  • Extreme urgency brought about by events unforeseeable for the contracting authority and in accordance with the strict conditions stated in the directive
Explanation:

Die derzeit vorliegende, nicht vorhersehbare und sich sehr schnell ausbreitende PandemieCovid-19 stellt ein dringliches Ereignis dar, das bei fehlenden Vorkehrungen und Maßnahmen zu nicht wieder gut zu machenden Personenschäden bis hin zum Tod führen kann. Diese Pandemie erfüllt damit die Voraussetzungen der vergaberechtlichen Dringlichkeit. Soweit aus dringenden und zwingenden Beschaffungsverpflichtungen zur Erfüllung staatlich, hoheitlicher Aufgaben des Gesundheitsschutzes der Bevölkerung auch eine Einholung von Vergleichsangeboten nicht möglich war, musste der Auftrag unmittelbar vergeben werden.
