DfE — New Buildings for Southern Regional College — Banbridge
The project is for the development and construction of a new campus for Southern Regional College constructed on the existing Banbridge Site at Castlewellan Road. The project will include the following works:
— associated services and drainage,
— earthworks including cut/fill and removal of surplus excavated/unsuitable material,
— construction of new fully serviced campus building,
— site clearance including removal of existing college buildings and associated landscaping. The form of contract will be NEC3 Option A. Please refer to the procurement documents for further information.

CPD is assisting the CA in conducting the procurement process for this requirement, but for the avoidance of doubt, the contract will be entered into by Southern Regional College and the successful tenderer.The authority expressly reserves the rights:
(i) not to award any contract as a result of the procurement process commenced by publication of this notice or to cancel the procurement at any stage;
(ii) to make whatever changes it may see fit to the content and structure of the tendering competition;
(iii) to award (a) contract(s) in respect of any part(s) of the works covered by this notice and
(iv) to award contract(s) in stages and in no circumstances will the authority be liable for any costs, charges or expenses incurred by candidates irrespective of the outcome of the procurement process or if the procurement process is cancelled or postponed. Any expenditure, work or effort undertaken prior to contract award is accordingly at risk of the company participating
In this procurement process. Economic operators should be aware that up to the point the contract becomes unconditional, all costs, charges and expenses are the economic operator's and the Contracting Authority will not reimburse any costs incurred prior to this stage. All discussions and correspondence shall be deemed strictly subject to contract until the contract is entered into the contract shall not be binding until it has been signed and dated by duly authorised representatives of both the Southern Regional College and the economic operator team. All dates and time periods specified in the procurement documents are provisional only and the Contracting Authority reserves the right to change these. This project will be used to progress the Government's
Wider social, economic and environmental objectives.

This procurement is governed by the Public Contracts Regulations 2015 which provides for economic operators who have suffered, or who risk suffering, loss, or damage, as a consequence of an alleged breach of the duty owed in accordance with Regulation 91 to start proceedings in the High Court. A standstill period will commence at the point information on the award of the contract is communicated to tenderers. That notification will provide information on the award decision. The standstill period, which will be for a minimum of 10 calendar days, provides time for unsuccessful tenderers to challenge the award decision before the contract is entered into. Any proceedings relating to any perceived non-compliance with the relevant law must be started within
30 days, beginning with the date when the economic operator first knew, or ought to have known that grounds for starting the proceedings had arisen.
