A Framework Agreement Shall be Entered Into for the Delivery of Consumables for Clinitek Analysers
A framework agreement for the delivery of instrument specific consumables and tests for the Clinitek analysis instrument, delivered by Siemens Healthcare AS. The framework agreement must replace the expired agreement. The contract period is 4 years.
The framework agreement includes the delivery of consumables for Clinitek analysis instruments delivered by Siemens Healthcare AS. The products included in the contract are specific for the equipment and must be procured from Siemens. The contracting authority wants to enter into a new contract for a period of 4 years.
Afdeling IV: Procedure
According to the PPE §13-4, letter b, a procurement can be made without a tender competition if the procurement involves services that only one specific supplier can provide since a competition is impossible due to technical reasons, or to the supplier having a monopoly. The contracting authority considers the products to be dependent on instruments and can, as far as we know, only be delivered by Siemens Healthcare AS. The replacement of 70–80 analysers is an alternative. However, this will result in considerable costs and it will involve time and resource consuming training for many employees at the Hospital. This is therefore considered as a highly unreasonable alternative. The contracting authority therefore considers entering into a new contract without a prior tender competition to be correct. Cf.
