III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca în situatiile prevazute la art.164, 165, 167 din Legea nr.98/2016.

Modalitatea prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor. Aceste documente pot fi:

1.• certificate constatatoare privind lipsa datoriilor RESTANTE cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) la momentul prezentarii;

2.• cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv;

3.• dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice;

4.• alte documente edificatoare, dupa caz

Ofertantul, tertul sustinator si subcontractantul (dupa caz), nu trebuie sa intre sub incidenta art. 60 din Legea nr. 98/2016.Modalitate prin care poate fi demonstrata îndeplinirea cerintei: declaratie in acest sens, odata cu depunerea ofertelor.

Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de înregistrare în conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla în niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.

Modalitate prin care poate fi demonstrata îndeplinirea cerintei:

Loturile: 1,10,11,12,13,14,15,16,17,18,19,2,20,21,22,23,24,25,26,3,4,5,6,7,8,9 Specificati cifra de afaceri medie anuala Fisa de informatii generale cuprinzand cifra de afaceri anuala pe ultimii 3 ani(2019,2018,2017). Nivelul impus pentru cifra de afaceri anuala pentru anii 2019, 2018, 2017 esta ca aceasta sa fie mai mare sau cel putin egal cu valoarea celui mai mare contract subsecvent pentru lotul/loturile la care participa.

Documente justificative (bilanturi contabile, audituri financiare, alte documente) se vor prezenta la solicitarea autoritatii contractante doar de catre ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

Loturile: 1,10,11,12,13,14,15,16,17,18,19,2,20,21,22,23,24,25,26,3,4,5,6,7,8,9 Pentru contractele de achizitie de bunuri: executarea de livrari de tipul specificat Lista principalelor livrari de produse efectuate in cursul unei perioade care acopera ultimii 3 ani, cu indicarea valorilor, datelor si a beneficiarilor publici sau privati. Valorile trebuie sa acopere cel putin valoarea lotului/loturilor ofertate.

Loturile: 1,10,11,12,13,14,15,16,17,18,19,2,20,21,22,23,24,25,26,3,4,5,6,7,8,9 Pentru contractele de achizitie de bunuri: esantioane, descrieri sau fotografii, cu certificate de autenticitate Catalog/fisa tehnica/pliant,descrieri sau fotografii ale produselor care urmeaza a fi livrate, a caror autenticitate trebuie certificata la solicitarea autoritatii contractant, conform art. 179, alin. 1, din Legea nr. 98/2016.
