III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

(απόδειξη καταλληλότητας για την άσκηση επαγγελματικής δραστηριότητας παρ.2 άρθρ. 75 ν.4412/2016) προσκομίζουν:

πιστοποιητικό/βεβαίωση του οικείου επαγγελματικού ή εμπορικού μητρώου του κράτους εγκατάστασης. Οι οικονομικοί φορείς που είναι εγκατεστημένοι σε κράτος μέλος της Ευρωπαϊκής Ένωσης προσκομίζουν πιστοποιητικό/βεβαίωση του αντίστοιχου επαγγελματικού ή εμπορικού μητρώου του Παραρτήματος XI του Προσαρτήματος Α΄ του ν. 4412/2016, με το οποίο πιστοποιείται αφενός η εγγραφή τους σε αυτό και αφετέρου το ειδικό επάγγελμά τους. Στην περίπτωση που χώρα δεν τηρεί τέτοιο μητρώο, το έγγραφο ή το πιστοποιητικό μπορεί να αντικαθίσταται από ένορκη βεβαίωση ή, στα κράτη - μέλη ή στις χώρες όπου δεν προβλέπεται ένορκη βεβαίωση, από υπεύθυνη δήλωση του ενδιαφερομένου ενώπιον αρμόδιας δικαστικής ή διοικητικής αρχής, συμβολαιογράφου ή αρμόδιου επαγγελματικού ή εμπορικού οργανισμού της χώρας καταγωγής ή της χώρας όπου είναι εγκατεστημένος ο οικονομικός φορέας ότι δεν τηρείται τέτοιο μητρώο και ότι ασκεί τη δραστηριότητα που απαιτείται για την εκτέλεση του αντικειμένου της υπό ανάθεση σύμβασης.

Οι εγκατεστημένοι στην Ελλάδα οικονομικοί φορείς προσκομίζουν βεβαίωση εγγραφής στο Βιοτεχνικό ή Εμπορικό ή Βιομηχανικό Επιμελητήριο ή στο Μητρώο Κατασκευαστών Αμυντικού Υλικού ή πιστοποιητικό που εκδίδεται από την οικεία υπηρεσία του Γ.Ε.Μ.Η. των ως άνω Επιμελητηρίων

Επισημαίνεται ότι, τα δικαιολογητικά που αφορούν στην απόδειξη της απαίτησης του άρθρου 2.2.4 (απόδειξη καταλληλότητας για την άσκηση επαγγελματικής δραστηριότητας) γίνονται αποδεκτά, εφόσον έχουν εκδοθεί έως τριάντα (30) εργάσιμες ημέρες πριν από την υποβολή τους, εκτός αν, σύμφωνα με τις ειδικότερες διατάξεις αυτών, φέρουν συγκεκριμένο χρόνο ισχύος (Πρβλ. παράγραφο 12 άρθρου 80 του ν.4412/2016, όπως αυτή προστέθηκε με το άρθρο 43 παρ. 7 α σημείο αδ’ του ν. 4605/2019).

Precise information on deadline(s) for review procedures:

Κάθε ενδιαφερόμενος, ο οποίος έχει ή είχε συμφέρον να του ανατεθεί η συγκεκριμένη δημόσια σύμβαση και έχει υποστεί ή ενδέχεται να υποστεί ζημία από εκτελεστή πράξη ή παράλειψη της αναθέτουσας αρχής κατά παράβαση της ευρωπαϊκής ενωσιακής ή εσωτερικής νομοθεσίας στον τομέα των δημοσίων συμβάσεων, έχει δικαίωμα να προσφύγει στην ανεξάρτητη Αρχή Εξέτασης Προδικαστικών Προσφυγών (ΑΕΠΠ), σύμφωνα με τα ειδικότερα οριζόμενα στα άρθρα 345 επ. ν. 4412/2016 και 1 επ. π.δ. 39/2017, στρεφόμενος με προδικαστική προσφυγή, κατά πράξης ή παράλειψης της αναθέτουσας αρχής, προσδιορίζοντας ειδικώς τις νομικές και πραγματικές αιτιάσεις που δικαιολογούν το αίτημά του.

Σε περίπτωση προσφυγής κατά πράξης της αναθέτουσας αρχής, η προθεσμία για την άσκηση της προδικαστικής προσφυγής είναι:

(α) δέκα (10) ημέρες από την κοινοποίηση της προσβαλλόμενης πράξης στον ενδιαφερόμενο οικονομικό φορέα αν η πράξη κοινοποιήθηκε με ηλεκτρονικά μέσα ή τηλεομοιοτυπία ή

(β) δεκαπέντε (15) ημέρες από την κοινοποίηση της προσβαλλόμενης πράξης σε αυτόν αν χρησιμοποιήθηκαν άλλα μέσα επικοινωνίας, άλλως

(γ) δέκα (10) ημέρες από την πλήρη, πραγματική ή τεκμαιρόμενη, γνώση της πράξης που βλάπτει τα συμφέροντα του ενδιαφερόμενου οικονομικού φορέα. Ειδικά για την άσκηση προσφυγής κατά προκήρυξης, η πλήρης γνώση αυτής τεκμαίρεται μετά την πάροδο δεκαπέντε (15) ημερών από τη δημοσίευση στο ΚΗΜΔΗΣ.

Σε περίπτωση παράλειψης που αποδίδεται στην αναθέτουσα αρχή, η προθεσμία για την άσκηση της προδικαστικής προσφυγής είναι δεκαπέντε (15) ημέρες από την επομένη της συντέλεσης της προσβαλλόμενης παράλειψης.

Οι προθεσμίες ως προς την υποβολή των προδικαστικών προσφυγών και των παρεμβάσεων αρχίζουν την επομένη της ημέρας της προαναφερθείσας κατά περίπτωση κοινοποίησης ή γνώσης και λήγουν όταν περάσει ολόκληρη η τελευταία ημέρα και ώρα 23:59:59 και, αν αυτή είναι εξαιρετέα ή Σάββατο, όταν περάσει ολόκληρη η επομένη εργάσιμη ημέρα και ώρα 23:59:59.
