Multiple framework contract with reopening of competition:
multiple framework contract: in the event of contract award, a framework contract, which is set to end on 31.12.2017 and may be extended for up to 24 months, will be signed with each tenderer who complies with the exclusion and selection criteria and proves that he has all the necessary authorisations, in accordance with Decree No 2011-1457 of 7.11.2011 on the authorisation to purchase electricity for resale, and all available or future legal texts related thereto.
Reopening of competition: for a specific order, all the economic operators that signed a framework contract with the European Parliament will be invited to submit a price offer which will be assessed on the basis of the award criteria defined in point 6 of the administrative clauses. At the end of this stage, a specific supplies contract, with a duration of 18 months, will be signed with the contractor submitting the lowest price offer. The European Parliament may reopen competition in order to sign a second specific supplies contract with a duration of up to 24 months.
Procedures for reverting to the ARENH (Regulated Access to Incumbent Nuclear Electricity) mechanism:
in the context of a 100 % market price, the European Parliament retains the possibility to revert to ARENH. Where applicable, the option shall be used no later than 31 October of year N-1 to become applicable on 1 January of year N.
Reverting to the ARENH mechanism will be authenticated by the European Parliament sending a registered letter to the contractor:
— service instructions to confirm reverting to the ARENH mechanism,
— service instructions to determine the baseload price for reselling the block substituted by ARENH.
