c) odpis z właściwego rejestru lub z centralnej ewidencji i informacji o działalności gospodarczej, jeżeli odrębne przepisy wymagają wpisu do rejestru lub ewidencji, w celu potwierdzenia braku podstaw wykluczenia na podstawie art. 24 ust. 5 pkt 1 ustawy;

d) oświadczenie Wykonawcy o braku wydania wobec niego prawomocnego wyroku sądu lub ostateczne j decyzji administracyjnej o zaleganiu z uiszczaniem podatków, opłat lub składek na ubezpieczenia społeczne lub zdrowotne albo w przypadku wydania takiego wyroku lub decyzji dokumentów potwierdzających dokonanie płatności tych należności wraz z ewentualnymi odsetkami lub grzywnami lub zawarcie wiążącego porozumienia w sprawie spłat tych należności;

e) oświadczenie Wykonawcy o braku orzeczenia wobec niego tytułem środka zapobiegawczego zakazu ubiegania się o zamówienia publiczne.

5. W celu potwierdzenia, że oferowane dostawy odpowiadają wymaganiom określonym przez Zamawiającego:

a) dokument potwierdzający opis przedmiotu zamówienia pochodzący od producenta / wytwórcy / autoryzowanego przedstawiciela lub informacja wygenerowana elektronicznie z oficjalnego portalu/strony producenta;

b) oświadczenie potwierdzające, że oferowane w przetargu wyroby dopuszczone są do obrotu na terenie RP i spełniają wymogi: ustawy Prawo farmaceutyczne, ustawy o wyrobach medycznych.

II. Podstawy wykluczenia Wykonawcy: zgodnie z art. 24 ust. 1 oraz ust. 5 ustawy Pzp.

III. Zamawiający przewiduje zastosowanie możliwości określonej w art. 24aa ustawy Pzp.

IV. Zamawiający nie wymaga wniesienia wadium.

V. Klauzula informacyjna wynikająca z art. 13 RODO dotycząca przetwarzania danych osobowych jest dostępna w pkt XXII SIWZ.
