This invitation to tender mainly involves services related to project management, health and safety coordination, quality control, including the Technical Control Body (OCT), for Project AA3 at the OHIM. This project provides for, inter alia, the construction of a new building for the OHIM; it will be located on plot UT-2 of the Agua Amarga development site and will be adjacent to the current OHIM headquarters located at Avenida de Europa, 4, Alicante, Spain.
These specifications for the invitation to tender refer to the award of a contract (per lot) to provide the following services related to the implementation of Project AA3 (design and implementation of a new phase called 'Agua Amarga 3' (AA3) on the OHIM site at Avenida de Europa, 4, Alicante):
— lot 1: project management and health and safety coordination for Project AA3,
— lot 2: quality control and OCT for Project AA3.

Information and formalities necessary for evaluating if the requirements are met: (a) they are not bankrupt or being wound up, are not having their affairs administered by the courts, have not entered into an arrangement with creditors, have not suspended business activities, are not the subject of proceedings concerning those matters, nor are in any analogous situation arising from a similar procedure provided for in national laws or regulations;
(b) they or persons having powers of representation, decision making or control over them have not been convicted of an offence concerning their professional conduct by a judgment of a competent authority of a Member State which has the force of 'res judicata';
(c) they have not been guilty of grave professional misconduct proven by any means which the contracting authority can justify including by decisions of the EIB and international organisations;
(d) they are in compliance with their obligations relating to the payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of the contracting authority or those of the country where the contract is to be performed;

III.2.2)Economic and financial ability
Information and formalities necessary for evaluating if the requirements are met: — bank references concerning the company's solvency,
— certified financial statements and external audit reports for the past 3 financial years for which accounts have been closed, or other equivalent documentation (e.g. where company law in the tenderer's country of residence does not require publication of balance sheets),
— statement as to overall turnover for the past 3 financial years,
— should tenderers rely on the capacities of other entities, a written commitment from such entities confirming that they will provide tenderers with the resources needed to carry out the contract. A statement must be enclosed for a parent company, a grouping of companies (e.g. consortium) or a grouping of companies which shall constitute a temporary association of companies.
Minimum level(s) of standards possibly required: the following minimum annual turnover is required for the past 3 financial years for which accounts have been closed:
— for lot 1: 1 400 000 EUR,
— for lot 2: 400 000 EUR.
III.2.3)Technical capacity
Information and formalities necessary for evaluating if the requirements are met:
— presentation of the company (history, activities, etc.),
— for each lot in which a tenderer will participate, information must be provided for at least 3 contracts entered into by his company during the past 3 years, which correspond to services similar in complexity and size to those described in the technical specifications.

To be considered as being 'similar in complexity and size', the contracts must refer to services concerning project management, health and safety coordination or quality control, that are related to the construction of an office building of at least 5 000 m2 (gross constructed surface area). These contracts will be considered as having been entered into during the past 3 years if the document stating acceptance by the OHIM for the services provided under said contracts was signed after 1.1.2012.

The tenderer must submit the following information in support of each reference provided:
• description of the services provided;
• project description;
• certificate of satisfactory performance, stating that the services were fully completed in a professional manner. This certificate must be signed by a representative authorised by the body or entity that requested the services. It must include the description of the services performed, their location, and the dates and value of the contract,
— statement as to the average annual manpower of the company and the number of management staff of the service provider in the past 3 years,
— for lot 2 only: quality control laboratories used for the inspections required in the technical specifications must be clearly stated, and proof of their capacities must be provided as follows:
• private laboratories shall provide proof of their capacities by means of a certificate issued in accordance with Royal Decree 2200/1995 of 28 December or Royal Decree 410/2010 of 31 March, for the respective tests,
• alternatively, laboratories accountable to a local government entity may be used; they must have sufficient capacities and be proficient in the field of construction or public works,
— recent proof of entry on the trade register,
— declaration certifying that, should the tenderer be awarded the contract and services be provided on Spanish territory, he undertakes to comply with provisions under Spanish law as regards health and safety in the workplace.

For tenderers wishing the submit a tender for lot 1 'Project management and health and safety coordination for Project AA3', a site visit/briefing is planned for 2.11.2015 (11:30), at the following address: Avenida de Europa, 4, 03008 Alicante (Alicante), SPAIN.
The OHIM does not deem a site visit necessary in order to submit a tender for lot 2: 'Quality control and OCT for Project AA3'.

Each tenderer may send a maximum of 2 representatives. Visitors' names and ID document numbers must be sent by fax (+34 965138500) or e-mail (procurement@oami.europa.eu) to the OHIM before 29.10.2015.

No questions will be answered at this briefing.
A record will be made of the activities conducted during the visit so as to subsequently draw up the minutes which will be sent to all tenderers.
