Ein Bewerber/Bieter kann seine Nichtberücksichtigung im Nachprüfungsverfahren bei der Vergabekammer überprüfen lassen. Voraussetzung für ein Nachprüfungsverfahren ist, dass der Verstoß gegenüber der Vergabestelle gerügt wird. Der Antrag ist unzulässig, soweit der Antragsteller den gerügten Verstoß gegen Vergabevorschriften im Vergabeverfahren erkannt und gegenüber dem Auftraggeber nicht innerhalb einer Frist von 10 Kalendertagen gerügt hat (§ 160 Abs. 3 Nr. 1 GWB),

Mehr als 15 Kalendertage nach Eingang der Mitteilung des Auftraggebers, einer Rüge nicht abhelfen zu wollen, vergangen sind (§ 160 Abs. 3 Nr. 4 GWB).
Nach Ablauf dieser Frist ist gegen diese Entscheidung kein Rechtsmittel mehr möglich. Der Antrag auf Nachprüfung ist an die Vergabekammer des Bundes beim Bundeskartellamt, Villemombler Straße 76, 53123 Bonn, zu richten.
