Supervision services according to FIDIC Contract Conditions (Engineer) and relevant national legislation for phase reconstruction and extension of existing facilities and construction of new port capacities of the Port of Prahovo. Works to be supervised include construction of vertical quay and vertical bank protection at terminal, gabion bank protection, road works, construction of railways in terminal, installation of utility networks at terminal, construction of buildings and other civil engineering/architectural buildings, etc. Existing port facilities shall be operational during the Works. Contract will be managed according to FIDIC Conditions of Contract for Construction for building and engineering works designed by Employer (RED BOOK, 1st Ed. 1999).

Financing – Requested EIB support (subject to confirmation) through Finance Contract for Serbian Inland waterway infrastructure between Republic of Serbia and EIB (Official Gazette of RS, No. 2/19), and budget of Republic of Serbia.

Port of Prahovo covers part of riparian and water area on the right Danube riverbank, from km 859+800 to km 858+800, 11 km downstream from Negotin.

II.2.4)Description of the procurement:

Guide to Procurement (GtP) for projects financed by the EIB from September 2018 ( ) is applied to this tender, while tender document templates are from the PRAG (Practical Guide for Procurement and Grants for European Union external actions – August 2020).

Participation is open to all-natural persons and firms (participating either individually or in a grouping - consortium - of tenderers) originating from all countries of the world.

All eligible natural and legal persons or groupings of such persons (consortia) may apply.

A consortium may be a permanent, legally-established grouping or a grouping which has been constituted informally for a specific tender procedure. All partners of a consortium (i.e., the leader and all other partners) are jointly and severally liable to the Contracting Authority (CA).

The participation of an ineligible natural/legal person will result in the automatic exclusion of that person. If that ineligible person belongs to a consortium, the whole consortium will be excluded.

Only one application or tender can be submitted by a person whatever the form of participation (as an individual legal entity or as leader or partner of a consortium submitting an application/tender). If a natural or legal person submits more than one application or tender, all applications or tenders in which that person has participated will be excluded.

Grounds for exclusion

As part of the application form, candidates must submit a signed declaration, included in the standard application form, to the effect that they are not in any of the exclusion situations listed in Section of the PRAG (August 2020), as well as in the GtP (September 2018) for projects financed by the EIB (, Section 1.4 (Ethical Conduct), Section 1.5 (Conflict of Interest), Section 1.7 (mandatory compliance with EIB's environmental and social safeguards) and Section 3.6 (Prohibited Conduct – Covenant of Integrity (CoI)– template available in EIB GtP, Annex 3), Anti-fraud policy of the EIB ( and Section 3.8 Environmental and Social Covenant (template is available in EIB GtP, Annex 7). It should be noted that, in the CoI, the tenderer is requested to self-declare all sanctions and/or exclusions (including any similar decisions having the effect of imposing conditions on the tenderer or its subsidiaries or to exclude the said tenderer or its subsidiaries, such as temporary suspension, conditional non-exclusion, etc.) imposed by the European institutions or any multilateral development banks (including the World Bank Group, the African Development Bank, the Asian Development Bank, EBRD, EIB or Inter-American Development Bank), regardless of the date of issue and the expiration or not of such decisions and of the current status of any sanction and/or exclusion. In this regard, any omission or misrepresentation, made knowingly or recklessly, may be considered as fraud under the EIB Anti-Fraud Policy. Therefore, the Client reserves the right to reject any offer presenting an inaccurate or incomplete CoI, and may cause the rejection of the offer for prohibited conduct.

Pursuant to its Sanctions Policy, the Bank shall not provide finance, directly or indirectly, to or for the benefit of an individual or entity that is subject to financial sanctions imposed by the EU, either autonomously or pursuant to the financial sanctions decided by the United Nations Security Council on the basis of article 41 of the UN Charter.

Objective criteria for choosing the limited number of candidates:

If more than 8 eligible candidates meet the above selection criteria, their relative strengths and weaknesses must be re-examined in order to rank their applications and identify the 8 best candidates. The additional comparative criteria that will be taken into consideration during this re-examination are, in order of precedence 1 above 2, as below:

1) the highest number of relevant contracts in compliance with the above technical ability.

2) The total cumulative value of relevant contracts in compliance with the above technical ability.

Previous experience which caused a breach of contract and termination by a Contracting Authority shall not be used as a reference.

III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

The following selection criteria will be applied to candidates. In the case of applications submitted by a consortium, these selection criteria will be applied to the consortium as a whole if not specified otherwise. The selection criteria will not be applied to natural persons and single-member companies when they are sub-contractors. No local preference provisions or local content provisions (such as national licenses, mandatory local sub-contracting, mandatory association with local companies, mandatory local workforce, etc.) are required in this Contract.

III.1.2)Economic and financial standing
List and brief description of selection criteria:

The reference period which will be taken into account will be the last three years for which accounts have been closed.

• The average annual turnover of the candidate over the last three financial years must be at least 2.0 million EUR;

• The average current ratio (current assets/current liabilities) over the last three years must be greater than 1 (>1).

III.1.3)Technical and professional ability
List and brief description of selection criteria:

The reference period which will be taken into account will be the last ten years preceding the submission deadline.

Technical ability

The candidate has provided services, during the reference period, of at least two supervision contracts of the construction and/or reconstruction and/or extension of inland waterway ports and/or sea ports including the relevant port infrastructure comparable to the scope of the subject contract (at least but not limited to quays, internal roads and utilities), both executed under FIDIC conditions or similar contract conditions such as those used by the World Bank/European Bank for Reconstruction and Development/Council of Europe Development Bank / European Investment Bank and other international financial institutions–reference supervision contracts.

At least one reference supervision contract shall be for supervision of the construction and/or reconstruction and/or extension of the inland waterway ports.

The minimum value of services provided by the candidate in each reference supervision contract shall be at least 0.4 million EUR.

At least one reference supervision contract shall have value of services provided during the reference period of not less than 1.1 million EUR.

This means that the service contract the candidate refers to could have been implemented at any moment during the reference period, meaning that the project referred to could have been started/completed at any time during the indicated period but it does not have to be started and completed during that period, nor implemented during the entire period. Tenderers are allowed to refer either to projects completed within the reference period (although started earlier) or to projects not yet completed. Completed projects will be considered in their whole if documentary evidence is provided (statement/certificate from the CA/Beneficiary, proof of final payment). For still on-going projects, only the part completed during the reference period, although started earlier, shall be considered and will have to be supported by documentary evidence (similarly to projects completed), detailing its value. If a project was implemented in a consortium, the percentage that the tenderer has completed must be stated in the evidence, together with a description of the services provided if the selection criteria relating to the pertinence of the experience have been used. Documentary evidence for all reference projects must be submitted together with the Application Form.

Previous experience which caused breach of contract and termination by a CA shall not be used as reference.

Capacity-providing entities

An economic operator may rely on the capacities of other entities, regardless of legal nature of the links which it has with them. In that case it must prove to the CA that it will have at its disposal the resources necessary for performance of the contract through a commitment by those entities placing those resources at its disposal. Such entities, must comply with the same rules of eligibility as the economic operator relying on them and with the selection criteria for which the economic operator relies on them. The data for this third entity for the relevant selection criterion should be included in a separate document and documentary evidence provided together with the Application Form.

For the technical and professional criteria, an economic operator may only rely on the capacities of other entities where the latter will perform the tasks for which these capacities are required.

For the economic and financial criteria, the entities upon whose capacity the economic operator relies, become jointly and severally liable for the contract performance.

Professional Ability

At least ten permanent staff currently working in the field of construction/engineering. Permanent staff is considered as staff whose employment is not based on any kind of fixed term contracts having a preset end by reference to a specific date or on completion of a given task

Submission of applications

Applications must be submitted using the standard application form (the format and instructions of which must be strictly observed) available from the following Internet address: and must be accompanied by a declaration on honour on exclusion and selection criteria using the template available at the same Internet address. Any documentation (letter, etc.) sent with an application in addition to what has been requested shall not be considered.

Applications must be submitted in English exclusively to the CA in a sealed envelope to the address mentioned in Section I:

• Either by post or courier service, in which case the evidence shall be constituted by the postmark or the date of the deposit slip,

• OR hand delivered by the participant in person or agent directly to the premises of the CA in return for a signed and dated receipt, in which case the evidence shall be constituted by this receipt.
