IV.1.1.
Type of procedure
Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below
- Extreme urgency brought about by events unforeseeable for the contracting authority and in accordance with the strict conditions stated in the directive
Explanation:
A Kbt. 98. § (2) bekezdés e) pontja szerinti feltételek alátámasztása
— „az feltétlenül szükséges,”
A fent részletezettek alapján a védőeszközök a járványügyi helyzettel kapcsolatos ellátásban feltétlenül szükségesek, mind a megelőzés, mind pedig a védekezésre tekintettel
— „mivel az ajánlatkérő által előre nem látható okból előállt rendkívüli sürgősség miatt”.
A védőeszközök elengedhetetlenek a már fertőzött betegek kezelésében részt vevő egészségügyi dolgozók számára. Tekintettel arra, hogy a fertőzöttek száma napról napra folyamatosan növekszik, így a védőeszközök minél gyorsabb beszerzése elengedhetetlen az Ajánlatkérő számára, annak érdekében, hogy a gyógyítási tevékenység akadálymentesen és folyamatosan történjen. A járvány kialakulása, európai elterjedése, annak üteme nem volt előre látható körülmény.

Tekintettel a 2020. március 18. és 20. szállítási határidőre, figyelemmel a nyílt, meghívásos vagy tárgyalásos eljárás Kbt.-ben meghatározott minimális időszükségletére, ajánlatkérő központi ellenőrzési kötelezettségére és a Kbt. 131. § (6) bekezdésének rendelkezéseire a beszerzési igény ezen eljárásfajták alkalmazásával jogszerűen nem kielégíthető.
— „a rendkívüli sürgősséget indokoló körülmények azonban nem eredhetnek az ajánlatkérő mulasztásából, vagy az ajánlatkérő által előidézett okból”.
Ajánlatkérő az előtte álló feladatokhoz meglévő készleteinek átcsoportosításával szükséges technikai forrást nem képes teremteni, a beszerzéshez szükséges anyagi forrás a kijelölést megelőzően nem állt rendelkezésre, továbbá a járvány terjedése és annak sebessége előre nem volt megjósolható, így ajánlatkérőt a beszerzés hirdetmény nélküli tárgyalásos eljárás keretében történő beszerzés tekintetében mulasztás nem terheli, a beszerzést indokló körülmény kialakulásában semmilyen módon nem működött közre.
