Beim Übergang vom Trog zum Tunnel offene Bauweise beim Zulauf West ist nach Vertrag eine geböschte Baugrube vorgesehen. Allerdings berücksichtigt der Entwurf eine in diesem Bereich befindliche Gashochdruckleitung nicht. Daher wurde festgelegt, das anstelle der geböschten Baugrube neu ein senkrechter Baugrubenverbau in der Form eines Bohrträgerverbaus vorgesehen werden soll.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Eine Änderung des Gesamtcharakters läge vor, wenn sich das Wesen des gesamten Auftrages verändern würde - indem beispielsweise die orginäre Bauleistung, Lieferung oder Dienstleistung durch andersartige Leistungen ersetzt werden würde oder indem sich die Art der Erbringung der Leistung grundlegend ändern würde. Dies ist gegenständlich nicht der Fall, weil es sich lediglich um eine geänderte Form des Baugrubenverbaus handelt (senkrechter Verbau anstatt einer geböschten Baugrube) im Bereich der Gashochdruckleistung beim Trog Zulauf West handelt.
