asumate in DUAE si anume: certificari/documente/contracte/parti relevante ale contractelor/procese verbale,documente justificative care probeaza cele asumate in angajamente/acorduri etc vor fi solicitate doar operatorului economic clasat pe primul loc, pana la finalizarea evaluarii. Modalitate prin care poate fi demonstrată îndeplinirea cerinţei: se va completa DUAE de către operatorii economici participanţi la procedura de atribuire cu informaţiile ce descriu nivelul lor de experienţă, prin raportare la valorile produselor livrate, corespunzător cerinţelor autorităţii contractante. Următoarele documente justificative care probează îndeplinirea cerinţei vor fi prezentate, la solicitarea autorităţii contractante, doar de către ofertantul clasat pe locul I în clasamentul intermediar întocmit la finalizarea evaluării ofertelor. - procesul-verbal de recepţie şi/sau alte documente din care să reiasă următoarele informaţii: beneficiarul, cantitatea livrată/valoarea corespunzătoare a produselor livrate în perioada de referinţă (ultimii 3 ani); În cazul depunerii unei oferte comune, DUAE va fi completat de către fiecare operator economic în parte. Acordul de asociere, precum şi documentele justificative vor fi prezentate, la solicitarea autorităţii contractante, doar de către ofertantul (în cazul asocierii de către fiecare operator economic care face parte din asociere) clasat pe locul I în clasamentul intermediar întocmit la finalizarea evaluării ofertelor.
