Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below
  • New works/services, constituting a repetition of existing works/services and ordered in accordance with the strict conditions stated in the directive
Explanation:

The initial contract was awarded for a total amount of 7 140 000 EUR covering the entire duration of the contract. However, the analysis of expenditure during the period already elapsed has led to the conclusion that this threshold will not be suffice to cover the needs of the European institutions until the expiry date of the contract i.e. 30.4.2021.

In accordance to point II.2.1) of the contract notice dated 14.10.2015 referred to in point IV.2.1) and its legal basis, as amended by Regulation (EU, Euratom) No. 2018/1046 of the European Parliament and of the Council of 18.7.2018, on 11.3.2019 the Commission launched a negotiated procedure to increase the overall maximum threshold of the contract.

Article 11 point e) of annex 1 pertaining to the Regulation (EU, Euratom) 2018/1046 stipulates that the contracting authority will be able to use the negotiated procedure for additional services (without prior publication of a contract notice) ‘for new services or works consisting in the repetition of similar services or works entrusted to the economic operator to which the same contracting authority awarded an original contract, provided that these services or works are in conformity with a basic project for which the original contract was awarded after issuance of a contract notice, subject to the conditions set out in point 11.4’, according to which ‘this procedure can only be used during implementation of the original contract and for a maximum period of three years once issued’.
