Valoare estimata totala a acordului cadru: intre min.273.060,00 lei -max.7.991.140,00 lei.

Cantitățile minime si maxime aferente loturilor prevăzute in caietul de sarcini sunt orientative si nu se constituie in obligații contractuale.

Aceste cantitati au fost estimate la nivelul consumului mediu din anii anteriori. Contractele subsecvente se vor atribui semestrial, sau ori de cate ori apare o nevoie noua, in functie de necesitatile autoritatii contractante si resursele financiare pe care autoritatea contractanta le are la dispozitie.

Cerinţa nr. 1.

Ofertanţii, terţii susţinători şi subcontractanţii nu trebuie să se regăsească în situaţiile prevăzute la art. 164, 165, 167 din Legea nr. 98/2016.

Modalitatea de îndeplinire:

Se va completa DUAE Partea III Motive de excludere, în conformitate cu art. 193 alin. (1) din Legea nr. 98/2016, respectiv art. 202 alin. (1) din Legea 99/2016.

Documentele justificative care probează îndeplinirea celor asumate prin completarea DUAE urmează a fi prezentate, la solicitarea autorităţii contractante doar ofertantul clasat pe primul loc in clasamentul intermediar întocmit la finalizarea evaluării ofertelor;

Nota:

5. Certificatul privind plata taxelor si impozitelor locale va fi prezentat atat pentru sediul societatii cat si pentru toate punctele de lucru/sediile secundare ale ofertantului.

6. Certificatele de atestare fiscala, certificatele privind plata taxelor si impozitelor locale, cazierele fiscale, cazierele judiciare trebuie sa fie VALABILE LA DATA PREZENTARII.

7. In cazul in care in tara de origine sau tara in care este stabilit ofertantul/tertul sustinator/subcontractantul nu se emit documente de natura celor prevazute mai sus sau respectivele documente nu vizeaza toate situatiile prevazute la art. 164, 165, 167, autoritatea contractanta are obligatia de a accepta o declaratie pe proprie raspundere sau, daca in tara respectiva nu exista prevederi legale referitioare la declaratia pe propria raspundere, o declaratie autentica data in fata unui notar, a unei autoritati administrative sau judiciare sau a unei asociatii profesionale cu competente in acest sens.

Operatorul economic (lider, asociat, tert sustinator) va completa cerinta corespunzatoare in formularul DUAE din documentatia de atribuire. Pentru confirmarea celor declarate in DUAE se va solicita ofertantului clasat pe primul loc dupa aplicarea criteriului de atribuire(inclusiv de catre ofertantul asociat al castigatorului licitatiei sau tertul sustinator, dupa caz ) prezentarea pana la data incheierii raportului procedurii de atribuire a urmatoarelor documente: - Certificat de atestare fiscala pentru persoane juridice privind obligatiile de plata la bugetul consolidat al statului in original sau copie certificata pe proprie raspundere pentru conformitate cu originalul, document din care sa reiasa ca ofertantul nu are datorii restante la momentul in care trebuie sa prezinte acest certificat. In acest caz sun aplicabile prevederile art. 166 (2) din Legea nr. 98/2016 privind achizitiile publice; - Certificat de atestare fiscala pentru persoane juridice privind obligatiile de plata la bugetul local in original sau copie certificata pe proprie raspundere pentru conformitate cu originalul, document din care sa reiasa ca ofertantul nu are datorii restante la momentul in care trebuie sa prezinte acest certificat. Pentru persoanele juridice straine ca modalitate de indeplinire a cerintei este si completarea DUAE conform art.193 din Legea 98/2016, urmand ca documentele edificatoare sa fie prezentate doar la solicitarea autoritatii contractante, si doar ofertantului clasat pe primul loc la finalizarea evaluarii ofertelor.

Cerinţa nr. 1.

Operatorii economici care depun ofertă trebuie să dovedească o formă de înregistrare în condiţiile legii din ţara rezidentă, din care să reiasă că operatorul economic este legal constituit, că nu se află în niciuna din situaţiile de anulare a constituirii, precum şi faptul că are capacitatea profesională de a realiza activităţile ce fac obiectul contractului de achiziţie publică/sectorială. Cerinţa se aplică inclusiv pentru subcontractanţi şi/sau terţi susţinători care completează informaţiile aferente situaţiei lor la nivelul unui DUAE distinct.

Modalitatea de îndeplinire:

Se va completa DUAE Partea IV Criterii de selectie lit. A pct.1) de către operatorii economici participanţi la procedura de atribuire a contractului de achiziţie publică cu informaţiile solicitate de către autoritatea contractantă - informaţii referitoare la îndeplinirea cerinţelor privind capacitatea de exercitare a activităţii profesionale.

Documentul justificativ/suport care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentat, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe primul loc în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor. Ca documente suport se solicita certificat constatator emis de Oficiul Registrului Comerţului de pe lângă Tribunalul teritorial (actualizat cf. art. 22 din Legea 26/1990) sau pentru ofertantii straini, document echivalent emis in tara de rezidenta.

Obiectul contractului trebuie sa aiba corespondent in codul CAEN din Certificatrul Constatator emis de ONRC, iar ofertantul trebuie sa fie autorizat sa desfasoare activitatile aferente contractului, conf art. 15, din Legea 359 /2004.

În procedurile de atribuire a contractelor de achiziţie publică de produse care cuprind şi prestarea de servicii conexe, în cazul în care este necesar ca operatorii economici să deţină o autorizaţie specială, sau să fie membri ai unei anumite organizaţii pentru a putea presta serviciile în cauză în statul de origine, sau să fie înscrişi în registre profesionale, autoritatea contractantă are dreptul de a solicita acestora să demonstreze că deţin o astfel de autorizaţie, că sunt membri ai unei astfel de organizaţii, sunt înscrişi în registre profesionale. Dacă se impune avizarea/atestarea/autorizarea operatorului economic, aceasta trebuie să fie în relaţie directă cu obiectul principal al contractului/relevantă scopului urmărit prin încheierea contractului de achiziţie publică/sectorială.

Ofertantii vor transmite/introduce in SEAP/SICAP documentele solicitate pentru indeplinirea criteriilor de calificare si propunerea tehnica semnate cu semnatura electronica extinsa, bazata pe un certificat calificat, eliberat de un furnizor de servicii de certificare acreditat, conform art. 60 din HG 395/2016. Fiind vorba de o procedura desfasurata integral prin mijloace electronice, ofertele financiare se depun in SEAP, www.e-licitatie.ro pana cel tarziu la data si ora stabilita in anuntul de participare .
