This invitation for expression of interest follows the general procurement notice published in the OJEU 2017/S 180-367819 and on the EBRD’s website on 14.9.2017.
The Joint Stock Company “Ukrainian Railways” (the Contracting Authority) has received a loan from the European Investment Bank — EIB and a loan from the European Bank for Reconstruction and Development — EBRD (both loan agreements are currently undergoing the ratification procedure with the Ukrainian Parliament — Verkhovna Rada) towards the cost of the Ukraine Railway Modernization Project (JSC “Ukrzaliznytsia” infrastructure modernization). The project will be jointly financed by the EIB and the EBRD.
The project concerns the electrification, laying of a new second track, development of tracks layout within stations, along with the modernization of interlocking, signalling and telecommunication system in stations and on open lines, of the Dolynska – Mykolaiv – Kolosivka railway line in Southern Ukraine towards the Ukrainian ports in the Black Sea, over a total length of approximately 253 km.
Phase 1: Dolynska – Mykolaiv section (148 km).
Phase 2: Mykolaiv – Kolosivka section (105 km).
The aim of the project is to improve the capacity of these existing rail lines. The underlying aim is to provide more capacity in the main corridor between central Ukraine and the principal ports thereby to improve the quality of rail services and allow rail to maintain or expand its modal share.
The project is to be implemented applying FIDIC-MDB Harmonised Construction Contract Conditions. The works are expected to be performed over the period of 2019-2022.
This assignment for Construction Supervision and Project Management Services (the services) is to be financed through a grant accorded from the Neighbourhood Investment Platform (NIP), secured by the EIB on behalf of the Contracting Authority. This Platform utilizes non-repayable aid granted by the European Commission in support of investment activities of International Financial Institutions (IFIs) in the EU Neighbouring Countries, assisting promoters during different stages of the project cycle.
The Contracting Authority now invites eligible consulting firms (applicants) to indicate their interest in providing the services. Interested applicants should provide information demonstrating that they have the required qualifications and relevant experience to perform the services.
Applications are accepted only by using an application form available on request from the Contracting Authority.
Procurement of the services will be conducted through the procedures as specified in the EIB’s Guide to Procurement, June 2011. Shortlisted applicants shall subsequently be invited to submit technical and financial proposals that shall be subject to evaluation on the basis of the most economically advantageous tender (quality and cost based selection) as further specified in the request for proposals.
Eligibility is open to all firms.
Consulting firms may associate with other firms in the form of a Joint Venture, Consortium or Association (JVCA) to enhance their qualifications. A type of association shall be clearly stated in the expression of interest. The experience and financial record of any proposed sub-contractor shall not be included in the evaluation.
Pre-qualification Criteria:
The following selection criteria will be applied to candidates. In case of applications submitted by a JVCA, these selection criteria will be applied to the overall JVCA as a whole.
(a) economic and financial standing:
— annual turnover over the last 3 fiscal years for which accounts have been closed (2017, 2016, 2015) has to be at least 6 000 000 EUR or equivalent;
(b) professional capacity:
— experience and past performance on previous contracts:
(i) general experience: the candidate shall show that its general experience in implementation of assignments in areas of specialisation of railway sector is not less than 10 years;
(ii) specific experience: the candidate shall show that it has successfully implemented, completed and received final payment under at least 3 similar assignments over the last five (5) years.
Similar assignment means provision of construction supervision and/or project management services related to railway rehabilitation, modernization and construction works (electrification and/or laying of tracks and/or modernization of interlocking, signalling and telecommunication systems), under FIDIC contract conditions, of value at least 2 000 000 EUR per contract.
Applicants shall demonstrate that they had a participation of a minimum of 50 % in each of the contracts brought as reference;
(iii) among the similar assignments brought as reference in para ii above, at least 1 shall have been performed in the EU’s Eastern Neighbourhood and/or countries of the Commonwealth of Independent States CIS (Armenia, Azerbaijan, Belarus, Kazakhstan, Kyrgyzstan, Moldova, Russia, Tajikistan, Uzbekistan) as well as Georgia and Ukraine;
(iv) experience in working with IFIs shall be demonstrated by at least 1 successfully implemented similar assignment brought as reference in para ii above.
The Contracting Authority intends to shortlist at least 4 and up to 6 applicants to whom a request for proposal shall be sent. In the event that more than 6 applicants fulfil all the qualifying criteria above, the employer shall use the following criterion to rank the applicants, select the top 6 of them and subsequently invite shortlisted applicants to submit proposals: the number of contracts in CIS counties as well as Georgia and Ukraine in a field related to the services brought as reference in b(iii) above.
The Contracting Authority reserves the right to accept or reject any application, to cancel the pre-qualification process and reject all applications at any time prior to the time when information on the outcome of pre-qualification is communicated to the applicants, without thereby incurring any liability to the applicants. In the case of cancellation of the pre-qualification process, all applications submitted will be promptly returned to the applicants.
Provisional date of request for proposal is first quarter of 2019. The services are expected to start in Q2 2019 and last 48 months.
The expression of interest, as well as all subsequent correspondence, shall be written in English. A copy of the EOI, in Russian or Ukrainian Language, is to accompany the English version. The English version shall prevail.
The original and all copies of the application shall be typed or written in indelible ink and shall be signed by a person duly authorised to sign on behalf of the applicant. This authorisation shall consist of a written confirmation and shall be attached to the application. The name and position held by each person signing the authorisation must be typed or printed below the signature.
A prospective applicant requiring any clarification with respect to the application form shall contact the Contracting Authority in writing or by email using contact details indicated below. The Contracting Authority will respond to any request for clarification, provided that such request is received 14 calendar days prior to the closing date specified herein.
Should the Contracting Authority deem it necessary to amend the application form as a result of a request for clarification, it may do so at any time prior to the closing date by issuing addenda. Any addendum issued shall be part of the application form and will be communicated in writing or by email to all applicants, who have obtained the pre-qualification document.
1 original and 3 copies of the above information, in English and either Ukrainian or Russian, should be submitted to the Contracting Authority in an envelope marked “Expression of Interest for Construction Supervision and Project Management Services for the Ukraine Railway Modernization Project (JSC “Ukrzaliznytsia” Infrastructure Modernization)”, to reach the Contracting Authority not later than the above mentioned closing date and time. A flash drive with PDF edition of the EOI in both languages shall be delivered together with the paper edition.
Unfair competition cases shall be dealt by the Antimonopoly Committee of Ukraine in compliance with the procedure prescribed by current legislation of Ukraine.
