II.2.4)Description of the procurement:

In building A, for the operation of laser systems and for the delivery of laser radiation to the target and experimental area, a pre-vacuum is required, provided by the precursor centres suspended on the bridge structure of the hall, so that the vibrations generated by vacuum pumps can be kept away from the laser hall and the target areas by means of flexible vibration attenuators inserted into the pipeline. The precursor shall have a pressure of 0.1 mbar, the need for a vacuum for each target area according to the markings of the submitted sketch.

The pre-vacuum required for operation shall be provided by an independent, separate machine unit consisting of a number of pump blocks sized according to the specified suction requirements. The design therefore had to take into account the possibility of later developments if their vacuum demand increases.

The machine units are placed on 11 podes, connected to bridges in the chamber’s airspace, thus reducing mechanical vibrations to the vibration attenuated areas. We plan to solve the vibration attenuation in three places:

— with compensators located immediately after the pumps,

— and to connect vacuum pipes attached to bunkers and clean-room panels of LTA or laser areas to the podests (bridge) piping,

— with obscuration devices deposited between the machine base constructed for the positioning of the machinery units in the podests and the podeste.

All pumps of the machinery units are connected to the building automation system, so that key parameters, signals and alarms of normal operation are directly visible (removable) in the control rooms, and it is possible to start/stop remotely and switch to efficient operation. All parameters required for servicing can be seen directly to the pump in the connected building surveillance system. The regulation shall also be carried out here.

Via pre-assessed pipelines from pumping stations, the precursor service is provided to clean-room laboratories through pipelines of the design type and diameter, where a pressure transducer (at take-off points) ensures the adequacy of the service provided, and automatic sliding locks ensure adequate segmentability during operation. The piping is 1 4404 stainless steel.

Piping for process gases up to 1/2' is a tube with longitudinal welds if it is seamless or larger, and it is certified as suitable for gases with a purity of 99,999 %, degreasing and de-oiled by appropriate purification procedures. The inner surface roughness of the tube is approximately 1.0 um. Seamless acid resistant tubes according to ASTM A 269, cleaned to the absence of oil or fat. A certificate of art is required for the pipeline according to EN 10204/3.1. (The certificate of art shall be obtained by the successful tenderer during performance.) The pipe class “3” according to the specification of the pipe class shall be used for construction. Pipes shall be welded by an AWI orbital procedure, with welds having a thickness at least equivalent to the wall thickness.

Motorising the bridge crane A and increasing load capacity.

Public procurement includes the construction of pipelines for the vacuum system, the supply and installation of vacuum pumps, vacuum pressure meters, vacuum push prices and other vacuum technology tools, and the construction of pipelines and fittings for supply systems for nitrogen and compressed air.

The contractor shall, on the basis of the construction contract, conduct trial operations for the facility before the technical handover and acceptance of the construction and installation works. The duration of the test run shall be 30 days.

II.2.14)Additional information

The time limit for performance shall be 395 calendar days from the starting point of the obligation to perform. The time limit for performance specified in point II.2.7) is therefore expressed in calendar days.

The contracting authority shall cover the public procurement in part under the grant contract NKFIH-902-1/2017 concluded with the National Research, Development and Innovation Office on 11.4.2017, and partly with the Ministry of National Economy 2015.9. Section III: Legal, economic, financial and technical information

III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

An economic operator against whom the Kbt may be a tenderer shall not be a tenderer, a subcontractor, or an economic operator against whom the Kbt may participate in the certification of suitability. Any of the grounds for exclusion set out in section 62 (1)-(2) shall apply.

The Kbt. Pursuant to section 74 (1), the contracting authority shall exclude from the procedure any tenderer, subcontractor or organisation participating in the certification of suitability that falls within the scope of the exclusion grounds; or the ground for exclusion on its part occurred in the course of the procedure.

The contracting authority shall draw attention to the Kbt. The possibility of self-cleaning under section 64 (1) and (2).

Means of verification:

The non-existence of the grounds for exclusion by the AT is laid down in Government Decree No 321/2015 of 30 October (hereinafter: Section 1 (1)-(5) and (7), Section 2 (1) and (4), Section 3, Section 4(1), (3) and (4), Sections 6 to 8 and 10, as well as Sections 12 to 16,

— pursuant to Section 1(1) of the Government Decree, all ATs are required to prove in advance in their tenders, in accordance with Chapter II of the Government Decree, that they do not fall within the scope of the grounds for exclusion laid down, by submitting the European Single Procurement Document (EEKD),

And then the Kbt. In the course of the examination under section 69 (4), at the request of the contracting authority, the AT shall submit statements or certificates in accordance with sections 8 and 10 of the Government Decree on the non-existence of the grounds for exclusion. Please note that, in the case of section 8(ib) of the Government Decree, the beneficial owner as defined in Section 3(38)(a)-(b) or (d) of Act LIII of 2017 shall be declared; or if AT has no beneficial owner within the meaning of Section 3(38)(a)-(b) or (d) of the Money Laundering Act, a statement to that effect shall be attached. The contracting authority shall draw attention to the Kbt. Section 69 (5)-(7) and (9)-(11a), (13)-(14).

In the event of a joint tender, a separate EEKD shall be submitted in the tender for joint tenderers. The electronic form on behalf of the joint tenderers shall be attached by the economic operator submitting the tender.

If the tenderer intends to meet the required suitability criteria by relying on the capacities of another organisation or person, a separate EEKD shall be submitted for each of the organisations or persons concerned.

Completing the EEKD in accordance with Sections 3 to 7 of the Government Decree, in the Electronic Public Procurement System (hereinafter: ERR) shall be attached to the tender.

The Kbt. Pursuant to section 67 (4), all tenderers shall declare that they do not use the Kbt for the performance of the contract. A subcontractor subject to the grounds for exclusion under section 62 (1) and (2).

At shall also declare whether there is an ongoing change registration procedure. In the case of a pending change registration procedure, the AT shall attach the application for registration of changes submitted to the court of registration and the certificate of its arrival sent by the court of registration [Section 13 of Decree No/]. The on-going change registration procedure shall also be declared with negative content.

Ability to pursue a professional activity:

S/1. The AT is unsuitable if

(i) the economic operator specified in the tender, carrying out construction activities and established in Hungary, shall not be included in the Étv. In the register referred to in section 39 (3), or

(ii) the economic operator specified in the tender, carrying out construction activities and not established in Hungary, is not registered in the register of the country where he is established, or if he does not have the licence, licence or membership of an organisation or chamber required in the country where he is established.

Means of verification:

S/1. Pursuant to Sections 1(1) and 5(1) of the Government Decree, the AT shall attach the EEKD in the tender, and it is sufficient to complete the section “α” of Part IV in this respect, given that, under Section 2(5) of the Government Decree, the contracting authority also accepts a simple declaration of the economic operator concerned for the prior verification of the eligibility requirement SZ/1.

The Kbt. In the case of an economic operator established in Hungary pursuant to section 69 (4)-(7), the fact of being registered in the register shall be verified by the contracting authority; in the case of an economic operator not established in Hungary, proof of registration in the register of the country of establishment or proof of possession of the licence, licence or organisation or chamber membership required in the country of establishment shall be submitted.

III.1.2)Economic and financial standing
List and brief description of selection criteria:

P.1-P.3 PURSUANT TO DECREE NO 321/2015 OF APRIL Government Decree/(X. 30.) (hereinafter: Pursuant to Sections 1(1) and 5(1) of the Government Decree), tenderers shall attach the ESPD in the tender, and it is sufficient to complete the section “α” of Part IV of this section, given that, pursuant to Section 2(5) of the Government Decree, the contracting authority also accepts a simple declaration of the economic operator concerned for the prior verification of the economic and financial suitability requirement P/1-P/3.

Pursuant to Section 1(2) of the Government Decree, by the contracting authority, the Kbt. Pursuant to section 69 (4)-(7), tenderers invited to submit certificates on suitability requirements shall certify, in accordance with Chapter IV of the Government Decree, that they meet the required suitability requirements, as follows:

P.1 Pursuant to Section 19(1)(b) of the Government Decree, the tenderer shall attach, for the last three closed financial years preceding the date of dispatch of the invitation to tender, the part of the accounts of its own or its legal predecessors according to accounting laws on the basis of which the result after tax may be established (if publication is required by the law of the country where the economic operator is established).

If the reports requested by the contracting authority can be consulted on the website of the company information service, the contracting authority shall verify the data of the reports, in which case the reports on the website of the company information service need not be attached.

If the tenderer operates in a legal form that does not allow for the submission of the accounts, the tenderer shall provide a statement of the post-tax profit, excluding value added tax, achieved in the financial year ending with the last three balance sheet dates preceding the date of dispatch of the invitation to tender.

If the tenderer does not have the document referred to in point P.1 because he started operating after the prescribed period, he shall be entitled to prove his suitability by means of a statement of its turnover from the subject-matter of the public contract (construction and installation works) obtained during the period of operation, excluding value added tax.

P.2-3. Pursuant to Section 19(1)(c) of the Government Decree, tenderers shall provide a statement of their total turnover, excluding value added tax, in the financial year ending with the last three balance sheet dates preceding the date of dispatch of the invitation to tender, and a statement on the total turnover, excluding value added tax, of the subject-matter of the public procurement (construction and installation works) broken down by year, depending on when the tenderer was established or commenced its activities, if these data are available.

The contracting authority also draws attention to Section 19(3) of the Government Decree. The Kbt shall also apply to the certification of economic and financial capacity. Section 65 (6)-(8) and (11)-(12) of the Kbt. Section 69 (11a), the Kbt. Section 140 (9) and Sections 3 (2) and 6 of the Government Decree.

If the tenderer meets the required suitability criteria by relying on the capacities of another organisation, this organisation shall, with regard to the suitability criteria it certifies, certify compliance with the relevant eligibility criterion in the same way as the means of verification required for the tenderer [Kbt. Section 67 (3)].

Minimum level(s) of standards possibly required:

P/1. Tenderers shall be unfit if their own results or those of its predecessor were negative in more than one of the last three financial years ending on the date of dispatch of the invitation to tender.

If the tenderer does not have the document referred to in point P/1 because it started operating after the prescribed period, the contracting authority shall classify the tenderer as unsuitable if its turnover, excluding value added tax, is less than HUF 300 000 000, calculated on the basis of the subject-matter of the public procurement (construction and installation works), excluding value added tax.

P/2. Tenderers shall be unfit if their total turnover, excluding value added tax, for the three financial years ending on the last balance sheet dates preceding the date of dispatch of the invitation to tender is below HUF 600 000 000.

P/3. Tenderers shall be unfit if their turnover from the subject-matter of the public procurement (construction and installation works), excluding value added tax, is below HUF 300 000 000 in the financial year ending on the last three balance sheet dates preceding the date of dispatch of the invitation to tender.

With regard to the eligibility criteria P/1, the Kbt. Section 65 (6) – in the event of a joint tender, it shall be sufficient for one of the joint tenderers to comply. With regard to the eligibility criteria P/2 and P/3, the Kbt. Section 65 (6) – in the event of a joint tender, joint tenderers may also comply jointly.

III.1.3)Technical and professional ability
List and brief description of selection criteria:

M.1-M.2 PURSUANT TO DECREE NO 321/2015 OF APRIL Government Decree/(X. 30.) (hereinafter: Pursuant to sections 1 (1) and 5 (1) of the Government Decree), tenderers shall attach the ESPD in the tender, and it is sufficient to complete section “α” of Part IV of this section, given that, pursuant to Section 2(5) of the Government Decree, the contracting authority also accepts a simple declaration of the economic operator concerned for the prior verification of the technical and professional suitability requirements M.1 to M.2. Please note that the Kbt. Section 62 (1) (i), and the Kbt. Section 73 (1) c).

Pursuant to Section 1(2) of the Government Decree, by the contracting authority, the Kbt. Pursuant to section 69 (4) to (7), tenderers invited to submit certificates on suitability requirements shall certify, in accordance with Chapter IV of the Government Decree, that they meet the required suitability requirements, as follows:

M.1 Pursuant to Section 21(2)(a) of the Government Decree, the tenderer shall describe the works performed in accordance with the requirements and the contract during the five years preceding the date of dispatch of the invitation to tender in accordance with Section 22(3) of the Government Decree.

The certificate provided by the other party to the contract shall contain at least:

— the name (name and address) of the other party to the contract,

— the name and contact details of the contact person of the other party to the contract,

— a brief description of the subject-matter of the contract with a level of detail from which compliance with the eligibility criterion can be clearly established,

— the quantitative and qualitative data indicated in the minimum suitability criteria,

— the place of performance,

— the time of performance (the date of commencement and completion of performance, specifying year, month and day),

— a statement as to whether the performance was performed in accordance with the requirements and the contract.

The contracting authority shall also draw attention to Sections 21(2a)(a), 21/A and 22(5) of the Government Decree.

M.2 On the basis of Section 21(2)(b) of the Government Decree, tenderers shall prove compliance with the minimum technical and suitability requirements under point M.2 by naming the professionals (organisations) who they intend to involve in the performance, by describing their qualifications or qualifications and their professional experience.

With regard to the professional(s) to be involved in the performance of the contract, the tenderer shall attach to its tender the following:

— copies of diplomas,

— a declaration of availability signed by the professional,

— a curriculum vitae showing professional experience signed by a professional in such detail that compliance with the eligibility criteria can be clearly established.

The contracting authority shall verify the duration of the required professional experience on the basis of the curriculum vitae, in which the duration of the professional experience shall be carried out with the accuracy of the year/month. The contracting authority shall draw the tenderers’ attention to the fact that duplicative periods of exercise shall be counted only once in the professional’s period of practice.

With regard to the professional referred to in point M/2(a), if the professional is registered in the above-mentioned register, the tenderer shall also provide data (e.g. registration mark or entitlement and chamber registration number) that would enable the contracting authority to fulfil its control obligation. If the professional to be presented does not have an entitlement according to the minimum suitability requirement at the time of the offer, the tenderer shall declare that, if successful, the professional involved in the performance will have access to the register until the conclusion of the contract. The failure to register shall qualify as the withdrawal of the tenderer from the conclusion of the contract. On the basis of section 131 (4).

The Kbt shall also apply to the certification of technical and professional capacity. Section 65 (6)-(7), (9) and (11)-(12) of the Kbt. Section 69 (11a) and the Kbt. Section 140 (9). In addition, the ERR. Section 12 (2). The contracting authority shall also draw attention to Section 24(2) of the Government Decree.

If the tenderer meets the required suitability criteria by relying on the capacities of another organisation, this organisation shall, with regard to the suitability criteria it certifies, certify compliance with the relevant eligibility criterion in the same way as the means of verification required for the tenderer [Kbt. Section 67 (3)].

Minimum level(s) of standards possibly required:

M.1.1) The tenderer shall not be applicable if, for five years from the date of dispatch of the invitation to tender, he failed to perform, in accordance with the provisions and the contract, reference work(s) for the construction of high purity electropolated electropolised orbital welded process gas pipelines with a total length of 700 fm.

M.1.2) The tenderer shall not be able to perform the reference(s) relating to the manufacture and/or installation and/or sale of a vacuum rust-free and oil-free steel tube with a minimum diameter of DN100 of a total length of 110 fm, in accordance with the specifications and the contract, for five years from the date of dispatch of the invitation to tender.

Several eligibility criteria may be verified by means of a single reference. One eligibility criterion may be fulfilled from more than one reference.

M.2 The tenderer shall be unsuitable if he does not include in the performance of the contract:

a) at least 1 professionals, who have access to Regulation 266/2013 According to Government Decree/(VII.11.) in the field of energy installations and/or technical building engineering (MV-EN or MV-ég, or equivalent), the education and experience required for the registration of responsible technical managers, with practical time;

b) at least 1 professionals qualified as welding machine operator according to MSZ EN ISO 14732, with experience of at least 24 months, who also hold a certificate of fire protection specialist examination, in a field of welding, open flame and hazardous warming;

C) at least 1 professionals with a non-destructive visual examination qualification according to MSZ EN ISO 9712 and a VT2 qualification with at least 24 months’ experience.

Several eligibility criteria may be verified by one professional. The contracting authority shall require the professional referred to in point M/2(a) to have at the time of the entry into force of the contract, at the time of entry into force of the contract, the provisions of Regulation 266/2013. In accordance with Government Decree No/of 11 July, as detailed in the public procurement document. Failure to do so shall constitute the withdrawal of the tenderer from the conclusion of the contract. Section 131 (4) and the contracting authority may conclude contracts with the second most advantageous tenderer.

The contracting authority shall also accept equivalent qualifications for all professionals referred to in point M.2. Proof of equivalence shall be provided by the tenderer.

With regard to the required technical and professional competence requirements, the Kbt. Section 65 (6) – in the event of a joint tender, joint tenderers may also comply jointly.

III.2)Conditions related to the contract
III.2.2)Contract performance conditions:

Currency of offer, contract, payments: HUF.

The contracting authority shall pay the purchase price pursuant to Decree No 322/2015 of April on the purchase price In accordance with Title 19 of Government Decree/(X.30.), in particular section 32/A.

Kbt. Section 135 (1) to (3) and (6), and the Ptk. Section 6:130(1)-(2).

Kbt. On the basis of section 135 (8), it shall allow the successful tenderer to request an advance of up to 10 % of the contractor’s fee, excluding the reserve and VAT, but not exceeding HUF 300 million.

Provisions confirming the contract:

Penalty for late payment (employee’s fee without VAT and reserves 0.1 % per day), max. 10 %

Defective performance penalty for breach of the committed service break (contract fee without VAT and reserve reserve 0.2 % per working day),

Defective performance penalty for breach of the undertaking according to the evaluation criteria (2 % of the contractor’s fee without VAT and reserve),

Default penalty (20 % of the entrepreneur’s fee without VAT or reserve),

Performance guarantee (5 % of the contractor’s fee without VAT and reserves),

Warranty (36 months),

Warranty guarantee (5 % of the entrepreneur’s fee without VAT or reserve),

Guarantee for repayment of advances (5 % of the contractor’s fee, up to a maximum of HUF 75 million).

The contracting authority shall provide a reserve of 5 % of the total consideration under the contract (total contractor fee).

The contracting authority allows 7 partial invoices to be issued (invoice 1: 25 %, account 2: 10 %, account 3: 10 %, account 4: 10 %, account 5: 10 %, account 6: 20 %, account 7: 15 %)

The settlement of the advance received shall be deducted from the consideration for the partial performance in proportion to the value of the partial performance in proportion to the total contractor’s fee.

During the performance of the contract, the successful tenderer shall be in possession of a construction liability insurance with a compensation limit of at least HUF 890 million/damage and HUF 1400 million per year, including damage to property and personal injuries caused to third parties. At the time of the conclusion of the contract, the successful tenderer shall provide the contracting authority with the document certifying that liability insurance has been taken out in all respects in accordance with the construction contract.

Financing method: ex-post financing.

The detailed terms and conditions shall be set out in the draft contract.

In accordance with section 40 (1), it shall be conducted in a single electronic public procurement system operated by the Prime Minister’s Office. Tenders shall be submitted in the ERF, taking into account Kbt. Section 40 (1), second sentence. 2 In order to use the ERF (to prepare and submit a tender), registration by an authorised person is required [ECR. Section 6(1)].

3 They shall draw the tenderers’ attention to the fact that they shall take into account the Public Procurement Act during the preparation of the tender. Section 41/A.

4 The tenderer’s compliance with the suitability criteria and the absence of grounds for exclusion are certified by the Kbt. Section 69 (11a) may also be carried out.

5 The conformity of the right of representation of the person submitting a declaration made in the ERF by electronic means and of the right of representation for joint tenderers shall be determined by the Kbt. Section 35(2a) of the Kbt. Section 41/A (4-5) and the Kbt. On the basis of section 65 (12).

6 The KA does not require or allow the successful tenderer(s) to establish a (joint) company (project company) in order to perform the contract, and AK does not allow variants (alternative) tenders to be submitted.

7 The eligibility criteria and proof of this are more stringent than the list of qualified tenderers: SZ/1, P/1.-P/3 and III.1.3) points M/1 to M/2.

8 The contracting authority shall not make the tender conditional upon the provision of a tender guarantee.

9 Kbt. Section 81 (5) shall apply.

10 The priced budget shall be attached to the tender.

11 The tenderer Kbt shall be attached in the tender. Article 66 (2) and (6).

12 The tender shall be attached to the Public Procurement Act. Section 68(4), duly completed, by filling in the form provided in the ERF.

13 If any attached document is drawn up in a language other than Hungarian, the tenderer’s translation into Hungarian shall also be attached [Kbt. Section 47 (2)].

14 The tender shall be attached to the Public Procurement Act. Article 134 (5).

19 In the evaluation of the content elements of tenders according to the evaluation criteria, points may be awarded for each of the lots: 0 – Paragraph 10.

20 The method of evaluation shall be reversed pro rata to the award criterion “price” and apportionment with regard to qualitative evaluation criteria. With regard to the assessment criterion relating to the additional guarantee period, the evaluation method shall be the straight-ahead apportionment. Detailed provisions are set out in the procurement document.

21 The contracting authority shall not determine the most favourable amount of the tender element with regard to the qualitative evaluation criteria.

22 The contracting authority shall not provide for the possibility of tendering for lots, given that it would be unreasonable from an economic, technical and qualitative point of view. The construction and construction work to be ordered relates to an establishment (a building complex in a technical unit) and the division of the works into lots is not justified by technical or financial considerations. In addition, the work of more than one contractor in a work site at the same time would be a matter of concern from the point of view of occupational safety and accident protection, as well as the same technical and functionally related work carried out at the same time, with a view to enforcing the guarantee requirements, to conclude more than one contract. The purpose of this further construction is to improve the technical service standard of the building where the research technology is located. However, due to the lack of space for the equipment producing these services and the specific non-vibration conditions, they could not be physically concentrated in this single building, either according to the current concept or the concept of further construction. The shared construction of systems designed to provide a delocalised but technically single related service would be technically impractical and would require unnecessary additional work to be carried out for the proper design of the interfaces and the assessment of their suitability.
