Furnizare echipamente de protectie COVID 19 conform cerintelor din caietul de sarcini.

A. In conformitate cu prevederile art. 160 alin. (1) din Legea nr. 98/2016, termenul-limita pana la care orice operator economic interesat are dreptul de a solicita clarificari sau informatii suplimentare in legatura cu documentatia de atribuire este de maximum 18 zile inainte de data-limita de depunere a ofertelor;

B. In conformitate cu prevederile art. 160 alin. (2) din Legea nr. 98/2016 autoritatea contractanta va raspunde in mod clar si complet tuturor solicitarilor de clarficare/informatiilor suplimentare in a 11-a zi inainte de termenul-limita stabilit pentru depunerea ofertelor.

Orice solicitare de clarificare transmisa dupa data mentionata la punctul A., va pune AC in imposibilitatea de a oferi un raspuns in termenul mentionat la punctul B. si, drept urmare, orice solicitare de clarificare in afara termenelor mentionate se va considera tardiva.

List and brief description of conditions:

Cerinta nr. 1:

Ofertantii, tertii sustinatori si subcontractantii NU trebuie sa se regaseasca in situatiile prevazute la art. 164, 165 și 167 din Legea nr. 98/2016.

Modalitatea de indeplinire: se va completa DUAE de catre ofertanti (inclusiv de catre asociati/subcontractanti/terti sustinatori) participanti la procedura de atribuire cu informatiile aferente situatiei lor.

Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertanti clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor. Aceste documente pot fi:

• certificate constatatoare privind lipsa datoriilor cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) valabile la data prezentarii;

• cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv;

• dupa caz, documente prin care se demonstraza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin (2), art. 171 din Legea 98/2016 privind achizitiile publice;

• alte documente edificatoare, dupa caz.

Cerinta nr. 2

Declaratie privind neincadrarea in prevederile art. 59 si 60 din Legea nr. 98/2016 privind achizitiile publice (evitarea conflictului de interese), cu mentionarea persoanelor care detin functii de decizie in cadrul autoritatii contractante, precum si a celor implicate in elaborarea documentatiei de atribuire si derularea procedurii. Modalitatea de indeplinire: se va completa Formularul nr. 2 de catre toti ofertantii (inclusiv de catre asociati/subcontractanti/terti sustinatori) participanti la procedura de atribuire cu informatiile aferente situatiei lor si se va depune in SEAP odata cu depunerea DUAE, pana la data limita de depunere a ofertelor, semnat cu semnatura electronica extinsa.

Persoanele cu functie de decizie in cadrul Autoritatii Contractante, cele cu putere de reprezentare din partea furnizorului de servicii auxiliare precum si cele implicate in procedură din partea acestuia din urma, in ceea ce priveste organizarea, derularea si finalizarea procedurii de atribuire sunt urmatoarele: dr. Adam Ovidiu - manager, Nicolau Daniela Lenuta - director ingrijiri, dr. Zeno Ghe. Andrei - director medical, ec. Martin Cristian - director financiar contabil, ec. Notă:

1. Nedepunerea DUAE odata cu oferta (inclusiv pentru asociat/tert sustinator) atrage respingerea acesteia ca inacceptabila.

2. Se vor depune, odată cu DUAE, următoarele documente: angajamentul ferm al tertului sustinator din care rezulta modul efectiv in care se va materializa sustinerea acestuia, acordul de subcontractare si/sau acordul de asociere, după caz.

1. Operatorii economici care depun oferta trebuie sa dovedeasca o forma de inregistrare si, dupa caz, de atestare ori apartenenta din punct de vedere profesional, in conformitate cu cerintele legale din tara in care este stabilit operatorul economic din care sa reiasa faptul ca operatorul economic este legal constituit, nu se afla în niciuna dintre situatiile de anulare a constituirii sale precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.

Modalitate prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.

Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertanti clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE sunt:

— Pentru persoane juridice/fizice romane - Certificatul Constatator eliberat de Oficiul Registrului Comertului de pe langa instanta competenta, din care sa rezulte domeniul de activitate principal/secundar, codurile CAEN aferente acestora. Certificatul Constatator trebuie sa contina informatii reale/actuale la data prezentarii acestora. Obiectul contractului trebuie sa aiba corespondent in codul/codurile CAEN din certificatul constatator,

— Pentru persoane juridice/fizice straine - Documente care dovedesc forma de inregistrare/atestare ori apartenenta din punct de vedere profesional, conforme legii tarii de rezidenta a operatorului economic. Toate documentele vor fi insotite de traducerea autorizata in limba romana.

Nota: Cerinta se aplică inclusiv pentru subcontractanti si/sau terti sustinatori care completeaza informatiile aferente situatiei lor la nivelul unui DUAE distinct.

2. Pentru loturile la care se solicita dispozitive medicale - Operatorii economici vor depune Aviz de functionare pentru activitatile de comercializare, distributie dispozitive medicale emis de ANMDM in conformitate cu art. 926 din Legea nr. 95/2006 privind reforma in domeniul sanatatii, inclusiv Anexa din care sa reiasa ca ofertantul este distribuitor al producatorilor echipamentelor ofertate ce fac obiectul procedurii.

Modalitatea de indeplinire: se va mentiona in DUAE numarul si data avizului la rubrica „Finalizare - Partea V: Reducerea numarului de candidati calificati” – se va bifa DA, iar in casuta deschisa se vor completa informatiile de identificare ale avizului.

Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE, respectiv documentele echivalente, emise in tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

Minimum level(s) of standards possibly required:

Se va completa DUAE de către operatorii economici participanți la procedura de atribuire cu informațiile ce descriu nivelul lor de experiență, prin raportare la contractele executate în trecut, corespunzător cerințelor autorității contractante. Asociatul/asociații nominalizați va/vor prezenta distinct DUAE în care se vor cuprinde informațiile solicitate. La nivelul DUAE trebuie precizate informații cum ar fi: numărul și data contractului invocat drept experiență similară, tipul/categoriile de produse, valoarea contractului fara TVA, beneficiarul, data și numărul documentului de recepție. Următoarele documente justificative care probează îndeplinirea cerinței vor fi prezentate doar de către ofertantii clasati pe primele 3 locuri/ lot în clasamentul intermediar întocmit la finalizarea evaluării ofertelor, astfel: procesul-verbal de recepție sau recomandări sau alte documente echivalente din care să reiasă următoarele informații: beneficiarul, obiectul contractului, valoarea contractului, perioada de derulare a contractului și locul livrării. In cazul in care ofertantii beneficiaza de sustinerea unui tert, avand in vedere Notificarea nr. 256/08.12.2016, se va solicita tuturor ofertantilor, ca odata cu depunerea DUAE si a ofertei pana la data limita a depunerii ofertelor, sa prezinte angajamentul tertului sustinator (impreuna cu documente anexe la angajament, transmise acestora de catre tert/tertii sustinatori, din care rezulta modul efectiv in care se va materializa susținerea acestuia/acestora).

Solicitarile de clarificari primite din partea operatorilor economici si toate răspunsurile la solicitările de clarificări cerute de operatorii economici sau formulate de autoritatea contractantă/decizii CNSC/contestaţii/note de informare/măsuri de remediere vor fi postate pe site-ul www.sicap-prod.e-licitatie.ro rubrica Documentaţii/clarificări/decizii, precum şi prin publicare de erate.

Daca doua sau mai multe oferte, clasate pe primele 3 locuri, au o valoare totala egala a propunerii financiare si sunt clasate pe acelasi loc, in vederea departajarii, autoritatea contractantă va solicita clarificari prin intermediul SEAP, in vederea incarcarii electronice de catre operatorii economici de documente care contin noi preturi, fara ca acest lucru sa afecteze pozitiile superioare in clasament. In cazul in care in urma solicitarii de reofertare operatorii economici nu isi modifica preturile (isi mentin preturile ofertate initial), atunci ordinea in clasament se va stabili in ordinea crescatoare a datei si orei la care a fost postata in SEAP oferta initiala.
