2.1. in the case of which a liquidation has been opened, the arrangement approved by the court in the course of the restructuring procedure shall provide for the creditors to be compensated by the liquidation of its assets or the court has ordered the liquidation of its assets in accordance with Article 332 (1). 1 of the Law of 15 May 2015. 2. Assessment of the fulfilment of the conditions of participation in the procedure and the absence of grounds for exclusion

On the basis of statements and documents submitted by Contractors.

Economic operators may jointly apply for the award of a contract (e.g. civil companies, consortia).

In such a case, they shall establish the Agent (Leader) to represent them in the procedure for the award of a contract or representation in the proceedings and the conclusion of a public contract. A mandate in electronic form bearing a qualified electronic signature must be submitted together with the offer.

The provisions relating to the Contractor shall apply mutatis mutandis to the joint contractors.

If the Contractor’s tender is selected, the contracting authority will request a contract for the cooperation of the Contractors, before the conclusion of the contract.

For the award of the contract.

List of declarations or documents to be provided by the Contractor

A. Documents and declarations to be submitted with the tender:

1. In order to pre-certify that the economic operator is not subject to exclusion and fulfils the conditions for participation in the procedure, the Contractor shall submit:

(a) the statement in the form of a single European Procurement Document (ESPD) on the day on which the tenders are submitted. The example of the single model is Annex 4 to the SIWZ.

A1) In the case of joint procurement by the contractors, a single document shall be submitted by each joint Contractor. These statements are intended to confirm that the conditions for participation in the proceedings have been fulfilled and that there are no grounds for exclusion in so far as each of the contractors satisfies the conditions for participation in the proceedings and the absence of grounds for exclusion.

(A2) Where the Contractor will rely on the resources of other entities to confirm compliance with the conditions of participation in the proceedings, it shall submit a third party to the tender. Should be filled in to the extent that the Contractor is relying on their resources. One must indicate that there are no grounds for exclusion (as in the case of the Contractor) and that they meet, in so far as they rely on their resources, the conditions for participation in the proceedings. This applies both to situations in which a third party is not a subcontractor during the performance of the contract as well as when such a subcontractor is in a position to do so;

(A3) The contractor who intends to subcontract part of the contract shall indicate the lots the performance of which it intends to subcontract and shall specify the subcontractors of those subcontractors in ONE; it is not required to demonstrate the absence of grounds for exclusion in relation to the subcontractors or to indicate them in the single declaration.

B. Documents and declarations made at the invitation of the Contracting Authority:

Prior to the award of the contract, the contracting authority shall require the tenderer, whose tender has been awarded up to a maximum of 10 days, to submit the following statements or documents at the date of the submission:

1. In order to confirm that there are no grounds for exclusion from participation in the proceedings:

(1) information from the National Criminal Register within the scope of Article 24 (3). 1 points 13, 14 and 21 of the Public Procurement Act, which have been issued no earlier than 6 months before the closing date for the submission of tenders,

(2) a certificate from the competent head of the tax office that the Contractor is not in arrears with the payment of taxes, issued not earlier than 3 months before the closing date for the submission of tenders, or any other document proving that the Contractor has concluded an agreement with the competent tax authority on the repayment of those taxes, together with interest or fines, if any, and, in particular, has obtained the authorised exemption, deferral or payment of any outstanding payments or suspension of the execution of the decision of the competent authority in full, in order to confirm the absence of grounds for exclusion on the basis of Article 24 (1). 5 point 8 of the Public Procurement Act;

(3) a certificate issued to the relevant department of the Social Insurance Institution or of the Kasa Rolniczego Ubezpieczenia Społecznego or of Kasa Rolniczego Ubezpieczenia Społecznego (Agricultural Social Insurance Fund) or other document proving that the Contractor has not been in arrears with the payment of social security or health insurance contributions, issued not earlier than 3 months before the closing date for submission of tenders, or any other document confirming that the Contractor has concluded an agreement with the competent authority in respect of the repayment of those debts, together with interest or fines, if any, and, in particular, has obtained the authorised exemption, deferral or payment of any outstanding payments or suspension of the execution of the decision of the competent authority in full, in order to confirm the absence of grounds for exclusion pursuant to Article 24 (1). 5 point 8 of the Public Procurement Act;

(4) a copy from the relevant register or from a central register and information on the economic activity, where separate provisions require entry in a register or records, in order to confirm the absence of grounds for exclusion on the basis of Article 24 (1). 5 points 1 of the Public Procurement Act;

(5) a statement by the Contractor that it is not subject to a final judgment of a court or of a final administrative decision on the non-payment of taxes, levies or contributions on social or health insurance, or, in the event of such a judgment or decision, of the documents proving the payment of those duties, including any interest or fines, or the conclusion of a binding agreement on the reimbursement of those duties, in accordance with Annex 6 to the SIWZ;

(6) a statement by the Contractor that no decision has been taken against him as a precautionary measure, in accordance with Annex 6 to the SIWZ;

7) a statement by the Contractor that local taxes and charges referred to in the Local Taxes and Charges Act 12.01.1991 have not been paid out (Dz. (Polish Journal of Laws of 2019, item 1170 as amended), in accordance with Annex 6 to the SIWZ.

(8) The documents referred to in Chapter VI, Part B, 1, each of the Contractors who are jointly and severally liable for the award of the contract shall be made up of each of the Contractors.

(9) Civil companies — a certificate from the Tax Office, the Social Insurance Institution and/or the KRUS consist both of the company and of each partner.

(10) The contracting authority shall ask the Contractor, who shall consist of the capacities or situations of other bodies, in accordance with the rules laid down in Article 22a of the Public Procurement Act, to submit to those bodies the documents referred to in Chapter VI (B) (B). 1, to confirm that the exclusion referred to in Article 24 (1) does not apply to them. 1 paragraphs 12 to 23 and paragraph. 5 points 1, 3 and 8 of the Public Procurement Act.

2. In order to confirm that the supplies offered meet the contracting authority’s requirements:

(a) Declaration by the Contractor that the subject of the contract is covered by the marketing documents for the territory of the Republic of Poland in accordance with the Act of 20 May 2010 on medical devices (Journal of Laws 2020, item 186) with the undertaking that these documents will be made available to the Contracting Authority whenever it is called upon to do so;

catalogue cards, leaflets, drawings, leaflets, instructions for use, specification cards or other documents proving the fulfilment of the requirements laid down in the statement of technical parameters (Annex 1 to the SIWZ), issued by the manufacturer of the equipment or its authorised representative.

NOTE: in the documents/documents, the parameters supporting the fulfilment of the contracting authority’s requirements must be marked.

III.1.3)Technical and professional ability

C. Documents to be made by foreign contractors

1. Where the Contractor is established outside the territory of the Republic of Poland:

(1) In place of the documents referred to in Chapter VI (B) (1) (1), the relevant register or, in the absence of such a register, an equivalent document issued by a competent judicial or administrative authority in the country where the Contractor is established shall have any other equivalent documents or documents, within the limits laid down in Article 24 (1). 1 points 13, 14 and 21 of the Public Procurement Act. Documents must be issued no earlier than 6 months before the closing date for submission of tenders.

(2) instead of the documents referred to in Chapter VI (B) (1) (2) to (4), deposit a document or documents issued in the country in which the Contractor is established certifying respectively that:

(a) has not been in arrears with the payment of taxes, levies, social security or health insurance contributions or concluded an agreement with the competent authority on the repayment of those duties together with any interest or fines, in particular the granting of the authorised exemption, deferral or payment of any outstanding payments or suspension of the execution of the decision by the competent authority, which was issued no earlier than 3 months before the closing date for the submission of tenders,

(b) it has not been wound up or declared bankrupt, which was issued no earlier than 6 months before the closing date for the submission of tenders.

2. If, in the country in which the Contractor is established, the person concerned does not issue the documents referred to in the paragraph. 1 above shall be replaced by the document containing the Contractor’s statement respectively, indicating the person (s) entitled to represent him or her or the declaration by the person to whom the document was to be filed, made before a notary or before a judicial, administrative or self-regulatory body, of the place of residence of the Contractor or his place of residence.

3. If the Contractor is established within the territory of the Republic of Poland and the person concerned by the document referred to in Chapter VI (B) (1) (1) resides outside Poland, submits the document referred to in Chapter VI (C) (1) (1) to the extent specified in Article 24 (1). 1 points 13, 14 and 21 of the Public Procurement Act. If no such documents are issued in the country of residence of the person concerned by the document, he shall be replaced by a document containing a statement made by that person before a notary or before a judicial, administrative or self-regulatory body having regard to the place of residence of that person.

4. In the event of any doubt as to the content of a document submitted by the Contractor, the Contracting Authority may ask the competent authorities of the country in which the Contractor is established or resident, as the case may be, to provide the necessary information concerning that document.

D. Declaration made after the opening of tenders

1. The Contractor must provide the Contracting Authority with the information referred to in Article 86 (1) within 3 days from the date on which the information referred to in (1) is published on the website (purchasing agency platform). 5 of the Public Procurement Act, a declaration of membership or absence of membership of the same group with the contractors who submitted tenders in the present proceedings, in order to confirm that the Contractor has no grounds for excluding the Contractor from participating in the procedure under Article 24 (1). 1 points 23 PPL — according to the formula in Annex 5 to the SIWZ.

2. With the submission of the declaration, the Contractor may submit documents or information demonstrating that the links with the other contractor do not lead to a distortion of competition in the procurement procedure.

4. Offers without proof of a tendering security (in the case of deposits in other forms than in money) shall not be considered. The payment of a deposit in money will be effective if, within the prescribed period, it is in the bank account of the Contracting Authority and complies with all the requirements laid down in the Public Procurement Act.

5. NOTE: if a security in the form of a guarantee/surety is lodged, the Contractor must submit (attach to the tender) an original document with a qualified electronic signature of the persons authorised to issue it, the Contractor shall submit the original document with the tender, attached to the platform on the platform “OFERTY”, by selecting the instructions “to add”.
