DE 2197642 Appointment of EOT for Hazelwood Integrated College Newtownabbey
The objective of this procurement process is to successfully appoint an Economic Operator Team (EOT) who will actively develop the employer’s brief for the design and delivery of a new Post Primary Hazelwood Integrated College Newtownabbey. The successfully appointed EOT shall provide the professional services applicable to RIBA (2013) Stages 0 to 7 as identified in call for tender contract documentation and information. The EOT shall develop the design to RIBA (2013) Stage 3 Exemplar Developed Design before appointing and managing an Integrated Supply Team (IST) to further develop the detail/technical design and deliver the project throughout all remaining RIBA Plan of Work (2013) Stages 4 to 7. For a complete description of this procurement please refer to CfT contract documents and draft scope of services. Price aspect will be assessed using the Narrow Average.
Hazelwood College Newtownabbey.
In accordance with Regulation 65(3) of the Public Contract Regulation 2015, 5 candidates will be invited. This offers adequate competition to ensure that the employer is assured value for money and that there is sufficient opportunity offered to tenders. However, this limit also protects the industry from wasting valuable resources which are required to prepare a tender submission.

Section III: Legal, economic, financial and technical information
In order for an economic operator to be eligible to participate in this competition the Economic. Operator team must hold all relevant licences, accreditations or certificates for specific categories and sectors as set out below: Project Manager Employees must have and maintain 1 of the following:
— registration with the Architect’s Registration Board (ARB),
— chartered membership of the Institution of Structural Engineers (IStructE),
— chartered membership of the Royal Institution of Chartered Surveyors (RICS),
— chartered membership of the Institution of Civil Engineers (ICE),
— chartered membership of the Chartered Institution of Building Services Engineers (CIBSE),
— chartered membership of the Institution of Mechanical Engineers (IMechE),
— chartered membership of the Institution of Engineering and Technology (IET),
— chartered membership of The Association of Project Management (APM) in a construction related role,
— chartered membership of The Chartered Institute of Architectural Technologists (CIAT),
— chartered membership of The Chartered Institute of Building (CIOB),
— chartered membership of The Royal Institute of British Architects (RIBA),
— chartered membership of The Royal Society of Ulster Architects (RSUA),
— equivalent professional body within your own jurisdiction.
Architect employees must have and maintain:
— registration with the Architect’s Registration Board (ARB), or
Employees must have and maintain:
— chartered membership of Engineers Ireland, or
Quantity Surveyor Employees must have and maintain:
— chartered membership of the Royal Institution of Chartered Surveyors (RICS), or
Employees must be from the electrical discipline and have and maintain:
— chartered membership of the Institution of Engineering and Technology (IET), or
Employees must be from the mechanical discipline and have and maintain:
— chartered membership of the Institution of Mechanical Engineers (IMechE), or
— equivalent professional body. within your own jurisdiction.
Economic operators are required to be registered and have Verified Status on Constructionline and should have the minimum category value (240 000 GBP) in at least one of the Constructionline Categories specified or have submitted a fully completed PQQ1A Constructionline Financial Addendum/s. In the case where an economic operator is a group of economic operators or relying on the capacity of other entities for economic and financial standing, the economic operator as “Leads Enterprise” must have a category value no less than 40 % of the minimum category value (96 000 GBP) required by the Contracting Authority; and the sum of the category values of the group of economic operators and the other entities that it is relying on for economic and financial standing, in a “Relevant Work Category” must be greater than or equal to the minimum category value (300 000 GBP) required by the Contracting Authority:

In order for an economic operator to be eligible to participate in this competition. The economic operator team must hold valid insurance to all the applicable values.
1)Public Liability Insurance with a minimum limit of indemnity not less than 10 000 000 GBP per incident.
2) Employer’s liability insurance (economic operator only) with a minimum limit of indemnity not less than 10 000 000 GBP per incident compliant with applicable statutory requirements.
Professional indemnity insurance:
Professional indemnity insurance for all activities of a professional nature including design liability with a limit of indemnity of not less than that specified below in GBP for each and every claim 5 000 000 GBP.
The economic operator (or where the economic operator is a group of economic operators, all parties forming the group of economic operators) must provide at least one of the core disciplines listed below from within its own resources:
— project manager,
— electrical engineer,
— mechanical engineer,
— structural engineer,
— civil engineer,
— quantity surveyor.
For the purposes of pre-qualification, the economic operator will be assessed.

The economic operators’ performance on this contract will be regularly monitored. If an economic operator has received. more than 1 current Notice of Written Warning or a Notice of Unsatisfactory Performance, the Contracting Authority, at its discretion, can consider an economic operator’s exclusion from future procurements, being undertaken on behalf of bodies covered by the Northern Ireland Public Procurement Policy (NIPP), for a minimum period of 12 months or 3 years respectively.

CPD, in its capacity as a Central Purchasing Body, is administering this procurement on behalf of the Contracting Authority. The Contracting Authority expressly reserves the right:
(i) to award one, some, all or no lots;
(ii) not to award any contract/Framework Agreement as a result of the procurement process commenced by publication of this notice or to cancel the procurement at any stage; and
(iii) to make whatever changes it may see fit to the content and structure of the tendering competition and in no circumstances will the Authority be liable for any costs incurred by economic operators or candidates. Any expenditure, work or effort undertaken prior to contract award is accordingly at the sole risk of the economic operator or candidate participating in this procurement process. This project will be used to progress the Government’s wider social, economic and environmental objectives. No business whatsoever is guaranteed under any resulting Framework Agreement or contract indeed there is no guarantee that any Framework Agreement or contract will be put in place in relation to this notice. No compensation etc will be paid if a contract or Framework Agreement is withdrawn for any reason. Economic operators should take part in this process only on the basis that they fully understand and accept this position.

This procurement is governed by the Public Contracts Regulations 2015 and. provides for economic operators who have suffered, or who risk suffering, loss, or damage, as a consequence of an alleged breach of. the duty owed in accordance with Regulation 91 to start proceedings in the High Court. A standstill period will commence at the point information on the award of the contract is communicated to tenderers. That notification will provide information on the award decision. The standstill period, which will be for a minimum of 10 calendar days, provides time for unsuccessful tenderers to challenge the award decision before the contract is entered into. Any proceedings relating to any perceived non-compliance with the relevant law must be. started within 30 days, beginning with the date when the economic operator first knew, or ought to have known that grounds for starting the proceedings had arisen (a court may extend the time-limit to 3 months, where the court considers that there is a good reason for doing so).
