Explanation:
The Land Equipment Vehicle Support Team, part of the UK Ministry of Defence intends to place a contract with Horstman Defence Systems Limited (“the Contractor”) for the repair and conversion of 60 LH and 60 RH Hydrogas Suspension Units (“Units”) used in connection with the Challenger II platform to Generation III build standard. It is considered that this Contract can be placed using the Negotiated Procedure Without Prior Publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011) for technical reasons. This is because only the Contractor, as the Original Equipment Manufacturer for the Units has access to the technical specifications, design and technical information, expertise, knowledge and know-how necessary to repair and convert the Units to Generation III build standard and, as the Units are safety critical to the operation of the platform, the Units must be repaired and converted in accordance with the relevant technical specifications in order to meet operational safety requirements.
