Notice of a call for expressions of interest

 1.Contracting authority:

 2.Application procedure:

The aim of this call for expressions of interest is to compile a shortlist of candidates.
The services include the free collection and recovery of furniture, office and computer equipment, equipment or supplies for kitchens, supplies for displays and decoration, unused consumables, etc. that the EUIPO (hereinafter 'the Office') no longer uses as they are old or obsolete and, where applicable, have been taken out of service.
Expressions of interest must be written in 1 of the official languages of the European Union and sent by post to the address given in point 1.
Placing candidates on the shortlist does not bind the EUIPO to award them the collection of office furniture and equipment referred to in point 8 of this notice.
 3.Required information and documents:

Interested parties must provide their full contact information and a list of the furniture and equipment stated in point 8 for which they express their interest.
The documentary evidence to be provided in order to assess the selection criteria can be found in point 12.
Candidates must submit a solemn declaration, duly signed and dated by an authorised representative, stating that they are not in any of the exclusion situations listed in point 11 (see the response form 'Solemn declaration'). If the candidate is a group of economic operators, the declaration must be signed by all members of the group.
In the event of any uncertainty, candidates may be requested to submit documents proving that they meet the non-exclusion criteria.
Expressing interest will involve the candidate accepting the requirements and terms laid down in this notice and the EUIPO's integrated management system policy (appended to the notice).
 4.General description of the procedure:

Interested parties are invited to submit expressions of interest in accordance with the rules laid down in this notice.
The contracting authority will compile a shortlist of candidates who meet the criteria listed in point 12. This list will include sub-lists corresponding to each of the fields described in point 8.
If the Office has obsolete and declassified furniture and equipment described in point 8, it will invite candidates on the shortlist (and the relevant sub-lists) to submit a tender.
The submitted tenders will be assessed on the basis of the award criteria notified by the contracting authority. Shortlisted candidates that may benefit from the obsolete and declassified furniture and equipment will then be chosen.
 5.Protection of personal data:

Personal data obtained for the purposes of this procedure will be processed in accordance with Regulation (EC) 45/2001 of the European Parliament and of the Council of 18.12.2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data.
This data will be processed solely for assessing tenders on the basis of the invitation to tender's specifications. The tenderer may, upon request, obtain his personal data and rectify any inaccurate or incomplete data. To do so, he must send a request to the person responsible for data protection at the EUIPO. The tenderer also has the right to have recourse at any time to the European Data Protection Supervisor, in accordance with Regulation (EC) No 45/2001 of the European Parliament and of the Council.
 6.Use of the list compiled as a result of this notice:

The list compiled as a result of this notice will be used exclusively for the services under category 27 (see Annex II to Directive 2004/18/EC of the European Parliament and of the Council).

 8.Full description of the fields covered by the call for expressions of interest:

This call for expressions of interest covers 2 fields:
1. Various items of equipment and furniture:
(a) desks;
(b) ergonomic chairs;
(c) cupboards;
(d) desk lamps;
(e) small drawer units;
(f) audiovisual equipment;
(g) kitchen equipment;
(h) visitors' chairs;
(i) shelving;
(j) gym equipment and furniture.
2. Computer equipment:
(a) CPUs for desktop computers;
(b) monitors;
(c) keyboards (Azerty, Qwerty, Qwertz, etc.);
(d) laptops;
(e) (small) servers;
(f) memory upgrades;
(g) printers;
(h) mobile phones, smartphones.

 10.Validity period of the list compiled as a result of this call for expressions of interest:

The list compiled as a result of this notice will be valid for 4 years as from the date of publication of this notice in the Official Journal of the European Union. Interested parties may submit an application at any time prior to the last 3 months of the list's validity.
 11.Grounds for exclusion:

11.1. Exclusion situations relating to the candidate:
The exclusion situations are as follows:
(a) the candidate is bankrupt, subject to insolvency or winding-up procedures, where its assets are being administered by a liquidator or by a court, where it is in an arrangement with creditors, where its business activities are suspended, or where it is in any analogous situation arising from a similar procedure provided for under national laws or regulations;
(b) it has been established by a final judgment or a final administrative decision that the candidate is in breach of its obligations relating to the payment of taxes or social security contributions in accordance with the law of the country in which it is established, with those of the country in which the contracting authority is located or those of the country of the performance of the contract;
(c) it has been established by a final judgment or a final administrative decision that the candidate is guilty of grave professional misconduct by having violated applicable laws or regulations or ethical standards of the profession to which the candidate belongs, or by having engaged in any wrongful conduct which has an impact on its professional credibility where such conduct denotes wrongful intent or gross negligence, including, in particular, any of the following:
(i) fraudulently or negligently misrepresenting information required for the verification of the absence of grounds for exclusion or the fulfilment of selection criteria or in the performance of a contract,
(ii) entering into agreement with other economic operators with the aim of distorting competition,
(iii) violating intellectual property rights;
(iv) attempting to influence the decision-making process of the contracting authority during the procurement procedure;
(v) attempting to obtain confidential information that may confer upon it undue advantages in the procurement procedure;
(d) it has been established by a final judgment that the candidate is guilty of any of the following:
(i) fraud, within the meaning of Article 1 of the Convention on the protection of the European Communities' financial interests, drawn up by the Council Act of 26.7.1995,
(ii) corruption, as defined in Article 3 of the Convention on the fight against corruption involving officials of the European Communities or officials of Member States of the European Union, drawn up by the Council Act of 26.5.1997, and in Article 2(1) of Council Framework Decision 2003/568/JHA, as well as corruption as defined in the law of the country where the contracting authority is located, the country in which the candidate is established or the country of the performance of the contract,
(iii) participation in a criminal organisation, as defined in Article 2 of Council Framework Decision 2008/841/JHA,
(iv) money laundering or terrorist financing, as defined in Article 1 of Directive 2005/60/EC of the European Parliament and of the Council,
(v) terrorist-related offences or offences linked to terrorist activities, as defined in Articles 1 and 3 of Council Framework Decision 2002/475/JHA, respectively, or inciting, aiding, abetting or attempting to commit such offences, as referred to in Article 4 of that Decision,
(vi) child labour or other forms of trafficking in human beings as defined in Article 2 of Directive 2011/36/EU of the European Parliament and of the Council;
(e) the candidate has shown significant deficiencies in complying with main obligations in the performance of a contract financed by the budget, which has led to its early termination or to the application of liquidated damages or other contractual penalties, or which has been discovered following checks, audits or investigations by an authorising officer, OLAF or the Court of Auditors;
(f) it has been established by a final judgment or final administrative decision that the candidate has committed an irregularity within the meaning of Article 1(2) of Council Regulation (EC, Euratom) No 2988/95;
(g) the candidate finds himself in a situation involving grave professional misconduct, fraud, corruption, other offences, significant deficiencies affecting contract performance or irregularities, resulting from:
(i) facts established in the context of audits or investigations carried out by the Court of Auditors, OLAF or internal audit, or any other check, audit or control performed under the responsibility of the authorising officer of an institution of the European Union, a European office or an agency or body of the European Union,
(ii) non-final administrative decisions which may include disciplinary measures taken by the competent supervisory body responsible for the verification of the application of standards of professional ethics,
(iii) decisions of the ECB, the EIB, the European Investment Fund or international organisations,
(iv) decisions of the Commission relating to the infringement of the Union's competition rules or of a national competent authority relating to the infringement of Union or national competition law.
11.2. Exclusion situations corresponding to natural persons who have powers of representation, decision or control with regard to the economic operator:
the candidate shall be in an exclusion situation when a person who is a member of his administrative, management or supervisory body, or has powers of representation, decision or control with regard to said candidate (including, in particular, members of the board of directors, members of management or supervisory bodies, and in cases where a natural person holds the majority of shares) is in 1 of the following situations:
— situation (c) stated above (grave professional misconduct),
— situation (d) stated above (fraud, corruption or other offences),
— situation (e) stated above (significant deficiencies in complying with a contract),
— situation (f) stated above (irregularity).
11.3 Exclusion situations corresponding to natural persons or legal entities assuming unlimited liability for the debts of the economic operator:
the candidate is in an exclusion situation when a natural person or legal entity assuming unlimited liability for the debts of said candidate is in 1 or more of the following situations:
— situation (a) stated above (in an arrangement with creditors and similar situations),
— situation (b) stated above (non-compliance with the obligations related to the payment of taxes or social security contributions).
 12.Selection criteria:

(a) Criteria relating to economic and financial capacity:
to be selected, candidates must prove that they have, on the one hand, sufficient economic and financial capacity and, on the other hand, sufficient technical and professional capacity to perform the contract.
Tenderers must provide the following documents:
— proof of professional risk insurance cover.
(b) Criteria relating to technical and professional capacity:
candidates must prove that they have sufficient technical and professional capacity. To do so, they must provide documents meeting the following criteria:
— company presentation (history, activities, etc.). Also required are the articles of association of the NGO, NPO or equivalent entity,
— where available, a list of similar projects involving the collection of office equipment and furniture carried out in the past 3 years, with details of the values, dates and locations. The tenderer must enclose a brief description of the projects for which said material was destined,
— declaration certifying that the candidate will not illegally use or dispose of the goods.
(c) Criteria relating to legal and regulatory capacity:
— recent proof of enrolment on a professional register, e.g. trade register or register of associations, or proof of enrolment on the Register of non-governmental development organisations (Registro de Organizaciones no Gubernamentales de Desarrollo) of the Spanish Agency for International Development Cooperation (Agencia Española de Cooperación Internacional para el Desarrollo) or a similar national register,
— if the tender relies on the capacities of other entities, a written agreement from such entities confirming that they will provide the tenderer with the resources necessary for contract performance.
 13.Additional information:

The goods will be given to charity, free of charge. Costs for collection, recovery and transport, as well as any corresponding duties or taxes for transferring the goods, will be borne by the contractor.
Details of the award procedure, as well as the technical specifications for each collection, will be stated in the consultation document which will be sent to the shortlisted candidates for the list or sub-list corresponding to the goods to be collected.
Expressions of interest must state the reference number for this notice (point 9) and include the information and documents requested in points 11 and 12. Candidates are requested to download the standard response form from the EUIPO's website: https://euipo.europa.eu/ohimportal/en/public-procurement and fill in the relevant forms.
Expressions of interest must be sent by registered mail, via courier service or delivered by hand to the address in point 1, and be addressed to the stated contact person.
Tenders must be delivered by hand to the Office during its opening hours: 9:30–13:00 and 15:00–17:00.
Expressions of interest must be sent in duplicate. A digital version of the documents (on CD-ROM) is desirable.
Interested candidates should therefore send their application as soon as possible following publication of this call for expressions of interest.
Questions relating to this call for expressions of interest must be sent solely in writing to the e-mail address in point 1. They may be sent at any time during the validity period of this notice (point 10), except for the 3 months prior to the end of said period.
Answers to questions and any amendments to this call for expressions of interest must be made electronically on the EUIPO's website: (https://euipo.europa.eu/ohimportal/en/public-procurement).
Please note that it is the responsibility of the shortlisted candidates to immediately notify the EUIPO of any change in their administrative, technical or financial data which would result in a change to the original application.
