Wir weisen ausdrücklich auf die Ausschlusswirkungen des § 160 Gesetz gegen Wettbewerbsbeschränkungen(GWB), insbesondere auf die Frist des § 160 Abs. 3 Satz 1 GWB hin.

Genaue Angaben zu den Fristen für die Einlegung von Rechtsbehelfen:

Ein zulässiger Nachprüfungsantrag bei der unter VI.4.1) genannten Vergabekammer kann allenfalls bis zur wirksamen Zuschlagserteilung gestellt werden. Eine wirksame Zuschlagserteilung ist erst möglich, wenn der Auftraggeber die unterlegenen Bieter über den Grund der vorgesehenen Nichtberücksichtigung ihres Angebots und den Namen des Bieters, dessen Angebot angenommen werden soll, in Textform informiert hat und seit der Absendung der Information 15 Kalendertage (bei Versand per Telefax oder auf elektronischem Weg: 10 Kalendertage) vergangen sind.

Ein Nachprüfungsantrag ist unzulässig, soweit

- der Antragsteller den geltend gemachten Verstoß gegen Vergaberechtsvorschriften schon vor Einreichen des Nachprüfungsantrages erkannt und gegenüber dem Auftraggeber nicht innerhalb einer Frist von zehn Kalendertagen gerügt hat,

- Verstöße gegen Vergaberechtsvorschriften, die aufgrund dieser Bekanntmachung erkennbar sind, nicht spätestens bis zum Ablauf der in IV.2.2) genannten Frist gerügt werden, oder

- Verstöße gegen Vergaberechtsvorschriften, die erst in den Vergabeunterlagen erkennbar sind, nicht spätestens bis zum Ablauf der Frist zur Bewerbung oder zur Angebotsabgabe gerügt werden.

Teilt der Auftraggeber einem Bewerber oder Bieter mit, dass er einer Rüge nicht abhelfen will, so kann der betroffene Bewerber oder Bieter wegen dieser Rüge nur innerhalb von 15 Kalendertagen nach Eingang dieser Mitteilung einen zulässigen Nachprüfungsantrag stellen.
