The purpose of this notice is to advise of the intention to novate contracts from Carillion Energy Services Limited and Carillion AMBS currently held by NIHE to Engie Regeneration Limited following an insolvency event. Contracts are due to novate no sooner than 10 days after the publication of this notice. There are 8 contracts effected by the novation process. The contracts were subject to OJEU competition in the past and awarded to Carillion Energy Services and Carillion AMBS. Following Carillion PLC entering insolvency on 15.1.2018, NIHE has been liaising with PwC and special managers regarding the continuation of services.

NIHE considers that it is entitled to award the above listed contracts to ENGIE Regeneration Limited in accordance with Regulation 72 (1) (d) of the Public Contracts Regulations 2015 which specifically provides for a safe harbour allowing Contracting Authorities to modify existing contracts without a new procurement procedure.

Contracts currently in place with Carillion PLC subsidiaries were effected by the insolvency event on 15.1.2018. PwC were appointed as special managers and have been conducting business since that date. PwC are working with all parties to finalise an acquisition of the contracts held by Carillion for the provision of services to NIHE. The intention is to novate all contracts to Engie Regeneration Ltd at a time after the 10-day expiry of this notice following publication. In considering the novation, Public Contracts Regulations 2015, Reg 72 1 (d) is applied to enable the proposed novation of contracts. All terms and conditions will remain unchanged. The scope or value of contracts will not be effected.
