This modification will allow the transition of the Oracle V11 software from the Invest NI data centre onto an Oracle cloud hosted infrastructure, and the associated hosting and license fees.

Following publication of a VEAT Notice (2019-OJS189-459124) this contract is being modified in accordance with; Regulation 72(1)(b)

Additional works, services or supplies ‘have become necessary’ and were not included in the initial procurement and a change of supplier would not be practicable (for economic, technical or interoperability reasons) and would involve substantial inconvenience/duplication of costs — provided the change does not exceed 50 % of the value of the original contract.

Regulation 72(1)(c)

The need for the change could not have been foreseen by a ‘diligent’ Department provided the changes do not affect the overall nature of the contract or exceed 50 % of the value of the original contract value.

On the basis of the information provided and supported by the legal advice sought by INI there would appear to be convincing reasons to modify this contract under Regulation 72(1)(b) and (c) due to the exclusive rights of Oracle in relation to the operating system that runs on their cloud infrastructure and that the hardware failure suffered in Oct 2018 could not have foreseen by INI.
