III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

1. Neîncadrarea în prevederile art. 165 din Legea 98/2016.

Nota: se solicita atât ofertantului, ofertantului asociat, subcontractantului, cât si tertului sustinator;

2. Neincadrarea la prevederile art. 164 din Legea nr. 98/2016.

Nota: se solicita atât ofertantului, ofertantului asociat, subcontractantului, cât si tertului sustinator;

3. Neincadrarea la prev. art. 167 din Legea nr. 98/2016.

Nota: se solicita atât ofertantului, ofertantului asociat, subcontractantului, cât si tertului sustinator;

4. Declaratia privind neincadrarea în situatiile prevazute de la art. 60 din Legea nr. 98/2016, document atasat la modele de formulare, declaratia va fi completata de toti participantii (ofertantii, tertii sustinatori si subcontractantii) odata cu depunerea DUAE;

5. Persoanele cu functii de decizie din cadrul autoritatii contractante în ceea ce priveste organizarea, derularea si finalizarea procedurii de achizitie sunt:

Potrivit prevederilor art. 193 din Legea 98/2016, autoritatea contractanta va accepta in cadrul ofertelor DUAE (Documentul Unic de Achizitie European) in locul documentelor solicitate in vederea demonstrarii cerintelor de calificare, inclusiv a capacitatii de exercitare, ca dovada preliminara. Înainte de atribuirea acordului-cadru, autoritatea contractanta va solicita ofertantilor clasati pe primele trei locuri, sa prezinte documentele justificative actualizate prin care sa demonstreze îndeplinirea tuturor criteriilor de calificare, în conformitate cu informatiile cuprinse în DUAE.

DUAE se va depune, dupa caz si de catre tertul sustinator/subcontractanti;

6. Certificat de atestare fiscala eliberata de administratia financiara; operatorii vor depune aceste certificate pe parcursul evaluarii, ca documente justificative actualizate prin care demonstreaza indeplinirea criteriilor de calificare in conformitate cu informatiile cuprinse in DUAE, iar acestea trebuie sa ateste lipsa datoriilor restante la momentul depunerii acestora;

7. Certificat de atestare fiscala pt. persoane juridice privind impozitele si taxele locale si alte venituri ale bugetului local – eliberat de primarie; operatorii vor depune aceste certificate pe parcursul evaluarii, ca documente justificative actualizate prin care demonstreaza indeplinirea criteriilor de calificare in conformitate cu informatiile cuprinse in DUAE, iar acestea trebuie sa ateste lipsa datoriilor restante la momentul depunerii acestora.

Nota: ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art.164, 165, 167 din Legea nr. 98/2016 si cu art. 60 din Legea 98/2016.

Nota: certificatele solicitate in cadrul acestei sectiuni pot fi prezentate in oricare dintre formele: original/copie lizibila cu mentiunea „conform cu originalul”.

Modalitatea prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.

Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, de catre ofertantii clasati pe primele trei locuri in clasamentul intermediar întocmit la finalizarea evaluarii ofertelor.

Ref. la cerintele privind motivele de excludere, documentele pot fi:

1. certificate constatatoare privind lipsa datoriilor cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) la momentul prezentarii;

2. cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/actul constitutiv;

3. dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice;

4. declaratia privind neincadrarea în situatiile prevazute de la art. 59-60 din Legea nr. 98/2016.

Certificat constatator emis de Oficiul Registrului Comertului. Informatiile din certificatul ORC trebuie sa fie reale/actuale la data prezentarii acestora.

Modalitatea prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE, respectiv certificatul constatator emis de ONRC sau în cazul ofertantilor straini, documentele echivalente emise în tara de rezidenta; urmeaza ca documentele justificative sa fie prezentate, doar la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele trei locuri în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor.

Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla în niciuna dintre situatiile de anulare a constituirii, precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.

Aviz de functionare eliberat de Ministerul Sanatatii, conform Legii 95/2006 modificata prin OUG 2/2014 art. 888, pentru care depune oferta, completand in acest sens in DUAE, urmând ca documentele justificative sa fie prezentate, doar la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele trei locuri în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor.

Pentru ofertantii straini respectiv avizul emis de MS, cf. Legii 95/2006 modificata prin OUG 2/2014 art. 888 sau documente echivalente emise in tara de rezidenta si sa fie prezentate, doar la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele trei locuri în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor.

Pentru persoane juridice straine: documente care dovedesc o forma apartenenta din punct de vedere profesional, în conformitate cu prevederile legale din tara în care candidatul/ofertantul este rezident, traduse în limba româna.

Daca exista asociati, documentele solicitate vor fi depuse si de catre acestia pentru partea pe care o realizeaza, doar la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele trei locuri în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor.

Se va depune fisa cu informatii generale privind cifra medie de afaceri globala care acopera activitatea din cel mult ultimii trei ani raportati la termenul-limita de depunere a ofertelor.

Loturile 1, 10, 11, 12, 13, 14, 15, 16, 2, 3, 4, 5, 6, 7, 8, 9. Pentru contractele de achizitie de bunuri: executarea de livrari de tipul specificat. Se va prezenta lista principalelor livrari de produse similare in ultimii trei ani.

Se va prezenta lista principalelor furnizari de produse in cursul unei perioade care acopera cel mult ultimii trei ani raportati la termenul-limita de depunere a ofertelor, din care sa rezulte ca a furnizat produse similare.
