(Lot I covers all services related to the running of the interinstitutional Europe by Satellite TV news service 24/7; professional staff to operate the fully equipped professional TV and Radio studios; the production, development and distribution of audiovisual and multimedia productions for the media and the general public).

NB! The object of the contract has not changed with this modification. However, a new main CPV code had to be inserted in section II.1) Scope of the procurement and section VII.1) Description of the procurement after the modifications solely because the form could not be submitted without this amendment. The main CPV code is still 32000000 as stated in the contract notice (2019/S 066-153244) and contract award notice (2019/S 173-421217).
Within 2 months of the notification of the modification to the contract, an appeal may be lodged to the review body in Heading VI.4.1. You may submit any observations concerning the modification to the contract to the contracting authority indicated in Heading I.1. If you believe that there was maladministration, you may lodge a complaint to the European Ombudsman within two years of the date when you became aware of the facts on which the complaint is based (see https://www.ombudsman.europa.eu). Such complaint does not have as an effect either to suspend the time-limit to launch an appeal or to open a new period for lodging an appeal.
Section VII: Modifications to the contract/concession
(Lot I covers all services related to the running of the interinstitutional Europe by Satellite TV news service 24/7; professional staff to operate the fully equipped professional TV and Radio studios; the production, development and distribution of audiovisual and multimedia productions for the media and the general public.)
The purpose of amending the contract is to order additional services in four key areas of audiovisual production and technical services that have become necessary to properly implement the contract and that were not included in the original contract:
1) Video producer – Video and audio production team
2) Graphic artist/motion designer – Video and audio production team
3) Audiovisual technician – Technical support team
4) Media manager – Media management and promotion team
The modification shall take effect from 1 February 2021.
No other modifications pursuant to Article 172 (3) of the Financial Regulation have been made prior to this one.
The contracted services require a compact, unified and efficient workflow from production to distribution. The modification shall support and integrate with these to properly implement the contract, i.e. a single contractor to manage the studios allows for a great degree of flexibility and interchangeability of service providers. Adding a new contractor would adversely affect workflows, flexibility and interchangeability of service providers and is therefore likely to result in substantial duplication of costs. In addition, technical equipment owned by the Commission is made available to the original contractor for its sole use for the purposes of the contract on the conditions that it maintains, repairs and insures it. This set up cannot just be changed. Adding a new contractor therefore also implies substantial duplication of costs in that the Commission would have to purchase or rent new equipment or pay for their use through such other contractor’s services.
