Interregion procurement of medical equipment (ROHU357) – In the framework of the tender “Cooperation for high health-care standards in prevention, early identification and effective treatment of diseases in the Bihor-Hajdú-Bihar Euroregion”, the contracting authority intends to purchase various medical equipment, appliances or instruments in three lots. The performance shall include the delivery, putting into service and the holding of a 2-day test run of a variety of medical equipment, appliances or instruments that are new to the factory. The holding of a 2-day test run shall be included in the time limit for delivery. The tenderer shall provide 2*2 hours of training for the part of the specialist consultants designated by the contracting authority on a date agreed in advance by the contracting authority.

17 For each part: The successful tenderer shall ensure, during the performance of the warranty obligation, that his specialists commence the correction of the defect on the spot as soon as possible, but no later than 24 hours after the notification of the defect, and preferably complete it on that day, including weekends and public holidays.

Pursuant to Section 1(7) of Government Decree No 321/2015 of 30 October, certificates relating to the grounds for exclusion and eligibility requirements issued prior to the commencement of public procurement may also be submitted, as long as the content of the facts and data specified in the certificates is real. Unless proven otherwise, the contracting authority shall presume the veracity of the data without any specific statement to that effect by the tenderer. The Kbt. Section 64 (1), notwithstanding the existence of any other grounds for exclusion other than those mentioned in section 62 (1) b) and f), including cases where the misconduct or infringement specified in an Act leads to exclusion based on the discretion of the contracting authority, an economic operator participating in the certification of the tenderer, candidate, subcontractor or suitability may not be excluded from the public procurement procedure if the decision of the Public Procurement Authority that has become final under section 188 (4), or, in the case of an administrative action to challenge it, the validity of the tender specified in section 188 (5), has been duly established by a final decision of the court under section 188 (5), or, in the event of an administrative action to challenge it, by a final decision of the court adopted in violation of section 188 (5), or a final decision of the court under section 188 (5). If intermittently. A decision of an authority that has become final under section 188 (4) or, in the event of an administrative action to challenge it, the final and binding decision of the court under section 188 (5), shall establish the reliability of the economic operator subject to the given ground for exclusion, and the contracting authority shall adopt it without consideration. The final and binding decision shall be submitted by the economic operator together with the European Single Procurement Document. As part of the verification of the non-existence of the grounds for exclusion, the economic operator shall not be required to provide a certificate that the economic operator has already submitted to the same contracting authority by electronic means in a previous procurement procedure in the ERF. In this case, the economic operator shall declare in which previous procedure the certificate submitted is to be taken into account in the evaluation. The contracting authority shall examine whether the certificate submitted previously meets the substantive requirements applicable to the certificate to be submitted in the given inter-procedural procedure, regardless of whether the previous certificate, if any, indicates in which procedure it was issued for use.

Tenderers shall provide prior proof of compliance with the Public Procurement Act by submitting the ESPD when submitting their tender. The following suitability criteria specified by the contracting authority pursuant to section 65. An α (alpha) declaration may be made in the EEKD document. The Kbt. Section 69 (4).

M1 The tenderer (joint tenderer) shall describe the most significant deliveries within the meaning of Section 21(1)(a) of Government Decree 321/2015 (X. 30.) in the preceding 3 years, counted back from the date of dispatch of the call for competition, the time of performance (starting and finishing year, month, day), the name and telephone number of the other party concluding the contract, the subject and quantity of the delivery, and the statement that the performance was performed in accordance with the provisions and the contract, as well as attaching to these deliveries 321/2015. The reference certificates or declarations referred to in Section 22(1) to (2) of Government Decree (X. 30.) Korm.

It shall be sufficient to describe and certify the most significant performances to the extent that they meet the eligibility criteria. With regard to the method of verification, the tenderer shall, in accordance with the provisions laid down in Decree No 321/2015 of April, (X. 30.) Government Decree (X..) shall provide the reference certificates or declarations referred to in Section 22(1) and (2) of Government Decree No/. The reference may be verified by one or more contracts.

The contracting authority shall require the certification of the performance of three years, and the contracting authority shall take into account the performances completed during the period under review, but not later than six years. PURSUANT TO DECREE NO 321/2015 OF APRIL According to Section 21/A of Government Decree No/of 30 October, the contracting authority shall also accept as proof of performance the certification of the result or activity specified in the reference requirement as part of the performance of the contract.

M.2 PURSUANT TO DECREE NO 321/2015 OF APRIL On the basis of Section 21(1)(i) of Government Decree No of 30 October, the tenderer shall attach to its tender the product(s) tendered with respect to the product(s) offered pursuant to Section 21(1)(i) of Government Decree No 16/2012. (II. 6.) Section 9(2) of Government Decree No 4/2009 on medical devices (III. 17.) The manufacturer’s declaration of conformity (EC Conformity Declaration) under Decree No 4/2009 of the Minister for Health and Health and, for the purposes of placing the medical device on the market, (III. 17.) Pursuant to Decree No 4/2009 of the Minister of Health, a copy of the CE conformity assessment certificate or equivalent certificate issued by a certification body accredited in any national system stating that the medical device complies with the provisions of Regulation 4/2009. (III. 17.) The essential requirements laid down in the Decree of the Minister of Health or Regulation (EU) 2017/745 of the European Parliament and of the Council on medical devices.

M.3 PURSUANT TO DECREE NO 321/2015 OF APRIL Pursuant to Section 21(1)(h) of Government Decree No/of 30 October, the tenderer shall submit the manufacturer’s brochure of the equipment, apparatus or devices to be offered, or a figurative product brochure certified by the manufacturer or distributor, from which it can be clearly established that the technical parameters of the relevant equipment, apparatus or devices meet the minimum professional requirements specified in the technical specifications.

Pursuant to Section 24(1) of Government Decree No 321/2015 (X. 30.) in cases where the official list of qualified tenderers specified in Sections 28 and 36 proves, subject to the provisions of Section 30 and Section 39, that the economic operator complies with the relevant eligibility requirement, the presence in the official list of qualified tenderers available electronically, or a certificate submitted by an economic operator established in another Member State of the European Union pursuant to the list of authorised tenderers set out in section 21(3) shall also be accepted by the contracting authority.

M.3 To the extent that Article 321 of Regulation (EC) No On the basis of Section 21(1)(h) of Government Decree (X. 30.) Korm., for equipment, devices or devices to be offered, it can be clearly established on the basis of the manufacturer’s brochure or the figurative product information certified by the manufacturer or distributor that the technical parameters of the relevant equipment, devices or devices do not meet the minimum professional requirements specified in the technical specifications.

Tenderers (joint tenderer) may also meet the technical and professional capacity criteria jointly. (Kbt. Section 65 (6)) The requirements that can be applied by analogy to economic operators only individually shall be sufficient under the possibility of joint compliance if one of them complies.

Proof of technical and professional capacity shall be provided by the Kbt. In the event of the involvement of organisations (persons) referred to in section 65 (6) as providers of capacity, the Kbt. Section 65 (7).

III.2)Conditions related to the contract
III.2.2)Contract performance conditions:

1 Main financing and payment terms:

Tenders, contracts and settlements shall also be made in HUF. No advance shall be paid by the contracting authority. Contracting authorities shall provide for the possibility of partial performance. The tenderer shall be entitled to submit one partial invoice and one final invoice. The tenderer shall be entitled to submit one partial invoice in the event of 50 % performance. The aid intensity of the project is 100 %. The contracting authority shall pay for the product to be delivered under the conditions laid down in the Public Procurement Document, the Kbt. On the basis of section 135 (1) (6) and (10), the Ptk shall pay the Ptk by transferring 30 days from the receipt of the invoice issued on the basis of the certificate of performance. Section 6:130 (1) to (2). The Kbt. Section 27/A The customer shall receive and process electronic invoices that comply with European Standard EN 16931-1:2017 and the list of syntaxes published by the European Commission in the Official Journal of the European Union.

In the event of a delay in payment by the buyer, during the term of the contract, as specified in point 3.1 of the draft contract, the Ptk. SECTION 6: Section 155 shall be entitled to default interest at the rate calculated on the basis of the provisions of section.

Penalty for late payment: In the event of late performance, the seller shall be required to pay a penalty for late payment equal to 1 % of the total net contract price for each calendar day, up to a maximum of 20 (twenty) per cent of the total net contract value.

Penalty for failure: 25 % of its consideration excluding VAT under the entire contract.

The detailed rules on payment conditions and ancillary obligations ensuring the contract are set out in point 3 of the draft contract specified in the procurement document.

The tender shall be received electronically by the expiry of the time limit for the submission of tenders. The ERF shall send an acknowledgement of the date of receipt. In the case of a tender submitted electronically, the Kbt. 1.) The tenderer(s) shall submit in their tender all the documents and declarations specified in point II.7 of the procurement document. As part of the verification of compliance with the eligibility criteria and of the absence of grounds for exclusion, the economic operator shall not be required to provide a certificate that the economic operator has already submitted electronically to the same contracting authority in a previous procurement procedure in the ERF. In this case, the economic operator shall declare in which previous procedure the certificate submitted is to be taken into account in the evaluation. The contracting authority shall examine whether the certificate submitted previously meets the substantive requirements applicable to the certificate to be submitted in the given public procurement procedure, regardless of whether the previous certificate indicates, if applicable, the purpose of the earlier certificate for use in the public procurement procedure. Where, on the basis of the Public Procurement Act or a separate law adopted on the basis of its authorisation, a contracting authority requires the submission of a document during a public procurement procedure, the document shall, if available, be submitted using the electronic form in the ERF system. If an electronic form is not available for the given document in the language in which the declaration is made, in the form of a simple electronic copy of the paper document. Where the electronic form relating to a given document is not available in the language in which the declaration is made, the declaration may be attached to the EQF as a document bearing at least an advanced electronic signature, but the contracting authority may not require the use of an electronic signature, except in the case provided for in paragraph (4). The tenderer or the contracting authority shall fill in a template as an electronic form as an electronic form in the procurement document, in the form of an electronic form, as part of its tender. Economic operators shall be authorised by the Kbt. For the purposes of the application of section 44 of the ERF, a dedicated function shall apply to the separate placement of a document containing a trade secret in the ERF.

2.) The Kbt. Section 131 (1) provides that contracting authorities may conclude the contract specified in the documentation with the winner of the procedure. If the contracting authority at the time of the announcement of the results, the Kbt. Section 131 (4) shall also specify in the summary the tenderer classified as the second most advantageous tenderer, and shall conclude a contract thereon if the successful tenderer resigns.

3.) The Kbt. Section 35 (8) The contracting authority shall inform the tenderer or joint tenderer that it does not allow the establishment of an economic organisation (project company) for the performance of the contract. However, several tenderers may submit tenders jointly. In this case, joint tenderers shall attach to their tender the agreement on joint and unlimited liability and the determination of the proportion in performance, and shall specify in their jointly submitted tender which of the tenderers is authorised to conclude the contract.

4.) The tenderer or (joint) tenderer, if a change registration procedure is in progress, shall attach to the tender the application for registration of changes submitted to the company court and a copy of the certificate of its arrival sent by the company registration court. A negative declaration is also required!

5.) Public procurement documents shall be accessible to all registered tenderers in full and in electronic form directly by electronic means, and the EQF identification number shall be available to all registered tenderers on the date of publication of the call for competition. On the day of expiry of the time limit for submission of tenders, the document shall be available until the time limit for submission of tenders expires.

6.) Tenders shall be submitted through the EQF.

7.) The contracting authority shall, in accordance with the procedure laid down in Regulation No 321/2015 of the European Parliament and of the Council, Pursuant to Section 30(4) of Government Decree (X. 30) Government Decree (X. 30) draws the attention of tenderers to the fact that, compared to the criteria for qualification set out in section 28 (3), the criteria and certification of its technical and professional capacity are stricter, as specified in points III.1.3.M1 and M.2 of the call.

8). Tenderer, Kbt. Pursuant to section 56 above, the contracting authority may request additional information on the content of the invitation to tender and the public procurement document in writing, no later than the fourth day before the time limit for replying www.ekr.gov.hu address. The contracting authority shall send the additional information via the EIR system as soon as possible, but not later than 6 days before the time limit for the submission of tenders expires. Tenderers shall state in their tender that they have received all additional information issued in the course of the public procurement procedure and that they have been taken into account in the preparation of their tender.
