The object of the procurement is a sanction list screening service which central government accounting units, agencies and off-budget entities can use to screen their payees and partners as required under Council of the European Union decisions and regulations. The State Treasury's goal is to find a trustworthy supplier who can provide a reliable and high-quality sanction list screening service.

II.2.4)Description of the procurement:

Council decisions and regulations contain provisions on so-called autonomous restrictive measures, or sanctions. Council regulations are directly applicable legal acts in all Member States which are binding on both the authorities and individual operators in these countries. The Member States also have an obligation to take national measures to implement any sanctions laid down exclusively in Council decisions. A regularly updated list of persons, groups and entities on the EU sanction list can be downloaded on the EU’s website (https://data.europa.eu/data/datasets/consolidated-list-of-persons-groups-and-entities-subject-to-eu-financial-sanctions?locale=en).

In addition to measures taken against parties on the sanction list, EU decisions that impose obligations on accounting units include a Council regulation that excludes Russian citizens and parties located in Russia from public procurement (https://eur-lex.europa.eu/legal-content/EN/TXT/PDF/?uri=OJ:L:2022:111:FULL&from=EN).

Using the sanction list screening service, central government accounting units, agencies and off-budget entities can screen their payees and partners as required under Council of the European Union decisions and regulations. The object of the procurement has three parts:

1) Automated payee screening

Includes comparing payments made by the central government to names and companies (including variations of names) contained on the EU sanction list. The data to be checked (list of payees) would be formed daily, and its total volume would be significant. The objective is to automate data exports to the screening service.

The contracting authority reserves the right to make the procurement cited in this section using Hansel Oy’s dynamic purchasing system (IT-consulting 2021-2025 or RPA & AI 2019-2023).

2) Screening of the central government’s partners and partner candidates

Includes comparing the central government's (future) procurement and contracting partners as well as parties cited in grant and funding decisions (partner candidates) to the parties on the EU sanction list. In addition to comparing the person’s or company's name to the EU sanction list (including variations of names), a more detailed screening in compliance with EU-imposed rules is required, for example checking if the persons or companies with a controlling interest in a prospective partner include parties on the EU sanction list, or if the beneficial owners of a prospective partner include such parties.

3) Screening for Russian nationals and companies in public procurement

Includes a screening mechanism allowing the accounting units to comply with the EU regulation of 8 April 2022 to exclude Russian nationals and entities established in Russia from public procurement (https://eur-lex.europa.eu/legal-content/FI/TXT/PDF/?uri=OJ:L:2022:111:FULL&from=EN). Rather than the EU sanction list, these checks focus on the nationality or geographical location of the person or entity. Under this decision, it shall be prohibited to award or continue the execution of a public contract to or with

a) a Russian national, or a natural or legal person, entity or body established in Russia;

b) a legal person, entity or body whose proprietary rights are directly or indirectly owned for more than 50 % by an entity referred to in point (a) of this paragraph; or

c) a natural or legal person, entity or body acting on behalf or at the direction of an entity referred to in point (a) or (b) of this paragraph.

Including, where they account for more than 10 % of the contract value, subcontractors, suppliers or entities whose capacities are being relied on within the meaning of Directives applicable to public procurement.

This notice is an information request. Its purpose is not to request tenders, nor does it oblige the contracting authority to carry through the actual procurement. The information request comes with an invitation to participate in market dialogue, in which operators interested in the procurement can engage in a dialogue concerning the procurement with the contracting authority. The purpose of the market dialogue is to obtain information about solutions available on the market. The market dialogue will not oblige suppliers interested in the procurement to participate in any tender competition to be organised later.

By this information request, we would like to invite operators to engage in market and technical dialogue.

Market dialogues in which registered operators will present their services/solutions for screening related to the sanction list will take place in July and August 2022 (in weeks 30 to 35). Technical dialogues, in which registered operators may comment on the invitation to tender documents, will be organised by e-mail after the meetings in autumn 2022. The contracting authority will send the content and programme of these events to the registered companies.

Operators interested in having a market dialogue meeting are requested to register their interest in participating in the market dialogue no later than 31 July 2022 by sending the name and contact details of their contact person to maksuliike@valtiokonttori.fi with the heading: “Sanction list screening service, dialogues.” Operators interested in this procurement are also requested to indicate which part (1.-3.) their presentation concerns. Operators interested only in technical dialogue may register their interest in procurement at a later stage as well by sending the name and contact details of their contact person to maksuliike@valtiokonttori.fi with the heading: “Sanction list screening service, dialogues.”

The contracting authority will answer enquiries about the prior information notice and send out the invitations to market dialogues no earlier than week 27.

The description given in the prior information notice is intended as preliminary and indicative advance information.
