The aim of this invitation to tender is to enter into a framework contract to carry out the corresponding services for the management of sports and sociocultural facilities at the Office for Harmonization in the Internal Market (trade marks and designs). This involves the technical, economic and administrative management of sports facilities, excluding the cleaning and maintenance of permanent facilities and equipment.

Information and formalities necessary for evaluating if the requirements are met: tenderers shall be excluded from participating in this call for tenders if:
(a) they are bankrupt or being wound up, are having their affairs administered by the courts, have entered into an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning those matters, or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations;
(b) they or persons having powers of representation, decision making or control over them have been convicted of an offence concerning their professional conduct by a judgment of a competent authority of a Member State which has the force of 'res judicata';
(c) they have been guilty of grave professional misconduct proven by any means which the contracting authority can justify including by decisions of the EIB and international organisations;
(d) they are not in compliance with their obligations relating to the payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of the contracting authority or those of the country where the contract is to be performed;
(e) they or persons having powers of representation, decision making or control over them have been the subject of a judgment which has the force of 'res judicata' for fraud, corruption, involvement in a criminal organisation, money laundering or any other illegal activity, where such illegal activity is detrimental to the Union's financial interests;
(f) they are subject to an administrative penalty referred to in Article 109(1) of Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council of 25.10.2012 on the financial rules applicable to the general budget of the Union and repealing Council Regulation (EC, Euratom) No 1605/2002;

(h) they are guilty of misrepresenting the information required by the contracting authority as a condition of participation in the procurement procedure or fail to supply that information.
III.2.2)Economic and financial ability
Information and formalities necessary for evaluating if the requirements are met: in order to demonstrate his economic and financial capacity to carry out the framework contract, the tenderer must provide the following documentation:
— proof of relevant professional risk insurance cover for at least 500 000 EUR,
— bank references concerning the company's solvency,
— certified financial statements and external audit reports for the past 3 financial years for which accounts have been closed, or other equivalent documentation (e.g. where company law in the tenderer's country of residence does not require publication of balance sheets),
— statement as to overall turnover for the past 3 financial years,
— should the tenderers rely on the capacities of other bodies to carry out the contract, a written commitment from such bodies confirming that they will provide tenderers with the resources needed to carry out the framework contract.
Minimum level(s) of standards possibly required: the company must have a total minimum turnover of 150 000 EUR for the past 3 years for which accounts have been closed.

Information and formalities necessary for evaluating if the requirements are met:
— Presentation of the company (history, activities, etc.).
— Educational and professional qualifications of the company's managerial staff.
— Statement as to the average annual manpower of the company and the number of management staff of the service provider in the past 3 years.
— Declaration certifying that the company is able to put forward at least 2 people for each of the profiles who fulfil the minimum requirements specified for the development of web services. It is not possible to put forward the same person for different profiles.
— Recent proof of entry on the trade register.
— Declaration certifying that, should the tenderer be awarded the framework contract, and as services are to be provided on Spanish territory, he undertakes to comply with provisions under Spanish law as regards health and safety in the workplace.
Minimum level(s) of standards possibly required:
a total minimum turnover of 500 000 EUR is required for contracts carried out in the past 3 years for which accounts have been closed. Documentary proof of this must be furnished (e.g. copies of invoices).
