Housing Infrastructure Fund (HIF) Banwell Bypass and Highway Improvements
The Council is seeking a suitable contractor for the design and construction of the key enabling infrastructure, namely:
• Banwell bypass including flood mitigation works;
• local transport improvements including supporting active and sustainable travel and public realm/traffic management within Banwell village;
• improvements to Junction 21 of the M5.
• strategic capacity improvements to the utility network.
The project is to be carried out in two stages, using a bespoke early contractor involvement (ECI) approach. Stage 1 to include preliminary design and ancillary services, and stage 2 detailed design and construction. Tender documents will be available on the supplying The South West online portal (www.supplyingthesouthwest.org.uk) for suppliers to download and complete from 24 August 2020.
The successful bidder will be asked to enter into two (2) separate, but linked agreements for delivery of the project: an NEC4 Professional Services Contract (June 2017) main option C for the carrying out of preliminary design and ancillary services (the ‘Stage 1 PSC’); and an NEC4 Engineering and Construction Contract (June 2017) main Option C for detailed design and construction (the ‘Stage 2 ECC’). At tender bidders are being asked to submit two (2) sums – a set of prices for the stage 1 PSC, and a set of prices for the stage 2 ECC. The prices submitted for the stage 2 ECC at this tender stage represents your initial target cost for the detailed design and construction stage of the project (your ‘Initial Target Cost’ or ‘ITC’). The successful tenderer will only be appointed to undertake stage 2 detailed design and construction phase of the project if instructed to do so by the Council. If the Council wishes the successful tenderer to undertake these
stage 2 activities, then it will (towards the end of stage 1) issue a ‘Confirmation of Notice to Proceed’ at the appropriate time. The ITC you submit for detailed design and construction may go up or down during stage 1. It may only be varied under and in accordance with the terms of the stage 1 PSC (and stage 2 ECC).

The Council does not bind itself to accept the lowest or any tender and shall not be liable for any loss or expense incurred by any bidder in the production of the tender or as a result of its decision not to award the contract to any bidder or to cancel the procurement process at any time. The Council may require a parent company guarantee, bond or similar from any or each tenderer to guarantee its obligations.
