The modification of the framework contract Ref. No LISA/2016/RP/02, increasing the maximum amount of the framework contract, in accordance with Article 172 3. (a) of the EU Financial Regulation, applicable by virtue of the Financial Rules of the European Union Agency for the Operational Management of Large-Scale IT Systems in the Area of Freedom, Security and Justice (eu-LISA), adopted by the Management Board Decision No 198/2019 rev 1 of 28 August 2019, where a framework contract may be modified without a new procurement procedure for additional services, provided a change of contractor cannot be made for technical reasons linked to interchangeability or interoperability requirements with existing equipment, services or installations; a change of contractor would cause substantial duplication of costs for the contracting authority; any increase in price, including the net cumulative value of successive modifications, does not exceed 50 % of the initial contract value.
Due to the use of certain technology, change of the contractor would not be feasible at this stage for additional services, as there is a too high risk to design and build new EURODAC from scratch including all testing and proper data migration. Moreover, changing the current technology would require to undergo full accuracy tests which requires efforts and data which eu-LISA does not possess; Changing the current technology from the current provider in the middle of the FWC, apart from building new Eurodac, will result in substantial duplication of costs for the Contracting authority.
