This will be a collaborative provision. The services required include the transportation of staff, contractors and approved passengers between shore bases, ships, lighthouse stations and other sites together with personal effects, equipment, materials and other required cargo which involves under slung loads.

Any contract resulting from the procurement exercise will be subject to the Law and jurisdiction of the Courts detailed in the Invitation to Tender package. No special legal form is required however each supplier will be required to become jointly and severally responsible for the contract before acceptance. If a group bid is accepted, the group must form itself into one single legally operating entity on acceptance.

Information and formalities necessary for evaluating if the requirements are met: The Authority will apply all the offences listed in Article 45(1) of Directive 2004/18/EC (implemented as Regulation 23(1) of the Public Contract Regulations (PCR) 2006 in the UK) and all of the professional misconducts listed at Article 45(2) of Directive 2004/18/EC (see also Regulation 23(2) in the PCR 2006) to the decision of whether a Candidate is eligible to be invited to tender.

Precise information on deadline(s) for lodging appeals: NLB will incorporate a minimum 10 working day standstill period (electronic transmission) or 15 working days (by postal service) at the point information on the award of the contract is communicated to all Tenderers. This period allows unsuccessful Tenderers to seek further debriefing from NLB before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information/debriefing has to be provided a minimum of 3 working days before the expiry of the standstill period. If this does not happen the standstill period must be extended by 3 working days from the date of the last debrief.
If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts (Amendment) Regulations 2009 (SI 2009/2992), The Public Contracts and Utilities Contracts (Scotland) Amendment Regulations (SI 2009 No. 428) and The Public Procurement (Miscellaneous Amendments) Regulations 2011 (SI 2011/2053) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland) and the sheriff court, the Court of Session (Scotland). Any such action must be brought promptly within the time limit of 30 days from the day on which you first knew or ought to have known that grounds for starting proceedings had arisen “the date of knowledge”. The Court has the discretion to extend the time limit where there is good reason for doing so, but only to a maximum of 3 months from the date of knowledge.
