II.2.4)Description of the procurement:

Negotiated procedure with a prior call for competition under the Utilities Contracts (Scotland) Regulations 2016 for the procurement of Marine civil engineer (Lead consultant), project manager, supervisor and principal designer services relating to a project for the redevelopment of the Ola Pier at Scrabster Harbour, Thurso, Scotland.

Evaluation of part IV 4A, 4B and 4D.

— the Bidder is unable to indicate suitability as required in section 4A; or,

— the Bidder is unable to comply with the requirements of yearly turnover stated at question 4B.1.1 and 4B.2.1; or,

— the Bidder is unable to comply with the requirements of the financial ratios stated in question 4B.4; or,

— the Bidder is unable to comply with the requirements of the insurance provisions stated at question 4B.5,

— the Bidder is unable to comply with the requirements of quality management procedures and health and safety procedures stated in question 4D.1.

Then the Authority has the right to exclude the Bidder from this process.

Evaluation of part IV 4C.

The combined score to be allocated for Technical and Professional ability of Bidders and the weighting to be applied will be evaluated on the basis of the responses to following questions:-.

4C.1.2 – Relevant examples (80 %);

4C.9 – Available tools, plant or technical equipment (20 %)

In respect of question 4C.1.2, each Assessment Panel member will evaluate and allocate a score to each topic according to the following table:

0 - Unacceptable. Nil or inadequate response. Fails to demonstrate previous experience/capacity/capability relevant to this criterion.

1 – Poor. The response is partially relevant but generally poor. The response shows some elements of relevance to the criterion but contains insufficient/ limited detail or explanation to demonstrate previous relevant experience/ capacity/capability.

2 – Acceptable. The response is relevant and acceptable. The response demonstrates broad previous experience, knowledge and skills/ capacity/ adaptability but may lack in some aspects of similarity e.g. previous experience, knowledge or skills may not be of a similar nature.

3 – Good. The response is sufficiently detailed to demonstrate a good amount of experience, knowledge or skills/ capacity/ capability relevant to providing similar services to similar clients.

4 – Excellent. The response is completely relevant and excellent overall. The response is comprehensive, unambiguous and demonstrates thorough experience, knowledge or skills/capacity/capability relevant to providing similar services to similar clients.

The scores allocated to each topic will be summed and then multiplied by 2.5 to arrive at the total overall score for this question. The overall weighting of this total score will be 80 %.

In respect of question 4C.9, each Assessment Panel member will evaluate and allocate a score to each topic according to the following table:

0 - Unacceptable. Nil or inadequate response. Fails to demonstrate previous experience/capacity/capability relevant to this criterion.

0 - Unacceptable. Is very unlikely to meet the project requirements.

1 - Poor. May fail to meet the project requirements.

2 - Acceptable. Will meet the project requirements.

3 - Good. Will clearly meet the project requirements.

4 - Excellent. Exceeds the project requirements.

The scores allocated to each topic will be summed and then multiplied by 1.25 to arrive at the total overall score for this question. The overall weighting of this total score will be 20 %.

The total weighted scores for questions 4C.1.2 and 4C.9 will then be added together to bring out an overall total score. All total scores will then be ranked in descending order.

III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers

4A.1 - if required by the member state, bidders are required to be enrolled in the relevant professional or trade registers within the country in which they are established;

4A.2 - where it is required within a bidder’s country of establishment they must confirm which authorisation or memberships of the relevant organisation(s) are required in order to perform this service. Bidders must confirm if they hold the particular authorisation or memberships.

III.1.2)Economic and financial standing
List and brief description of selection criteria:

This section refers to Section B of Part IV of the ESPD (Scotland) and covers questions 4B 1 - 5 of the ESPD (Scotland):

4B1.1: Bidders are required to have a minimum "general" yearly turnover of 700,000(GBP) for the last three (3) years.

As evidence for the ESPD (Scotland) question 4B1.1, the Procurement Officer may ask for annual accounts from the bidder.

4B.1.2 - NOT REQUIRED

4B.1.3 - If the relevant documentation requested in relation to 4B.1.1 is available electronically, please indicate.

4B.2.1: Bidders are required to have a minimum yearly “specific” turnover of 700,000 (GBP) for the last 3 years in the business area covered by the contract (i.e. Marine Engineering Consultancy and relative Project Management, Supervisor and Cost Consultancy).

4B.2.2 - NOT REQUIRED

4B.2.3 - If the relevant documentation requested in relation to 4B.2.1 is available electronically, please indicate.

4B.3: Where turnover information is not available for the time period requested, the bidder will be required to state the date which they were set up/started trading.

4B.4 - 4B.4.1: Bidders are required to state the value(s) for the following financial ratio(s)for the last three financial years:

— Profitability: operating profit (minimum level of standard required: %>20 %),

— Balance Sheet: current ratio (minimum level of standard required: minimum 1.5),

— Balance Sheet: gearing (total debt long & short/shareholders equity)(minimum level of the standard required: minimum <0.5).

4B.5: Bidders must be able to confirm that they hold, or can commit to obtain, prior to the commencement of any subsequently awarded contract, the types and levels of insurance indicated below against:

The Consultant’s failure to use the skill and care normally used by professionals providing services similar to the service of no less than 5,000,000 GBP in respect of each claim, without limit to the number of claims during the Provision of Services and for 10 years following completion of the whole of the service or termination;

(ii) Loss of or damage to property and liability for bodily injury to or death of a person (not an employee of the Consultant) arising from or in connection with the Consultant Providing the Service of no less than 10,000,000 GBP in respect of each claim, without limit to the number of claims during the Provision of the Services;

(iii) Death of or bodily injury to employees of the Consultant arising out of and in the course with the contract of no less than 10,000,000 GBP in respect of each claim, without limit to the number of claims during the Provision of the Services.

III.1.3)Technical and professional ability
List and brief description of selection criteria:

4C.1.2: Bidders are required to provide examples that demonstrate that they have the relevant experience to deliver the supply as described in part (II.2.4) of the Contract Notice.

4C.9: Bidders are required to demonstrate that they have (or have access to) the relevant tools, plant or technical equipment to deliver the types of requirements detailed in the Contract Notice

Minimum level(s) of standards possibly required:

4C.1.2: Bidders responses should include up to a maximum of 5 example projects which address as many of the following matters as possible:

Marine Works (10 %): please provide detailed examples of projects that you have successfully (from the client’s perspective) led and delivered as the Lead Consultant within the past 3 years which have included the design, project management and supervision of works in UK ports and harbours including construction of new piers and onshore facilities;

Geotechnics (10 %): please provide detailed examples of projects that you have successfully (from the client’s perspective) led and delivered as the Lead Consultant within the past 3 years which have included design and management of foundations of quay walls in UK ports and harbours;

Structures (10 %): please provide detailed examples of projects that you have successfully (from the client’s perspective) led and delivered as the Lead Consultant within the past 3 years which have included investigation of condition of existing structures, including marine structures together with development of repair and refurbishment solutions;

Dredging: (10 %) please provide detailed examples of projects that you have successfully (from the client’s perspective) led and delivered as the Lead Consultant within the past 3 years which have included design and implementation of dredging works for existing and new channels;

Preparation of Strategic Briefing and Outline Proposals: (10 %) please provide detailed examples of projects that you have successfully (from the client’s perspective) led and delivered as the Lead Consultant within the past three years which have included preparing reports for clients and engaging in the option selection process for infrastructure projects, including the preparation of Scope and Site Information for design and build contracts;

Project Management (10 %): please provide detailed examples of projects that you have successfully (from the client’s perspective) led and delivered as the Lead Consultant within the past 3 years which have included fulfilling the NEC3/4 ECC role of Project Manager, implementing processes for management of risk, time, quality, cost and change (compensation events);

Supervisor (10 %): please provide detailed examples of projects that you have successfully (from the client’s perspective) led and delivered as the Lead Consultant within the past 3 years which have included fulfilling the NEC3/4 ECC role of Supervisor, implementing processes for management of tests and inspections and of the defect notification and correction process;

Cost consultant (10 %): please provide detailed examples of projects that you have successfully (from the client’s perspective) led and delivered as the Lead Consultant within the past 3 years which have included preparation of cost estimates, cost plans and cash flow forecasts for infrastructure together with cost reporting to clients for duration of projects – incorporating reporting on the NEC processes for payment and compensation events (before and after implementation).

4C.9: Bidders should provide information to demonstrate that they have (or have access to) the relevant tools, plant or technical equipment to deliver the types of requirements detailed in the Contract Notice addressing the following matters:

Design software to demonstrate compliance with Eurocodes or equivalent (5 %).

Contract management software for NEC3/4 – as accepted by NEC, One Great George Street, London SW1P 3AA or equivalent (5 %).

Web-based document management systems in accordance with the requirements of PAS 1192 (5 %).

Communication systems between site and head office – quality and capacity of broadband and telephony services; type of software used for email management; messaging systems (5 %).
