The subject of the contract is the provision of technical maintenance services and support for the system of technical and physical protection of the national border of the Slovak Republic with Ukraine (hereinafter STAFO).
In view of the expiry of the Treaty on the provision of technical maintenance services and of the support to the system of technical and physical protection of the national border of the Slovak Republic with Ukraine (hereinafter: service Provision Contract) No 2012/001082-012, it is necessary to provide for a new contract which includes:
(a) Securing the functionality of STAFO:
Work work including replacement of non-functioning HW,
— Software for a Border Area and Security (EBAS MS),
— HW life cycle and SW component life cycle;
Configuration of configuration,
— Reporting amendments to STAFO;
(b) Integration requirements.
Without additional integration requirements;
(c) Operational requirements.

The supplementary services which are not included in the original contract from the original supplier shall be covered by the Appendix.

If the supplement is concluded, this is the provision of the additional services not included in the original contract by the original contractor. A change of supplier for another entity is not possible for economic or technical reasons, in particular requiring the compatibility and interoperability of existing services under the original contract. A change of supplier would create significant inconvenience (possible loss of the quality guarantee and functionality of the IS to ensure the monitoring and active protection of the state border and Schengen as well as undue technical difficulties in its operation) and substantial duplication of costs (incurring a disproportionate high cost of acquiring a new IS, making it unusable and excessively expensive, contrary to the principle of efficient, efficient and economic management of public finances as well as the fundamental principles of public procurement under Section 10 of the Act.
