Acordul-cadru are ca obiect incheierea de contracte subsecvente pentru achizitia medicamentelor utilizate pentru tratamentul pacientilor din cadrul Spitalului Judetean de Urgenta Targoviste. Autoritatea contractanta va raspunde in mod clar si complet tuturor solicitarilor de clarificari. In conformitate cu prevederile art. 160 coroborat cu art. 161 din Legea 98/2016 cu modificarile si completarile ulterioare, termenul-limita in care autoritatea contractanta va raspunde in mod clar si complet tuturor solicitarilor de clarificari /informatii suplimentare va fi in a 11-a zi inainte de termenul-limita stabilit in anuntul de participare pentru depunerea ofertelor. Numarul de zile pana la care se pot solicita clarificari inainte de data-limita de depunere a ofertelor/candidaturilor 18 zile.

Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca în situatiile prevazute la art. 164, 165, 167 din Legea nr.98/2016.

1.Declaratie privind neincadrarea in prevederile Art.164 din Legea nr.98/2016 privind achizitiile publice. Operatorul economic va completa cerinta corespunzatoare in formularul DUAE din documentatia de atribuire.

Încadrarea în situatia prevazuta la art. 164 din Legea nr. 98/2016 privind achizitiile publice atrage excluderea ofertantului din procedura aplicata pentru atribuirea contractului de achizitie publica.

2 Cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor care au putere de reprezentare, de decizie sau control in cadrul acestuia asa cum rezulta din certificatul ONRC/actul constitutiv;

3 Dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. 2 art. 167 alin 2 art. 171 din legea 98/2016 privind achizitiile publice.

Operatorii economici nerezidenti (straini) au dreptul de a prezenta orice documente edificatoare, eliberate de autoritatile din tara in care acestia sunt rezidenti prin care sa dovedeasca indeplinirea obligatiilor de plata a impozitelor catre bugetul de stat si bugetul local, in conformitate cu legislatia din tara de rezidenta.Certificatele trebuie sa ateste lipsa datoriilor restante cu privire la plata impozitelor si a asigurarilor sociale, la momentul prezentarii acestora.Documentele se vor prezenta insotite de traducerea autorizata a acestora in limba romana.

Operatorii economici odata cu depunerea DUAE va prezenta angajamentul tertului sustinator (impreuna cu documente anexe la angajament, transmise acestora de catre tert/tertii sustinatori, din care rezulta modul efectiv in care se va materializa sustinerea acestuia/acestora). Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate la solicitarea autoritatii contractante doar de catre ofertantii clasati pe primele 3 locuri, dupa aplicarea criteriului de atribuire, pana la incheierea Raportului Procedurii de atribuire, conf. art.196 alin.(2) din Legea nr.98/2016 privind Achizitiile Publice.

1. Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de înregistrare în conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla în niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.

Modalitate de îndeplinire: completare DUAE, Documentul justificativ, respectiv certificat ONRC sau pentru ofertantii straini, documente echivalente emise în tara de rezidenta. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate la solicitarea autoritatii contractante doar de catre ofertantii clasati pe primele 3 locuri, dupa aplicarea criteriului de atribuire, pana la incheierea Raportului Procedurii de atribuire, conf. art.196 alin.(2) din Legea nr.98/2016 privind Achizitiile Publice.

2. Operatorii economici ce depun oferta trebuie sa detina atestare ori apartenenta din punct de vedere profesional, respectiv sa detina: - Autorizatie de distributie angro emisa de Ministerul Sanatatii – Agentia Nationala a Medicamentului, pentru activitatea de depozitare, distributie si comercializare pentru produsul/produsele ofertat/ofertate, in conformitate cu Legea nr. 95 art 800 din 14 aprilie 2006 privind reforma în domeniul sanatatii, cu modificarile si completarile ulterioare, si ale art. 2 din normele la Ordinul nr. 131/2016 pentru aprobarea Normelor privind autorizarea unitatilor de distributie angro de medicamente de uz uman, certificarea de buna practica de distributie si înregistrarea brokerilor de medicamente de uz uman, completand in acest sens DUAE.

3. In situatia in care exista medicamentele care sunt utilizate pentru rezolvarea unor nevoi speciale, operatorii economici vor prezenta Autorizaţia pentru furnizare de medicamente pentru nevoi speciale emisă pentru distribuitori angro, autorizaţi de Agenţia Naţională a Medicamentului şi a Dispozitivelor Medicale, conform art. 699 alin. (1) și (2) din Legea nr. 95/2006.

Modalitate de indeplinire: Documentele justificative, respectiv Autorizatie de distributie angro emisa de Ministerul Sanatatii – Agentia Nationala a Medicamentului si Autorizaţia pentru furnizare de medicamente pentru nevoi speciale emisă pentru distribuitori angro, autorizaţi de Agenţia Naţională a Medicamentului, sau pentru ofertantii straini, documente echivalente emise în tara de rezidenta, care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate la solicitarea autoritatii contractante doar de catre ofertantii clasati pe primele 3, dupa aplicarea criteriului de atribuire, pana la incheierea Raportului Procedurii de atribuire, conf. art.196 alin.(2) din Legea nr.98/2016 privind Achizitiile Publice.

Documentele trebuie sa fie in termen de valabilitate la data prezentarii. Documentele emise in alta limba decat romana trebuie sa fie insotite de traducerea autorizata in limba romana. Documentele se vor semna cu semnatura electronica extinsa si se vor posta in SEAP.

Modul de departajare a ofertelor care inregistreaza propuneri financiare egale, conform criteriului de a atribuire:

— pentru locul 1: In situatia in care, se constata ca ofertele clasate pe primul loc, au propuneri financiare egale, autoritatea contractanta va solicita clarificari prin intermediul SEAP, in vederea incarcarii electronice de catre operatorii economici, situati pe primul loc, a unor documente care vor contine noi propuneri financiare (reofertare). Oferta financiara care inregisteaza pretul cel mai scazut in urma aplicarii criteriului de atribuire va fi declarata castigatoare,

— pentru locul 2: In situatia in care, se constata ca ofertele clasate pe locul 2, inregistreaza propuneri financiare egale, autoritatea contractanta va solicita clarificari prin intermediul SEAP, in vederea incarcarii electronice de catre operatorii economici, situati pe locul 2, a unor documente care vor contine noi prppuneri financiare (reofertare). Oferta financiara care inregistreaza pretul cel mai scazut in urma aplicarii criteriului de atribuire va fi declarata castigatoare. Ofertantul clasat pe locul I (loc superior) nu va fi afectat in nici o forma, intrucat in solicitarea de departajare se va mentiona in mod ferm si neechivoc locul 2 pentru care se reoferteaza. Oferta cu pretul cel mai scazut va fi declarata castigatoare,

— pentru locul 3: In situatia in care, se constata ca ofertele clasate pe locul 3, au propuneri financiare egale, autoritatea contractanta va solicita clarificari prin intermediul SEAP, in vederea incarcarii electronice de catre operatorii economici, situati pe locul 3, a unor documente care vor contine noi propunerei financiare (reofertare). Oferta financiara care inregistreaza pretul cel mai scazut in urma aplicarii criteriului de atribuire va fi declarata castigatoare. Ofertantul clasat pe locul I si locul II (locuri superioare) nu va fi afectat in nici o forma, intrucat in solicitarea de departajare se va mentiona in mod ferm si neechivoc locul 3 pentru care se reoferteaza. Oferta cu pretul cel mai scazut va fi declarata castigatoare.

Achizitorul isi rezerva dreptul de a denunta unilateral prezentul acord-cadru/contract subsecvent, printr-o notificare scrisa, fara nicio compensatie, de la data la care incheierii contractelor subsecvente, acordurilor-cadru incheiate de Ministeru Sanatatii, in calitate de unitate centralizata de achizitii. In acest caz, prestatorul are dreptul de a pretinde numai plata corespunzatoare pentru partea din acordcadru/contract-subsecvent indeplinita pana la data denuntarii unilaterale a prezentului contract.
