III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca în situatiile prevazute la art.164, 165, 167 din Legea nr.98/2016.

Totodata se solicita declaratie conf art.60/Legea 98/2016, care va fi prezentata de catre toti participantii la procedura de atribuire(ofertanti,terti sustinatori,subcontractanti ) odata cu depunerea DUAE pana la data limita a depunerii ofertelor

Modalitatea prin care poate fi demonstrata îndeplinirea cerin?ei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.

Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autorita?ii contractante, doar de catre ofertantii clasati pe primele trei locuri în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor. Aceste documente pot fi:

1. Certificate constatatoare privind lipsa datoriilor cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) la momentul prezentarii;

Referitor la certificatele fiscale - precizam ca acestea trebuie sa ateste LIPSA DATORIILOR RESTANTE LA MOMENTUL PREZENTARII ACESTORA-observatie valabila si pentru operatorii- persoane juridice/fizice straine, ce doresc a participa la procedura.

2. Cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv;

3. Dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizi?iile publice;

4. Alte documente edificatoare, dupa caz.

Mentionam ca in situatia operatorilor- persoane juridice/fizice straine, ce doresc a participa la procedura , acestea vor prezenta orice documente edificatoare, eliberate de autoritati competente din tara în care acestia sunt rezidenti, prin care sa dovedeasca îndeplinirea obligatiilor scadente de plata a impozitelor catre bugetul de stat si bugetul local, în conformitate cu legislatia din tara de rezidenta. Documentele se vor prezenta însotite de traducerea autorizata a acestora în limba româna.

NOTA: certificatele solicitate in cadrul acestei sectiuni pot fi prezentate in oricare dintre formele: original/copie legalizata/copie lizibila cu mentiunea “ conform cu originalul ”.

Operatorii economici ce depun ofertă trebuie să dovedească o formă de înregistrare în condițiile legii din țara de rezidență, să reiasă că operatorul economic este legal constituit, că nu se află în niciuna dintre situațiile de anulare a constituirii precum și faptul că are capacitatea profesională de a realiza activitățile care fac obiectul acordului cadru.

Modalitatea prin care poate fi demonstrată îndeplinirea cerintei: se va completa DUAE de către operatorii economici participanti la procedura de atribuire (inclusiv eventualii terti si subcontractanti) cu informatiile aferente situatiei lor.

Documentele justificative care probează îndeplinirea celor asumate prin

completarea DUAE, respectiv:

1. Certificat constatator emis de O.N.R.C - informatiile cuprinse in certificatul constatator trebuie sa fie reale/actuale la data prezentarii si din care sa reiasa ca obiectul contractului are corespondent in codul CAEN din Certificatul Constatator- pentru persoane juridice/fizice române;

2. Autorizatie de distributie angro eliberata de Ministerul Sanatatii- Agentia Nationala a Medicamentului- (in conf. cu art 788(1)Legea 95/2006 privind reforma in domeniul sanatatii, cu modificarile si completarile ulterioare; Ordinul ministrului sanatatii 1964/2008, art.2, pentru aprobarea normelor privind infiintarea, organizarea si functionarea unitatilor de distributie angro de medicamente de uz uman.);

3.Autorizatie de punere pe piata de la Agentia Nationala a Medicamentelor(Emisa de Agentia Nationala a Medicamentului, in baza art. 700 din Legea 95/2006 privind reforma in domeniul sanatatii, cu modificarile si completarile ulterioare;

Referitor la aceste cerinte - precizam ca persoanele juridice straine doritoare de a participa la procedura, vor prezenta documente care dovedesc o formă de înregistrare / atestare ori apartenenţa din punct de vedere profesional, in conformitate cu prevederile legale din tara in care ofertantul est rezident- documentele se vor prezenta însotite de traducerea autorizata a acestora în limba româna.Documentele justificative vor fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantii (în cazul asocierii de catre fiecare operator economic care face parte din asociere) clasati pe primele trei locuri în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor.

Precizam ca in situaţia în care doi sau mai mulţi ofertanţi sunt clasati pe primul loc avand oferte financiare cu preţul cel mai scăzut, atunci autoritatea contractantă va recurge la solicitarea de reofertare a preţului, prin intermediul facilitatilor SEAP.Aceiasi procedura se va aplica si pt ofertantii cu preturi egale clasati pe locul 2 si 3 din clasament, in cazul existentei acestei situatii. Cu privire la durata acordului cadru mentionam ca aceasta este de maxim 36 luni, insa in functie de dispozitiile forului tutelar-Ministerul Sanatatii acordul cadru se poate finaliza si la alta data(in interiorul celor 36 luni).Toate raspunsurile la clarificari cerute de catre operatorii economici sau formulate de catre autoritatea contractanta vor fi postate pe site-ul www.e-licitatie.ro. Acordul cadru va putea beneficia de clauze de revizuire(daca va fi cazul), in conditiile legale – in conformitate cu art. 221 din Legea 98/2016 si Instrucţiunea preşedintelui Agenţiei Naţionale pentru Achiziţii Publice nr. 3/2017 privind modificările contractului de achiziţie publică/contractului de achiziţie sectorială/acordului-cadru şi încadrarea acestor modificări ca fiind substanţiale sau nesubstanţiale.
