II.1.5)Short description of the contract or purchase(s)
This Framework (‘the Contract’) is for Supply and Delivery of Kerbs and Flags.
The primary objective is to establish a Framework for the Supply and Bulk Delivery of Kerbs and Flags on behalf of NEPO Local Authorities and other NEPO Associate Members for the supply and bulk delivery of kerb and flags. Durham County Council as the Lead Spoke Authority is conducting this procurement on behalf of all NEPO Contracting Authorities who are able to utilise this Framework on an as and when required basis.
The NEPO Contracting Authorities participating in this tender and who have given a firm commitment are:
— Durham County Council;
— Gateshead Council;
— Middlesbrough Council;
— Newcastle City Council;
— North Tyneside Council;
— Redcar and Cleveland Council;
— Stockton Borough Council;
— Sunderland City Council.
The framework may also be accessed by:
Durham Schools and Academies with an SLA with Corporate Procurement and other External Bodies such as Durham Constabulary, Durham Fire and Rescue. Access to the Framework will be subject to the approval of NEPO. This may incur a fee.
The agreement will be available for use by all NEPO Members. A list of member organisations is available at:

This agreement will also be made available to all current and future NEPO Associate Members. A list of current NEPO Associate Members is available at:

Organisations wishing to access NEPO agreement will be required to register as a NEPO Associate Member in the first instance.
NEPO intends to make this Framework Agreement available for use by all UK Contracting Authorities including but not limited to Government Departments and their Agencies, Non-Departmental Public Bodies, NHS Bodies, Local Authorities, Emergency Services, Educational Establishments, Registered Charities who have a need to purchase the above supplies.

The Contracting authority reseve the right to carry out mini-competions for special schemes or items which are not included on the Kerbs and Flags Pricing Schedules.

The Lead Spoke Authority reserve the right to require groupings of service providers to take a particular legal form or to require a single provider to take primary liability or to require each party to undertake joint and several liability. Precise information on deadline(s) for lodging appeals: The Lead Spoke Authority, Durham County Council will incorporate a standstill period at the point information of the award of the Contract is communicated to bidders. That notification will provide full information on the award decision. The standstill period which will be for a minimum of 10 calendar days, provides time for the unsuccessful bidders to EN Standard form 02 — Contract notice 12 / 16 challenge the award decision before the contract is entered into. The Public Regulations 2015 provide the aggrieved parties who have been harmed or at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland).
