Section IV: Procedure
The Fast Air Support Team (FAST), part of the UK Ministry of Defence, intends to award a contract to Cranfield Aerospace Solutions Ltd (CAeS) to provide support to trials and assessments of the vibration and temperature environment of the Typhoon Smart Dispenser System using Air Countermeasure Data Loggers (ACDL).
It is considered that for technical reasons this requirement can be placed using the Negotiated Procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of the Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011). This is because only CAeS has the requisite knowledge of the ACDL's having designed, manufactured, certified and maintained them. This ACDL is the only type that is cleared to operate with Typhoon aircraft. In addition, CAeS are the only economic operator able to certify the SDS for safety and airworthiness and therefore fulfil this requirement.
