Valoarea estimată minimă a AC este de 92 161 00 RON fără TVA.

Valoarea estimată maximă a AC este de 2 764 830,00 RON fără TVA.

Valoarea estimata a celui mai mare contract subsecvent pe fiecare lot in parte este specificata in Anexa B la fisa de date.

Autoritatea contractanta va raspunde, in mod clar si complet, tuturor solicitarilor de clarificare/informatii suplimentare in a 10-a zi inainte de termenul-limita de depunere a ofertelor.

Section III: Legal, economic, financial and technical information

III.1)Conditions for participation

Cerința nr. 1

Ofertanții, terții susținători și subcontractanții nu trebuie să se regăsească în situațiile prevăzute la art.164, 165, 167 din Legea nr. 98/2016.

Modalitatea de îndeplinire:

Se va completa DUAE în conformitate cu art. 193 alin. (1) din Legea nr. 98/2016, respectiv art. 202 alin. (1) din Legea 99/2016.

Documentele justificative care probează îndeplinirea celor asumate prin completarea DUAE urmează a fi prezentate, la solicitarea autorității/entității contractante doar ofertantilor clasati pe primele 3 locuri în clasamentul intermediar întocmit la finalizarea evaluării ofertelor sunt:

— certificatul de inregistrare fiscala

— certificate constatatoare privind lipsa datoriilor restante, cu privire la plata impozitelor, taxelor sau a contribuțiilor la bugetul general consolidat (buget local, buget de stat etc.) la momentul prezentării, pentru sediul social,

— cazierul judiciar al operatorului economic și al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, așa cum rezultă din certificatul constatator emis de ONRC / actul constitutiv,

— după caz, documente prin care se demonstrează faptul că operatorul economic poate beneficia de derogările prevăzute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizițiile publice,

— alte documente edificatoare, după caz.

În cazul în care în țara de origine sau țara în care este stabilit ofertantul/terțul susținător/subcontractantul nu se emit documente de natura celor prevăzute mai sus sau respectivele documente nu vizează toate situațiile prevăzute la art.164, 165 și 167, autoritatea/entitatea contractantă are obligația de a accepta o declarație pe proprie răspundere sau, dacă în țara respectivă nu există prevederi legale referitoare la declarația pe propria răspundere, o declarație autentică dată în fața unui notar, a unei autorități administrative sau judiciare sau a unei asociații profesionale care are competențe în acest sens.

Cerința nr. 2

Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art.59 si 60 din Legea 98/2016.

Cerința nr. 1

Operatorii economici care depun ofertă trebuie să dovedească o formă de înregistrare în condițiile legii din țara rezidentă, din care să reiasă că operatorul economic este legal constituit, că nu se află în niciuna din situațiile de anulare a constituirii, precum și faptul că are capacitatea profesională de a realiza activitățile ce fac obiectul contractului de achiziție publică/sectorială. Cerința se aplică inclusiv pentru subcontractanți și/sau terți susținători care completează informațiile aferente situației lor la nivelul unui DUAE distinct.

Modalitatea de îndeplinire:

Se va completa DUAE de către operatorii economici participanți la procedura de atribuire a contractului de achiziție publică/sectorială cu informațiile solicitate de către autoritatea/entitatea contractantă – informații referitoare la îndeplinirea cerințelor privind capacitatea de exercitare a activității profesionale.

Documentul justificativ care probează îndeplinirea celor asumate prin completarea DUAE, respectiv certificatul constatator emis de ONRC, sau în cazul ofertanților persoane juridice/fizice străine, documentele echivalente emise în țara de rezidență, traduse în limba română, urmează să fie prezentate, la solicitarea Autorității/entității contractante, doar de către ofertantii clasati pe primele 3 locuri în clasamentul intermediar întocmit la finalizarea evaluării ofertelor.

In situația în care vor fi executate părți din contract de către subcontractanți, dovada înregistrării și corespondența activităților principale/secundare din cadrul acestuia cu obiectul achiziției se va prezenta obligatoriu și de către subcontractanți, pentru partea din contract pe care o vor realiza.

În procedurile de atribuire a contractelor de achiziție publică/sectorială de produse care cuprind și prestarea de servicii conexe, în cazul în care este necesar ca operatorii economici să dețină o autorizație specială, sau să fie membri ai unei anumite organizații pentru a putea presta serviciile în cauză în statul de origine, sau să fie înscriși în registre profesionale, autoritatea/entitatea contractantă are dreptul de a solicita acestora să demonstreze că dețin o astfel de autorizație/că sunt membri ai unei astfel de organizații/sunt înscriși în registre profesionale. Dacă se impune avizarea/atestarea/autorizarea operatorului economic, aceasta trebuie să fie în relație directă cu obiectul principal al contractului/relevantă scopului urmărit prin încheierea contractului de achiziție publică/sectorială.

Cerința nr. 2

Operatorii economici ce depun oferta trebuie sa dovedeasca,ca sunt avizati cf.art.3-4 din Anexa la OMS1008/2016 pt. aprobarea Normelor metodologice de aplicarea a titlului XX din Lg.95/2006 cu modificarile si completarile ulterioare privind dispozitivele medicale si art.926 din Lg 95/2006.

Modalitatea de îndeplinire:

Se va completa DUAE de catre op.ec.participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE,respectiv Aviz de functionare emis de Ministerul Sanatatii pt activitati de import,comercializare si distributie pt. dispozitivele medicale- cf.art.3-4 din Anexa la OMS1008/2016 pt. aprobarea Normelor metodologice de aplicarea a titlului XX din Lg95/2006 cu modificarile si completarile ulterioare privind dispozitivele medicale si art.926 din Lg.95/2006,sau in cazul ofertantilor straini,documente echivalente emise in tara de rezidenta,in termen de valabilitate la data prezentarii,la solicitarea aut ctr.,doar de catre op.ec clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor . DUAE se depune(dupa caz) si de catre tertul sustinator.Pentru subcontractantii propusi de catre ofertant in oferta,aut ctr ia in considerare capacitatea tehnica si profesionala pt partea lor de implicare in ctr care urmeaza a fi indeplinit,daca documentele prezentate sunt relevante in acest sens.

In cazul in care doua sau mai multe oferte au aceeasi valoare totala a propunerii financiare si sunt clasate pe acelasi loc, in vederea departajarii se vor solicita noi propuneri financiare, fara ca acest lucru sa afecteze pozitiile superioare din clasament. Fiind acord cadru cu maxim 3 operatori departajarea se face pe fiecare loc in parte. In cazul in care sunt doua sau mai multe oferte pe locul 1 se va solicita o noua propunere financiara, iar locul 1 va fi atribuit ofertantului a carui noua propunere financiara are valoarea cea mai scazuta. In cazul in care sunt doua sau mai multe oferte pe locul 2 se va solicita o noua propunere financiara, iar locul 2 va fi atribuit ofertantului a carui noua propunere financiara are valoarea cea mai scazuta. In cazul in care sunt doua sau mai multe oferte pe locul 3 se va solicita o noua propunere financiara, iar locul 3 va fi atribuit ofertantului a carui noua propunere financiara are valoarea cea mai scazuta. Reofertarea se face cu doua zecimale.Se vor solicita reofertari pana la departajare. Toate documentele care nu sunt in limba romana se depun traduse in limba romana. Specificatiile tehnice care indica o anumita origine, sursa, productie, un procedeu special, o marca de fabrica sau de comert, un brevet de inventie, o licenta de fabricatie, sunt mentionate doar pentru identificarea cu usurinta a tipului de produs si nu au ca efect favorizarea sau eliminarea anumitor op. economici sau a anumitor produse, aceste specificatii vor fi considerate ca avand si mentiunea de ‘’SAU ECHIVALENT’’(art.56 din Legea 98/2016). Produsele se vor livra, conform comenzilor, catre magazia unitatii la urmatoarea adresa bd. 16 Dec. 1989, nr. 22-24, Timisoara, pana in incinta unde se efectueaza receptia acestora. Livrarea produselor se va face cu termenul de valabilitate de cel putin 1 an. La produsele cu termenul scurt, daca acestea ajung in farmacia unitatii noastre cu termen mai scurt de 1 an peratorul economic se obliga sa anunte farmacia pentru acceptul receptiei si sa schimbe lotul inaintea datei de expirare. In situatia in care, pe perioada de valabilitate a prezentului contract,Ministerul Sanatatii- in calitate de unitate de achizitii publice centralizate conform OUG 71/2012, incheie pentru noi si in numele unitatii noastre acord cadru pentru produsele/serviciile ce fac obiectul prezentului contract, acesta din urma devine nul de drept.
