II.2.4)Description of the procurement:

The Client now invites expressions of interest ("EoIs") to provide the consulting services described in the this notice and as further explained in the files available in ECEPP. Only applications submitted by registered users in ECEPP will be considered.

Following this EoI procedure, a shortlist of qualified firms will be formally established on the basis of the shortlisting criteria set out in this notice. Only the shortlisted consultants will be invited to submit proposals.

Procurement will be undertaken in accordance with the policies of the European Bank for Reconstruction and Development detailed in the EBRD Procurement Policies and Rules (“PP&R”) and the Guidelines for Clients Managing Donor or Loan Funded Consultancy Assignments (“Guidelines”), this notice and the Instructions to Consultants.

There are no eligibility restrictions based on the consultant's country of origin.

The invitation for Expressions of Interest is open to firms and joint ventures from all countries. The proceeds of the Bank's loan and WBIF grant will not be used for the purpose of any payment to persons or entities, or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations or under a law of official regulation of the Client's country.

III.1)Conditions for participation
III.1.2)Economic and financial standing
List and brief description of selection criteria:

Applicants shall meet the following criterion:

The audited financial statement and balance sheets for the past three years (2019-2021) must demonstrate the soundness of the applicant’s financial position, showing long-term profitability. Consistent losses or a risk of insolvency shown in the accounts may be cause for the disqualification of the Consultant;

In case of the Joint venture or Consortium, JV/Consortium partners must satisfy collectively all set criteria.

Individual partners must each satisfy the requirements for soundness of financial position.

III.1.3)Technical and professional ability
List and brief description of selection criteria:

Applicants shall meet the following criterion

- The applicant has successfully completed in the past five (5) years, counting from the deadline for submission of applications, one (1) or more consulting engineering contract(s) involving preparation of the preliminary and/or main design and/or works supervision and/or PIU Support Advisory for the project(s) involving construction of at least two (2) major road/motorway tunnels with application of New Austrian Tunneling Method (“NATM”) or similar tunnel excavation method, where implemented tunnels have a length of around 5.000 m and has been designed in accordance with Directive 2004/54/EC of the European Parliament and of the European Council on minimum safety requirements for tunnels in the Trans-European Road Network, will be considered an advantage. The candidate should demonstrate that it had a participation of minimum 50% in each of the project(s) brought as reference.

- The applicant has successfully completed in the past five (5) years, counting from the deadline for submission of applications, at least one (1) major consulting engineering contract involving the construction supervision, or PIU Support advisory on a major, IFI financed (EBRD/EIB/WB/ADB), road/motorway project implemented under FIDIC Conditions of Contract for plant and design-build for electrical and mechanical plant, and for building and engineering work, designed by the contractor (FIDIC Yellow Book) or similar with consultancy services value of around EUR 4 million. Experience with FIDIC Conditions of Contract for Underground Works (FIDIC Emerald Book) will be considered an advantage. The candidate should demonstrate that it had a participation of minimum 50% in the project brought as reference.

The contract shall be performed in accordance with the laws and regulations of BiH and the Entity of the Federation of Bosnia and Herzegovina governing the field of construction and civil engineering and the latest EBRD Procurement Policies and Rules, May, 2022.
