1° ne se trouve pas dans l'une des situations d'exclusion visées aux articles 67 à 69 de la loi du 17 juin 2016;

Dans les 20 jours qui suivent la date ultime de réception des offres, l’adjudicateur vérifiera la situation des soumissionnaires sur le plan des dettes sociales et fiscales et ce, sur base des attestations disponibles gratuitement via les applications électroniques accessibles.

Avant d’attribuer les différents lots du marché, l’adjudicateur vérifiera, dans le chef du soumissionnaire premier classé uniquement, l’absence de motifs d’exclusion obligatoires ou facultatifs:

- en consultant les bases de données nationales accessibles gratuitement ;

- en lui demandant de fournir les documents nécessaires non accessibles via ces banques de données (certificats délivrés par l’autorité compétente du pays concerné) et notamment un extrait de casier judiciaire de la société et/ou des membres de l’organe administratif, de gestion de surveillance et/ou des personnes qui détiennent un pouvoir de représentation, de décision ou de contrôle.

III.1.3)Technical and professional ability
List and brief description of selection criteria:

Pour démontrer sa capacité à exécuter le marché, le soumissionnaire devra joindre à son offre:

 la liste des principaux services effectués au cours des trois dernières années, en indiquant le montant, la date, le destinataire public ou privé, ainsi que les tonnages de déchets verts traités;

 une copie de toutes les autorisations dont il dispose permettant d'accueillir et de traiter les déchets. Il fournira notamment une copie d'un extrait du permis d'exploiter son site de traitement stipulant que celui-ci peut accueillir et traiter les déchets verts, et ce dans des proportions suffisantes pour assumer la gestion réglementaire conforme des quantités de déchets relatives aux différents lots pour lesquels il est fait offre.

Par ailleurs, s'il était envisagé de procéder en tout ou en partie à l'exportation des déchets, le soumissionnaire produira l'ensemble des pièces et éléments prouvant qu'il est dûment autorisé à procéder à ces exportations de déchets.

Le soumissionnaire devra au minimum disposer:

 d'au moins une référence dans le traitement de déchets verts, réalisée au cours des trois dernières années, pour des tonnages équivalents au lot pour lequel il fait offre;

 des autorisations nécessaires pour traiter les déchets visés et quantités relatives aux différents lots pour lesquels il est fait offre.
